Annexatioun of the abbey of Dumfermling to the crown

Item, becaus it is understand that the povertie of the croun is the speciall caus of the povertie of the realme and inhabitantis thairof, and that the patrimonie of the croun, being augmentit, is the greit weill and proffite baith of the kingis grace and to his leigis, thairfoir oure soverane lord, with consent of his estaitis, unittis, annexis and incorporattis to the croun of this realme to remane thairwith as propre annext patrimonie and propirtie thairof in all tyme cuming and with oure soverane lord and his successouris for evir all and haill the landis, lordschippis, baronies, mylnes, multuris, woddis, schawis, parks, fischingis, townis, villages, burrowis, regalitie, baronies, annuelrentis, tenementis, reversionis, custumes greit and small, fewfermes, places, houses, biggingis, castellis, towris, maner places, yardis, orcheardis, kirkis, teyndis gryt and small, fruittis, rentis, emolumentis and all and sindrie utheris commodities and proffeittis quhatsumevir, tennentis, tennandries and serrvice of frie tennentis, alsweill to burgh as to land, quhilkis in ony maner of way pertenit or may pertene to the abbacie or monasterie of Dumfermling, liand upoun the north syd of the watter of Forth allanerlie, to be in all tymes heieftir repute and haldin the propirtie and patrimonie of the crown, to remane thairwith in all tyme cuming efter the forme, tennoure and ordoure of the actis of annexatioun maid in the tyme of oure soverane lordis predicessouris, King James the secund and King James the fyft, and conforme to all the clauses, conditionis and circumstances thairof, quhilkis in all pointis ar haldin and understand as expressit and specallie contenit in this present act in all tyme heireftir. It is likwayes declarit be oure said soverane lord and his saidis estaitis that in the said annexatioun of the temporall landis of the foirsaid abbacie of Dumfermling, lyand upoun the north syd of the watter of Forth, ar nawayis comprehendit the baronies of Brint Iland, als Wester Kinghorne, and Newbirne, with annexis and connexis thairof, quhilkis pertenit to the said abbacie of Dumfermling ofbefoir, and lyis upoun the north syd watter of Forth, and quhirin Schir Robert Melvill of Murdocarny, knicht, and Schir Robert Melvill, his eldest sone and apperand air, and Andro Wod of Largo wer infeft respective. And forder, oure said soverane lord and his saidis estaitis willis and declaris that the saidis baronies, with thair annexis and connexis, sall remane in all tyme cuming as seperat baronies and nawyis to be comprehendit in the said annexatioun, with speciall provisioun that all the teyndis of the saidis landis and lordschip of Dunfermling salbe understand be vertew of this act annext to the croun efter the forme and tennoure of the said generall act of annexatioun maid in the yeir of God jM vC lxxxvij yeris; and als all the teyndis of the remanent prelaciis and kirklandis of this realme ar annext to the croun. It is alwayes declarit be oure said soverane lord and his estaitis of parliament that the lordschip and baronie of Mussilburgh schire, with annexis and connexis, frie regalitie, partis and pendicles of the samyn, ar nocht comprehendit in the said annexatioun, nor sall nocht be comprehendit in ony annexatioun to follow heireftir, becaus the said lordschip and baronie, with annexis, connexis, fre regalitie, partis and pendicles of the samyn, being ane pairt of the patrimonie of the said abbacie of Dumfermling, wes exceptit furth of the first generall annexatioun of the kirklandis to the croun; and Johnne, lord of Thirlestane, chancellar to oure said soverane lord, and Dame Jeane Fleming, his spous, for thame and thair aris, wer heretablie infeft thairin, quhilk lordschip and baronie thay have laitlie resignit in oure said soverane lordis handis for infeftment of lyverent thairof gevin to the quenis majestie for all the dayis of hir hienes lyftyme, and for ane uther infeftment of the heretable fie thairof gevin to the said Johnne, lord Thirlestane, chancellair foirsaid, his said spous and thair aris maill and of tailyie heretablie. Quhilkis infeftmentis oure said soverane lord, with advise and consent of his foirsaidis estaitis, ratifies and confermis be thir presentis and for his hienes and his successouris willis and grantis that the samyn stand in full force, steid and effect in all tyme heireftir. And ordanis the said new infeftment gevin to the said Johnne, lord of Thirlestane, his spous and thair aris foirsaidis to be insert in the buikis of perliamet gif neid be.
