Oure soverane lord and estaitis of this present parliament considdering how his hienes hes bene grytumlie circumvenit in granting of new infeftmentis to sindrie personis of thair landis, including thairwth be thair inoportune sute the advocatioun, donatioun and richt of patronage of dyvers kirkis and benefices quhilk nevir pertenit to thame ofbefoir bot to his majesties presentatioun, speciallie quhair the personis providit thairto is yit on lyff and the richt of the patronage of thair benefice purchest and takin during thair lyftyme without thair consent or knawlege, tending thairby to appropriat the fruittis of the said benefices quhen samyn sall vaik to thair particuler uses, not onlie to the greit hurt of his hienes and prejudice of the kirk, quhairby all convenient occasioun is abstractit frome his hienes to gratifie qualifiit personis quha hes travellit and ar able to serve the functioun of the ministrie and preaching of the evangell, bot als to the greit hasart and danger of the personis provydit to the saidis benefices yit on lyve. For remeid quhairof, oure soverane lord and estaitis foirsaidis hes statute and ordanit and be the tennoure heirof decernis and declaris all sic infeftmentis grantit in tymes bypast, or to be grantit in tymes cuming be his hienes contenand the gift and dispositioun of the richt of ony patronage, advocatioun and donatioun of benefice quhilk pertenit ofbefoir to his hienes gift and presentatioun quhairof the beneficit persoun wes for the tyme or salhappin to be on lyve the tyme of the granting of the said infeftment and thair consent not haid and obtenit thairto, hes bene fra the beginning and salbe in all tyme cuming null and of nane availl, force nor effect safar as concernis the dispositioun off the richt of the patronage of the saidis kirkis bot forder proces or declaratour of ony juge to be gevin thairupoun; and the said advocatioun, donatioun and richt of patronage of the saidis benefices to returne to his hienes and at his hienes dispostioun and presentatioun frelie as the same wes befoir the granting of this said infeftment and as gif the saidis infeftmentis haid nevir bene grantit, but prejudice alwayes of the saidis infeftmentis anent the remanent landis thairin contenit, quhilk sall remane in the awin strenth and effect, and this nullitie to be ressavit summarlie be way of exceptioun, reply or objectioun, dischargeing all jugeis within this realme to grant ony proces upoun the richt of the said patronage be vertew of the saidis infeftmentis, bot to hald the same as not expressit thairin, provyding that sasone as the beneficit manis awin consent may be haid and obtenit to the said infeftmentis, the same to be als sufficient and effectuall as gif thair consent haid bene obtenit thairto frome the beginning, reservand alwayes to the kingis majestie libertie to except sic out of this act as he sall deliver to the clerk of register within aucht dayis efter the dait heirof. According to the quhilk reservatioun, his majestie exceptit furth and from the said act the infeftmentis grantit be his hienes to the personis efter following contening advocatioun, donatioun and richt of patronage of the kirkis, benefices and chaiplanries efter specifiit, that is to say to Walter, prior of Blantyre, kepair of the privie seill in favoure and to the behuif of Ludovik, duke of Lennox, erll Darnelie, lord Torboltoun, Methven and Aubigny, the advocatioun, donatioun and richt of patronage off all and sindrie kirkis, personages and vicarages belanging and pertening to the archebischoiprik of Glasgow; as also the advocatioun, donatioun and richt of patronage of all and sindre kirkis, personages and vicarages belanging and pertening to the archebischoiprik and priorie of Sanctandrois gevin, grantit and disponit be his majestie to his darrest cousing Ludovik, duke of Lennox etc., his aris and assignais mentionat in the infeftment maid to him thairupoun; to Johnne, lord of Innermaith of the advocatioun and donatioun of the paroche kirk of Mukarsie; to Andro, lord Stewart of Uchiltrie of the infeftment of the landis of Uchiltrie and Erlistoun, with the advocatioun and donatioun of the personages and vicarages thairin contenit; to Johnne, lord of Thirlestane, chancellair of this realme, off the infeftmentis of the lordschip of Dunbar, the baronies of Eddilstoun and Stobo, with the advocatioun and donatioun of the benefices, chaiplanries and utheris contenit in the infeftmentis grantit be his hienes to the said lord chancellair thairupoun; to umquhile James, maister of Sincler and his aris of the advocatioun and donatioun of the personage and vicarage of Dysert; to Alexander, lord of Spynie of the landis, lordschip and baronie of Spynie, with the advocatioun, donatioun and richt of patronage of the kirkis, personages, vicarages and chaiplanries thairin contenit; to Schir Robert Melvill of Murdocarny, knicht, theasurer depute, of the advocatioun, donatioun and richt of patronage of the kirk of Monymail, personage and vicarage thairof; to Schir Johnne Cokburne of Ormeistoun, knicht, justice clerk, the richt of the patronage of the perroche kirk of Ormeistoun, now annext to the baronie of Ormeistoun; to Schir Williame Keith of Delnies, knicht, of the landis and baronie of Delny, with the advocatioun, donatioun and richt of patronage of the kirkis, personages, vicarages and chaiplanries thairin contenit; to Johnne Levingstoun, younger, of Donypace of the landis and baronie of Craigis, with the advocatioun and donatioun of the richt of patronage of the kirkis of Stracathro, Buttergill and Kilmoir; to Schir Patrik Waus of Barnebarrauche, knicht, of the landis and baronie of Barnebarrauche, lyand within the schirefdome of Wigtoun, with the advocatioun, donatioun and richt of patronage of the kirkis of Kirkynner, Kirkcowane, Cammanell and Wigtoun; to Maister David McGill of Cranstoun Riddell, advocat to oure soverane lord, in lyfrent, and to Maister David Makgill, younger, of the landis and baronie of Cranstounriddell, with annexis, connexis thairof, lyand within the schirefdome of Edinburgh and constabularie of Hadingtoun, with advocatioun, donatioun and richt of patronage of the personage and vicarage of the same; to Johnne Stewart, schireff of Bute, of the advocatioun, donatioun and richt of patronage of the personage and vicarage of Rothesay; to Schir Walter Ogilbie of Findleter, knicht, of the advocatioun, donatioun and richt of patronage of the paroche kirk of Fordyce and pendicles thairof; to Schir David Lindsay of Edzell, knicht, of the advocatioun, donatioun and richt of patronage of the paroche kirkis of Edzell, Ferne and Newdosk; to Johnne Hay of Urie of the advocatioun, donatioun and richt of patronage of the paroche kirk of Creichmond; to Alexander Fraser of Phillorth of the advocatioun and richt of patronage of the kirkis of Tyrie and Rathin; and to Patrik Mowett of Buquhollie the advocatioun, donatioun and richt of patronage of the kirkis of Cannesbie, personage and vicarage thairof, togidder with the advocatioun, donatioun and richt of patronage of the personage of Olrig to George Sincler of Maii; all quhilkis befoir exceptit his hienes declaris sall not be comprehendit under the said act.
