†Oure soverane lord, now efter his aige of xxv yeiris, with avise of the estaitis of this realme and haill bodie of this present parliament, ratifies, apprevis and, for his majestie and his successouris, perpetuallie confermes the charter and new infeftment, donatioun, dispositioun and renunceatioun thairin contenit, maid and grantit be his hienes efter his perfite age of xxj yeris compleit and generall revocatioun declarit in parliament, to his majesties lovit Dame Agnes Leslie, spous to his hienes richt traist cousing and counsallour, Williame, erll of Mortoun, lord Dalkeith, during all the dayis of hir lyvetyme, off all and haill the castell, palice, toure and fortalice of Dalkeith, with yardis, orcheardis, parkis, wodis, mylnis, fischingis, dowcattis and thair pertinentis, under provisioun that the said Dame Agnes suld keip and preserve the saidis woddis or cut nane thairof, or dispone thairupoun, except samekle as suld be necessar to the housis and mylnis contenit in the said infeftment undirwrittin, togidder with the propirtie off all and sindre the landis and utheris particularlie efter following specifiit thairintill; and to the said Williame, erll of Mortoun, his aris maill, of talyie and assignais efter specefiit in fie heretablie, off all and haill the erledome of Mortoun, contenand the particular landis, lordschippis, baronies and regalitie efter mentionat, at lenth specefiit in the said infeftment under the greit seill of the dait at Edinburgh, the xx day of Junii, jM vC lxxxix yeiris; togider with the uther infeftment of confermatioun of the foirsaid infeftment, contening thairin ane new dispositioun and renunceatioun in maner following, maid and grantit be his majestie efter his aige of xxv yeiris compleit to the said Dame Agnes Leslie in lyfrent during all the dayis of hir lyftyme, off all and haill the said castell, palice, tour and fortalice of Dalkeith, with the yardis, orcheardis, woddis, mylnis, fischingis and utheris particularlie efter specefiit contenit in the said infeftment, and to the said Williame, erll of Mortoun, his aris maill, of talyie and assignais under specifiit, contenand the particular landis, lordschippis, baronies, regalitie and utheris efter mentionat of the said erledome of Mortoun, at lenth specefiit in the said infeftment under the greit seill of the dait at Haliruidhous, the xxix day of Maii, the yeir of God jM vC fourscoir tuell yeiris, with all and sindre utheris infeftmentis, services, retouris and sasingis past thairupoun, grantit to the said Williame, erll of Mortoun or ony of his predicessouris upoun the said erledome of Mortoun, lordschip and regalitie of Dalkeith or ony part thairof in ony tyme bygane, in all and sindrie pointis, pasis, articles, clausis, immunities, privilegeis, liberties, conditionis and circumstances quhatsumevir thairin contenit; and decernis and declaris for his majestie and his successouris foirsaidis that the samyn infeftmentis, services, retouris and sasingis past and maid in favouris of the said Williame, erll of Mortoun and his foirsaidis presentlie ar, haif bene sen the first making thairof and salbe in all tyme cuming effectuall, guid, valide and sufficient in thame selffis to the said Williame, erll of Mortoun, his aris maill, talyie and assignais specifiet thairin for the peceable bruiking and joysing of the said haill erledome of Mortoun, lordschip and regalitie of Dalkeith, contening the particular landis, lordschippis and utheris following contenit in the saidis infeftmentis and utheris abonewrittin, perpetuallie and in all tyme cuming according to the tennouris and substance thairof in all pointis, notwithstanding quhatsumevir richt oure said soverane lord or his successouris hes or may pretend thairto or ony of the liberties and privilegeis contenit thairin, be foirfaltour, inhabilitie of ony persoun or personis, or yit his majesties revocatioun maid in this present parliament at ony tyme befoir, or ony utheris hienes actis, lawis, statutis or constitutionis of this realme, generall or speciall, maid to the prejudice or derogatioun of the foirsaidis infeftmentis, services, retouris or sesingis following thairupoun, or ony of the liberties or privilegiis exprest in the same, under the quhilk the same, nor na part thairof, sall nevir be comprehendit be na maner of way.
