†Oure soverane lord and estaitis of this realme assemblit at this present parliament, understanding that his majestie, efter his aige of tuentie ane yeris and making of the act of annexatioun of the temporall landis of all prelaciis within this realme to the patrimonie of his hienes croun, and dissolutioun thairin concludit with advise and consent of Johnne, lord Thirlestane, chancellar of this realme, Thomas, maistir of Glammis, thesaurair, umquhile Schir Lues Ballenden of Auchnoule, knicht, justice clerk, and Maistir Robert Douglais, provest of Lincluden, collectour generall to his hienes, be his charter and infeftment under the greit seill of the dait at Haliruidhous, the first day of November, the yeir of God jM vC lxxxvij yeiris, sett in fewferme heretablie to umquhile Schir Williame Stewart, knicht, sone lauchtfull to umquhile Andro, lord Stewart of Uchiltrie, his aris and assignais quhatsumever, all and haill the landis and baronie of Carstaris undirwrittin, extending to ane fourtie aucht pund land of auld extent, with the mylne of the samyne, with partis, pendicles, annexis, connexis, tennentis, tenandries, service of frie tennentis, advocatioun, donatioun and richt of patronage of benefices of the samyne, togidder with the office of balliarie of the foirsaidis landis and baronie and all fies and dewties pertening thairto; lyk as his majestie thairefter, upoun the said umquhile Schir Williame resignatioun thairof, deulie and lauchtfullie maid in his handis befoir his deceise in favouris of the personis undirwrittin for greit sowmes of monie payit be thame thairfoir to the said umquhile Schir Williame be his charter and infeftment under the greit seill, off the dait at Halyruidhous, the xxix day of Julii, the yeir of God jM vC lxxxviij yeiris, with avise foirsaid, infeft and seasit James Hammiltoun of Libbertoun and Cristiane Boyid, his spous, the langest levar of thame tua in conjunctfie or lyfrent, during all the dayes of thair lyftymes, and James Hammiltoun, thair eldest sone and apperand air, and his aris maill lauchfullie to be gottin of his bodie, quhilkis falyeing to Thomas Hammiltoun, also thair lauchfull sone, and his aris maill lauchfullie to be gottin of his bodie, quhilkis all falyeing, to the narrest and lauchtfull aris maill and of talyie of the said James Hammiltoun, eldair, specifiit and contenit in his new infeftment and charter taillie of his landis and lordschip of Avendaill and assignais quhatsumevir, off all and haill the foirsaidis landis and baronie of Carstaris, with the mylne, office of balliarie and utheris partis and pertinentis of the same abonewrittin, specifiit in the said infeftment, berand ane new gift and dispositioun thairintill off the saidis landis and baronie with the pertinentis of the samyne abone rehersit, with advocatioun, donatioun and richt of patronage of the personage and vicarage of the paroche kirk of Carstaris with the chaiplanrie callit [...] pertening thairto, and office of balliarie abone specefiit, and all thair pertinentis, to be haldin off his majestie and his successouris in fewferme, for payment of the fewferme and dewtie mentionat in the said infeftment. And lyk as his hienes sensyne, for ane lairge sowme of money pait to his hienes and his thesaurair foirsaid, be ane uther infeftment maid be his majestie with avise of the saidis counsellouris and present officiaris of the estait, efter his aige of xxv yeris compleit, past under the greit seill of the dait at Halyruidhous, the tent day of November, the yeir of God jM vC lxxxxj yeiris, nocht onlie ratifiet the foirsaid infeftment of fewferme, maid and grantit be his hienes with avise foirsaid to the said James Hammiltoun of Libertoun and Cristiane Boyid, his spous, in lyfrent, and to the said James Hammiltoun, thair sone and apperand air, his aris maill and of talyie and assignais abonewrittin in fie heretablie, off all and haill the foirsaidis landis and baronie of Carstaris, with the mylne of the samyne, advocatioun, donatioun and richt of patronage of the benefices thairof, togidder with the office of balliarie of the said baronie, and utheris partis, pendicles and pertinentis of the same abone rehersit, bot also thairby of new gaif, grantit and disponit, infeft and seasit the said James Hammiltoun of Libertoun and Cristiane Boyd, his spous, in lifrent, and the said James Hammiltoun, thair sone and apperand air, and his aris maill, of talyie and assignais foirsaidis in fie heretablie, in all and haill the saidis landis and baronie of Carstaris, with the maner place, mylne, mylne landis, multuris and suckin of the saidis haill landis and baronie, advocatioun, donatioun and richt of patronage of the parsonage and vicarage of the said paroche kirk of Carstaris and vicar landis thairof, with the chaiplanrie, callit [...] pertening thairto, togidder with the office of ballarie foirsaid and all fies and dewties belanging thairto, tennentis, tenandries and service of frie tennentis thairof, and all thair pertinentis, to be haldin of his majestie and his successouris in fewferme heretablie, for payment of the fewferme and dewtie thairin contenit as the foirsaidis thrie infeftmentis under the greit seill and sasingis following thairupoun at mair lenth proportis. And now his majestie and estaitis foirsaidis, haveand dew consideratioun of the premisis and of the greit sowmes of money, alsweill payit be the said James Hammiltoun of Libbertoun to the said umquhile Schir Williame Stewart for the foirsaidis landis and barony, with the pertinentis foirsaidis, as to his hienes and his thesaurair in his name, for ressaving of the ressignatioun, granting of confirmatioun and making of new dispositioun of the samyne to him and his said spous in lyfrent, thair sone foirsaid, his aris maill, of talyie and assignais in fewferme and fie heretablie, and thairwithall, considdering that his majestie nor his successouris ar be granting of the foirsaidis infeftmentis na thing diminischit, nor imparit in thair patrimonie nor proffite, bot rather ar thairby augmentit, as alsua his hienes respecting the guid, trew and thankfull service done to his majestie and his maist noble progenitouris be the said James and his predicessouris to the advancement of his majesties honour, weill and decoratioun of the realme, his hienes, thairfoir, with avise of the saidis estaitis of parliament, hes ratifiet and approvin and, be the tennour heirof, ratifies, apprevis and, for his majestie and his successouris, perpetuallie confermes the foirsaidis infeftmentis respective abonewrittin off the daitis particularlie abone specefiit, or of quhatsumevir uther dait or daitis thay be off, in all and sindrie pointis, pasis, articles, clausis, immunities, privilegis, liberties, conditionis and circumstances quhatsumevir contenit thairin; and decernis and declaris that the saidis infeftmentis presentlie ar, have bene sen the first granting thairof and salbe, in all tyme cuming, effectuall, valide, guid and sufficient in thame selffis to the said James Hammiltoun of Libertoun and Cristiane Boyid, his spous, the langer levar of thame tua during all the dayis of thair lyftymes, and efter thair deceisis to the said James Hammiltoun, thair sone and apperand air, his aris maill, of talyie and assignais abonewrittin in fie heretablie, for peceable bruiking and joysing of the foirsaidis landis and baronie of Carstaris, with the maner place, mylne, mylne landis, multuris and suckin of the said haill baronie, advocatioun, donatioun and richt of patronage of the parsonage and vicarage of the foirsaid paroche kirk of Carstaris, with the chaiplanrie abone specefiit pertening thairto, and vicar landis of the samyne abone mentionat; togidder with the office of balliarie off the foirsaid baronie and all fies and dewties thairto apertening, with tennentis, tenandries, service of frie tennentis thairof, and all thair partis, pendicles and pertinentis thairof abone rehersit, and everie pairt of the same, with all liberties and privilegeis contenit in the saidis infeftmentis, and ilk ane of thame perpetuallie and in all tyme cuming, according to the tennouris thairof in all pointis, nochtwithstanding his majesties revocatioun maid in this present parliament, or to be maid in ony tyme heireftir, or ony utheris his hienes actis, lawes, statutis or constitutionis, generall or speciall, maid of befoir in the contrair or prejudice thairof; undir the quhilkis, the saidis infeftmentis nor nane of thame nor na thing thairin contenit sall nevir be comprehendit be na maner of way. And forder his majestie, with consent of the saidis estaitis, willis and grantis and als decernis and ordanis, for his majestie and his successouris foirsaidis, that this present generall ratificatioun and approbatioun of the infeftmentis respective abonewrittin and seasingis following thairupoun, salbe of als greit efficacie, force, strenth and effect in all respectis and conditionis as gif the samyne wer at lenth and word be word ingrossit heirin.
