Ratificatioun to the Erll Merschell anent the college in Abirdene

Oure soverane lord and estaitis of this present parliament, understanding that George, erll Merschell, lord Keith etc. hes laitlie foundit and erectit ane college within the burgh of New Abirdene and dotit the same with dyvers rentis and patrimony of his awin propre landis, for advanceing of the quhilk also the provest, ballies, consaill and communitie of the said burgh hes gevin to the said erll the place, kirk, clois and yard quhilkis appertenit sumtyme to the gray freiris of Abirdene to be annext to the said college, as at mair lenth in the lettrez of fundatioun and erectioun of the said college is contenit. Thairfoir his hienes and estaitis foirsaidis ratifies, apprevis and confermis the said fundatioun and erectioun quhilk is of the dait the [...] day of Aprile jM vC fourscoir threttene yeiris, with all the clauses, articles, heidis and conditionis thairin contenit, and forder gevis and disponis thairto all fredomes, franchises, liberties, frie privilegis and jurisdictioun that to ane frie college within this realme be law and practik is knawin to apertene, provyding alwayes that the masteris, memberis, studentis, bursaris and haill inhabitantis of the said college is and salbe in all tymes heirefter subject to the jurisdictioun of the provest, ballies and counsaill of the said burgh of Abirdene in all thingis to be done or committit be thame outwith the wallis of the said college and within the territores or fredome of the said burgh.

Oure soverane lord and estaitis of this present parliament, remembring that the toun and heavin of Piterheid wes erectit in ane burgh in baronie be oure said soverane lord, and understanding perfytlie that the samyn hes bene in all tymes bygane ane veray commodious recept for schippis and boittis of all the leigis of this realme and strangearis reparing thairto, upoun apparrelling of the quhilk heavin, George, erll Merchell, proprietar thairof, hes bestowit large expenses and yit the samyn will have neid of mekle mair befoir the said heavin may be brocht to perfectioun; thairfor oure said soverane lord and his saidis estaitis of parliament hes gevin and grantit to the said George, erll Merschell ane impost of tuentie pennies for everie last of guidis cumand in at the said port, and gangand furth of the samyn, comptand xx bollis of wictuall to the last, and sua furth in uther guidis according to the wait and quantitie thairof; and the said impost to indure for the space of fyve yeiris nixt efter the dait heirof, and with power to the said George, erll Merschell, his servandis and factoris in his name, to arreist, poynd and distrenyie thairfoir during the space forsaid.

Oure soverane lord and estaitis of this present parliament, considdering that Andro, commendater of Jedburgh, having rasit lettrez befoir the lordis of sessioun for annulling and simpliciter suspending of the lettres of horning rasit be sex sindre parties clameand richt to the monkis portionis, superplus and temporalitie of the said abbacie of the croppis and yeiris of God jM vC lxxxvij, lxxxviij, lxxxix, lxxxx, lxxxxj and lxxxxij yeiris, as the lettrez of suspensioun rasit thairupoun in the self at lenth beris; quhilk being callit, Roger Ashintoun, gentleman in his hienes chalmer, and his majesties thesaurair, comptrollar and advocat for his hienes entres, Robert Kirktoun and Robert Trottar comperit be thame selfis and thair procurators, and the said mater being ressonit viva voce in presens of the saidis lordis of sessioun and the parteis richtis producit finding the questionis to arryis throw the multitude of the actis of parliament maid anent the saidis monkis portionis, superplus of benefices and annexatioun of temporall landis to the croun, remittit the decisioun of the foirsaid actioun and caus to his hienes and his saidis estaitis for certane ordour to be taken and sett down concerning the saidis monkis portionis, and to reduce all the actis of parliament maid ofbefoir thairanent to ane certane act and rule, quhairby the saidis lordis of sessioun may proceid summerlie to the decisioun of all sic causes, as the act maid thairupoun beris. And it is trew that the said Roger Ashetoun hes assignit and disponit to him in pensioun the foirsaid sowmme of ijC lxxvj lib. xvj s. viij d. furth of the temporalitie of the said abbacie of Jedburgh, and the said Robert Trotter and Robert Kirktoun hes the haill monkis portionis of the foirsaid abbacie disponit to thame, and the superplus is assignit to the ministrie, sua that the said commendater is altogidder defraudit baith of that pert of his temporalitie and als of the foirsaid superplus and monkis portionis quhilk wes assignit to him in recompense thairof; thairfoir, and seing the saidis monkis portionis ar disponit to Robert Trotter and Robert Kirktoun and the superplus of the said abbacie assignit to the said ministrie, oure soverane lord and estaitis foirsaidis reponis the said Andro, commendater of Jedburgh to his awin richt of the temporalitie of the said abbacie during his lyvetyme, as gif the samyn haid nevir bene takin fra him; and dischargis the said Roger Aschetoun and all utheris off all forder trubling of the said commendater thairanent, notwithstanding ony gift or dispositioun maid to thame of the samyn at ony tyme heirtofoir during the said commendataris lyvetyme as said is.

Oure soverane lord, with advise of the estaitis of this present parliament, ratifies and apprevis and for him and his successouris perpetuallie confermis the infeftment, gift and dispositioun maid, gevin and grantit to Andro, lord Uchiltrie of the landis of Erlistoun, liand within the schirefdome of Wigtoun, sumtyme pertening to Frances, sumtyme erll Bothuill, and fallin and becum in his majesties handis be the dome of foirfaltour ordourlie led and deducit aganis the said Frances, sumtyme erll Bothuill, and gevin, grantit and disponit to the said Andro, lord Uchiltrie with all richtis, privilegis and commodities belanging and pertening to the saidis landis, conforme to the said Androis giftes, infeftmentis and richtis thairof gevin and grantit to him of the samyn landis. Thairfoir oure said soverane lord and estaitis of this present parliament, for the causes contenit in the said charter, and for the guid, trew and thankfull service done to his majestie and his hienes maist noble progenitouris of worthie memorie be his hienes said trustie and weilbelovit counsellour Maister George Lauder of Bass and utheris his predicessouris quhome of he hes lineallie discendit in all tymes bygane, as become trew and faithfull subjectis without defectioun frome thair loyall and dewtifull obedience, hes ratifiet, apprevit and confermit and, be the tennour of this present act, for him and his hienes successouris, ratifies, approvis and perpetuailie confermis the foirsaid charter and infeftment in all the heidis, pointis, clauses, articles, circumstances, immunities, privilegis and conditionis at lenth contenit thairin, efter the forme and tennour of the same in all pointis. And als his majestie and estaitis foirsaid, be the tennour heirof, decernis, declaris and ordanis the samyn to be als effectuall, valide and sufficient to the said Maister George and his foirsaidis for thair peceablie bruiking, joysing and possessing of the saidis haill landis, office of balliarie, port and heavin, burgh of baronie, privilegis, liberties and immunities and all utheris speciallie and particularlie contenit in the said charter perpetuallie in all tymes cuming siclyk as gif the said charter and infeftment wer at lenth insert and contenit word be word in this present act, notwithstanding that the samyn is not insert nor contenit heirin.
