For puneisment of the ressettaris of tratouris and rebellis

Becaus of the commoun contempt in ressetting and suppleing of declarit tratouris and rebellis owir all partis of the realme, mony pretending excuse of ignorance and misknawlege of the personis, and althocht thay be knawin yit dois na diligence to apprehend and present thame to justice gif it be in thair power, nor yit to mak tymous advertisment to the ordinar magistrattis or uther personis of power within the schire and boundis nixt adiacent, to the effect the saidis tratouris and rebellis may be followit and still persewit quhill thay be takin or expellit furth of the realme; for remeid quhairof, it is statute and ordanit be oure soverane lord, with advise of his estaitis in this present parliament, that all former lawes and actis of parliament maid of befoir aganis ressettaris of trattouris and rebellis, and punisement of thame quhilk contempnandlie remanis at the horne, salbe put to dew executioun in all pointis, and speciallie quhen evir ony declarit tratouris or rebellis reparis in ony pairt of this realme, nane of oure soverane lordis leigis sall presum to ressett, supplie or intercommoun with thame, or to gif thame meit, drink, hous, harbrie or ony releif or confort under the same pane for quhilk thay ar foirfalt or put to the horne; and that immediatlie upoun knawlege of thair repairing in thay boundis, that all his hienes obedient subjectis do thair exact diligence at the uttermaist of thair power in serching, seiking, taking and apprehending of the saidis declarit tratouris and rebellis, and presenting of thame to justice, or in following of thame quhill thay be takin or expellit and put furth of the schire and immediatlie to mak intimatioun to the magistratis and personis of power and auctoritie in the nixt schire, quhilkis salbe haldin to do the lyk exact diligence without delay, and sa fra schyre to schire quhill thai be apprehendit and brocht to justice or expellit and put furth of the realme. And further, quhen evir ony maner of tratouris, rebellis or unknawin men vagabundis happynnis to repair in the cuntrie, all his hienes leigis knawing thame or amongis quhome thay resort, sall with all possible speid certifie his majestie or sum of his secreit counsaill or sum of the cheif personis of auctoritie and credite duelling within the same schire that sic personis (gif thay be knawin) ar within the samyn; and gif thay be unknawin, schawand thair takynnis and for quhat caus thay pretend thame selffis to be wandering athort the cuntrie or lurking in ony pairt, under the same pane that the tratouris, rebellis and vagabundis aucht to have sustenit in bodies or guidis thame selffis in cais thai haid bene apprehendit, presentit and convictit be justice.

Anent the eschaetis of rebellis

Oure soverane lord, with avise of his estaitis in this present parliament, statutis and ordanis that na assignatioun or uther evident alleagit maid in defraud of the creditour salbe a valiable title to persew or defend with, gif it salbe than instantlie verifiet be wreit that the cedent remanis rebell and at the horne for the same caus unrelaxt, nor na gift of eschaet, assignatioun or uther richt proceding thairof alleagit maid in defraud of the creditour and in favour of the rebell salbe valiable title to persew or defend with, gif it salbe than instantlie verifiet be wreit that the rebell remanis still at the horne for the same caus. As alsua it salbe a relevant exceptioun aganis ony pretending title be assignatioun or gift of escheat of the rebell to alleage that the said rebell him self, his wyff, barnis or neir freindis remanis in possessioun of his takkis and guidis to his awin use and behove; and in cais escheattis or lyfrentis salhappin to be gevin ony utherwayis nor to the behuif of the pairtie offendit, the thesaurair salbe haldin to mak the dispositioun to a responsall persoun quha salbe debtour to the pairtie at quhais instance the horning is led for his debt, or the thesaurair (gif he think gude) sall tak guid sufficient cautioun for his releif. And incais the donatour sall not be found responsall in landis or guidis, oure soverane lord, with avise of his estaitis, declaris the gift to be null. And becaus personis convict or standand rebellis for treasone, murther, slauchter or utheris odious crymes commounlie hes the fruitioun of thair guidis, debtis, takkis, steddingis and possessionis, thair housis still bruikit and possest be thair wyiffis, barnis or tendir freindis to the defraud of the law, of the proffite of the croun and encowrageing of wickit men efter committing of mischevous deidis, and that under pretens and cullour of fraudfull dispositionis or assignatiounis maid be thame selffis or giftis of thair escheattis simulatlie purchest or transferit in favour of thame selffs, thair wyffis, barnis, tendir freindis or weilwillaris, to thair commoditie and behuif; for remeid quhairof, oure soverane lord, with avise of his estaitis, statutis and ordanis that the saidis fraudfull and simulat dispositionis of escheatis, or ony thing following thairupoun, sall not serve to nurische and sustene the saidis tratouris and rebellis in thair contempt and rebellioun, bot that it salbe lauchfull to his hienes and his thesaurair to intromettwith and uptak the saidis eschaet guidis, geir and debtis remaning in the possessioun of the persoun be quhais deid and occasioun it fell, or of his wyff, barnis, famelie or tendir freindis quhatsumevir, upoun the ground and within the hous occupiet and possest be him befoir he was declarit or put to the horne; or in cais he have bene ressett in the same hous at ony tyme efter his foirfaltour or denunceatioun to the horne, notwithstanding ony fraudfull dispositioun or assignatioun or simulat gift or richt of eschaet purchest of the same in favour or to the behuif of the saidis tratouris or rebellis of befoir, quhairthrow the hous and possessionis of the saidis tratouris and rebellis sall nawyis be sufferrit to cum to thair use or commoditie, directlie or indirectlie, during the tyme of thair rebellioun and the uptaking of the saidis eschaet guidis and debtis, and laubouring of the saidis takkis and possessionis during the continuance of the saidis tratouris and rebellis in thair rebellioun sall nawyis be imput to the said thesaurair or utheris havand his richt or directioun as ony actioun, criminall or civile, exonering and dischargeing thame of the same forevir; and that the said thesaurair or his depuittis caus the housis of the personis committaris of the crymes foirsaidis be detenit and kepit upoun the expens of the reddiest of the saidis eschaet guidis.

Aganis granting of respeittis and remissionis

For furthering of the puneisment of slauchteris, fyre rasingis and utheris odious crymes sa commounlie committit in dyvers partis of the realme thir sindrie yeris bygane upoun sett purpois and foirthocht fellony, to the offence of God and contempt of oure soverane lordis auctoritie, his hienes, followand the lovable example of his maist noble progenitouris in lyk cais of his speciall favour, and at the instant request of his estaitis in this present parliament, grantis and, in the word of a prince, faithfullie promittis that he sall clois his handes and ceis fra granting of ony respeittis or remissionis for ony maner of slauchter, fyre rasing or utheris odious crymes that salbe committit upoun auld feid and foirthocht fellony for the space of fyve yeiris nixtocum eftir the dait heirof; that in the meantyme the realme may be put in peace, and his leigis maid to leive in suirtie, except the said respett or remissioun salbe cravit to the offendour be the wyff, barnis or narrest freind of the persoun that hes ressavit the offence, or that a sufficient lettre of slanis sene and perfectlie considderit be his hienes counsaill; and gif ony respeittis or remissionis salhappin to be grantit for auld actionis, that it be expremit in the same that the trespas wes committit befoir this present parliament, and that his hienes and his counsaill hes sene quhair the pairtie is assythit, utherwayis declaris the same respeitt or remissioun to be null and of nane availl. And incais ony sic remissonis or respeittis (as God forbid) salhappin to be grantit and past, ordanis and commandis his hienes justice, justice clerk and thair depuittis to proceid and do justice upoun the personis usaris thairof, notwithstanding the saidis remissionis and respeittis, as gif the samyn haid nevir bene grantit or producit; and ordanis all personis that hes alreddie obtenit respeittis for the saidis crymes sen his hienes acceptit the governament of the realme in his awin persoun to be callit to underly the law for the same at the instance of the partie offendit gif thay pleis to persew; and althocht thay insist not, at the instance of his hienes thesaurair and advocatt, and the personis offendouris comperand, and usand the saidis respeittis or remissionis, to caus thame find gude and responsall suirties actit in the buikis of adjornall for satisfeing of the pairtie as law will at the modificatioun of the lordis of counsall and sessioun, quhome his hienes ordanis and commandis to proceid and minister upricht justice in modifeing of condigne and sufficient assythmentis for the saidis slauchteris and utheris odious crymes according to the gravitie and circumstances thairof, as thai will answer to God and his hienes thairupoun; and for the furtherance heirof, that his hienes thesaurair and justice clerk caus collect the names of all personis that hes gottin respeittis or remissionis for slauchteris or utheris odious crymes sen his hienes acceptatioun of the governament in his awin persoun, and present the same to his hienes and his privie counsaill with all expeditioun.

For the better puneisment of the wickit cryme of setting of fyre in coilheuchis be sum ungodlie personis upoun privat revenge and despite, it is statute and ordanit that the committing of the said cryme in ony tyme heireftir salbe treasone, and that the committaris thairof, being ordourlie convict, sall suffer sic puneisment in bodies, landis and guidis as is dew be the law in caus of treassone.

For puneisment of masterfull beggaris and releif of the puir

Oure soverane lord and his estaitis in this present parliament ratifies and apprevis his hienes act of parliament maid for puneisment of strang and idle beggaris and provisioun for releif of the puir and impotent, and ordanis the same to be put in executioun in all partis of the realme as it hes alreddie tane effect within the partis of the burgh of Edinburgh; and becaus sum of the sherefdomes ar of wyde and lang boundis, quhairthrow it wilbe difficill to convoy vagabundis and personis offending to the commoun prisonis of the heid burrowis of the schyres, thairfoir ordanis and commandis all shereffis, stewartis, ballies, lordis and ballies of regalities and thair depuittis, and provest and ballies within burrowis, to mak prisonis, stokkis and irnis not onlie at the heid burgh, bot also at the principall throuche fair townis and paroche kirkis within the haill boundis of the schire, alsweill to burgh as to landwart, and to constitute ane or tua shereff depuittis of honest and zelous men of best credite and power in the boundis within or nixt adjacent to the saidis burrowis, throuche fair townis and paroche kirkis, to put the effect of the said act of parliament in executioun, or gif the saidis shereffis or uther juges ordinar beis fund remiss or negligent, gives and grantis full power, charge and auctoritie to the ministeris, eldaris and deaconis within the boundis of everie parochin, or of samony parochynis as will concur togidder, to nominat and elect ane, tua, thrie or ma personis of the best habilitie, zeale and discretioun within the same parochin or boundis, quhome his hienes makis and constitutis justices and commissionaris in that pairt to the effect undirwrittin, gevand, grantand and committand to thame conjunctlie and severallie full power, charge and auctoritie to execute the said act of parliament concerning the puneisment of strang and idle beggaris and vagabundis and provisioun for releif of the puir and impotent, and to that effect, to fenss and hald courtis, creat officiaris, summond assyiss, ilk persoun under the pane of fyve pundis, unlawis and panis to tak, uplift and raiss and for the same, gif neid beis, to poynd and distrenzie and the uses contenit in the said act apply, and generallie all and sindrie uther thingis to do, exerce and use that to the full executioun of the same act of parliament within the saidis boundis is necessarlie requirit. And incaiss the saidis jugeis ordinar or thair depuittis or the saidis personis to be nominat and elect as said is, is constitute justices and commissionaris be the auctoritie of this present act of parliament salhappin to refuis or delay to accept and use the said commissioun, or having acceptit the same, salbe fund remiss or negligent in executioun thairof, thay sall incur the pane of ane unlaw appointit aganis jugeis and magistratis be the said act of parliament, quhairupoun dittay salbe uptakin and thai callit and accusit thairfoir at generall justice airis or particuler dyettis, or then lettrez salbe direct be delyverance of the lordis of counsaill and sessioun chargeing alsweill the saidis jugeis ordinar and thair depuittis as the saidis personis to be nominat and electit and constitute justices and commissionaris be this present act of parliament upoun the sicht of the act and testimoniall of thair nominatioun and electioun, to put the said act of parliament to executioun in all pointis efter the forme and tennor thairof within xl dayes nixt eftir the charge, under the pane of rebellioun and putting of thame to the horne, and gif thair failzie thairin, the saidis xl dayis being bypast, to denunce the disobeyaris rebellis and put thame to the horne, and eschaet and inbring all thair moveable guidis to his hienes use for thair contemptioun; and for the bettir tryall of commoun sornaris, vagabundis and maisterfull beggaris, feinzeit fuillis and counterfute Egiptianis, and to the effect thay may be still persewit quhilll thai be compellit to setle thame at sum certane duelling or be expellit further of the cuntrie, that the shereffis and utheris jugeis ordinar and thair depuittis and uther justices and commissionaris abonespecefit tak inquisitioun be inquest at the heid courtis yeirlie of the names and takynis of thame, and mak denunceatioun of thame to the nixt ordinar jugeis and parochynis in the four halffis about, as also to our soverane lord and secreit counsaill within xl dayes efter the saidis heid courtis under the pane foirsaid.

Forsamekle as sindrie actis of parliament hes bene maid for puneisment of foirstallaris and regrattaris, being veray perntious memberis in the commoun weill, yit becaus it hes not bene expressit quhat wes foirstalling regraitting, thai soverane lord, with avise of his estaitis in this present parliament, declaris, statutis and oranis that quhaevir by or causses by ony merchandice, victuall or uther thing cuming be land or watter toward ony fair or mercatt in burgh or in landwart to be sauld in the same frome ony partis beyond sea or within the realme, or makis ony contract or promeiss for the having and bying of the same or ony pairt thairof befoir the saidis merchandise, victuallis or uther thing salbe in the fair or marcatt place in burgh, port or raid ready to be sauld, or sall mak ony motioun be word, write or message for raising of the prices or deirar selling of ony of the thingis abonementionat to the mercat, fair or toun, salbe estemit and jugeit ane foirstaller. And quhaevir gettis in his possessioun in ony fair or mercatt, ony corne, victuall, flesche, fische or uther viveris that salbe brocht to be sauld, and sellis the same agane in ony fair or mercat haldin in the same place or ony uther fair or mercat within four mylis thairof, or quha gettis in his hand be bying contract of promeiss the growand corne on the feild, salbe repute a regrattair, and becaus thair hes sa little effect followit in the executioun of the said act be the magistrattis within burrowis to quhome the executioun thereof wes committit, thairfoir it salbe lawchfull in tyme coming to our soverane lordis thesaurar or advocat to call and persew all personis suspect and dilatit of foirstalling and regraitting incais they salhappin to prevene be apprehending, intenting and executing first, alsweill as the saidis magistrattis in burrowis. And it sall not be lesum to the magistrattis within burgh to replege ony personis challengeit or persewit be the thesaurair or advocatt befoir his hienes justice or his deputtis at justice airis or particuler dyettis. And albeit thair be na speciall dittay bot that the foirstallair and regraitar be onlie accusit of commoun foirstalling or regraiting sa repute and haldine, yit the libell in that generallitie sall stand relevant and the personis accused to be put to the knawlege of ane assyiss. And gif thair cum in will or be convict be an assyis for commoun foirstalling and regraiting of mercattis, they sall incur for the first falt the pane and unlaw of fourtie pundis and sall find souirtie to abstene in tyme cuming under the pane of ane hudnreth markis; and gif he sall agane in the secund falt, the principall and his souirtie to incur and pay the said sowme of ane hundreth markis; and for the thrid falt the offendar being convict or cum in will to tyne and foirfalt all his moveable guidis to be inbrocht to our soverane lordis use as escheat, and that justice courtis or aris for the effect foirsaid be haldin everie yeir twyiss.

Anent the supplicatioun gevin in to the kingis majestie and estaitis of parliament be his hienes advocat, in name of his majesties faithfull and trew subjectis wthin this realme, makand mentioun that nocht onlie his majesties officirs of armes in putting of decreittis obtenit befoir the juges ordinar to executioun ar heavelie trublit be deforceing of thame in executioun of thair offices and stryking of thame to the effusioun of thair bluidis, in hie and manifest contemptioun of oure soverane lord and his hienes auctoritie and lawes, bot also ane new unaccustumat contempt is laitlie cropin in and enterit wthin this realme that na persoun wthin the same, nather officiaris of armes, shereffis in that part, may travell with frie access to execute ony summondis and lettres direct furth in his majesties name for summoning of ony persoun or personis to compeir befoir the lordis of the college of justice or utheris jugeis wthin this realme without hazard and perill of thair bodies, to the greit hinderance of justice and prejudice of the trew subjectis of this realme quha ar willing to leve under his hienes obedience and to repair wrangis and injuries done to thame be ordor of law; beseikand, heirfoir, his majestie and estatis foirsaidis to have consideraoun of the premisses and to sett doun be act of this present parliament that all personis salbe harmeless and skathles in executing of ony summondis, lettres or precept, and in putting of decreittis to executioun under sic panis and punisement as his majestie and the saidis estaitis thinkis maist expedient for the maintenance of justice and punischement of the contempnaris thairof, as the said supplicatoun at mair lenth proportis. Oure soverane lord and his estaitis of parliament, for the gratious luif and favor quhilk his majestie bearis to the burrowis of this realme eftir his perfite aige of tuentie fyve yeiris compleit, ratifies and apprevis all and quhatsumevir actis, richtis, privilegis, ordinances and constitutionis maid of befoir be his majestie and his maist noble progenitoris for mantenance of the liberties of frie burrowis conforme to the saidis actis and constitutionis in all pointis. And foirsamekle as be diverss actis of parliament maid of befoir in the dayis of his maist noble progenitoris, it is statute and ordanit that na persoun wthin this realme suld exerce the traffique of merchandice bot the burgesses of frie burrowis, quhilkis have not bene nor yit ar observit be reasone that thair is na penaltie irrogat to the personis contravenaris thairof, thairfoir oure said soverane lord and haill estaitis of this present parliament, confirmis, ratifies and apprevis the saidis actis, constitutionis and everie ane of thame with this additioun: that quhasoevir exerceises the said traffiq of merchandice not being frie burgesses, thair haill guidis and geir sall becum in eschaet, the ane half to oure soverane lord, and the uther half to the burgh quhais commissioner or collector sall first apprehend the same. Oure soverane lord and the estaitis of parliament ratifies, apprevis and confermis the act of parliament maid be Quene Marie, drowriar of this realme, in the moneth of Junij 1555 yeiris, intitulat 'Anent the commoun passages to burrowis', be the quhilk it wes statute that all commoun hie gaittis that frie burrowis hes bene in use off proceding ather for passage fra thair burgh or cuming thairto, and in speciall all commoun hie gaittis fra frie dryburrowis to the portis and heavynis nixt adjacent or proceding to thame, be observit and kepit, and nane mak thame impediment or stop thairintill, and gif ony dois to be callit and accusit for oppressioun and punist thairfoir according to the lawis, as in the said act at mair lenth is contenit; quhilk act, with the haill clauses and conditionis thairof, his majestie, with avise foirsaid, willis that the samyn salbe haldin as expressit thairin and to be put to dew executioun in all tyme heireftir, with thir additionis following: that forsamekle as it is sufficientlie understand be his majestie that dyverse malicious personis, upoun deliberat malice, stoppis and impeidis publict passages pertening to the frie burrowis wthin this realme, namelie to the portis quhilkis hes grytest occasioun of trafficque, be casting of fowseis and bigging of dykis for interclosing of the saidis commoun passages, and will not suffer the inhabitantis of the saidis burrowis and utheris his hienes leigis and trafficqueris towardis the saidis sey portis, to have or frequent the accustumat passage usit of befoir in transporting of victuallis, fewalis, viveris, merchandise and utheris for interteynement of the commoun negotiatioun of the cuntrie, bot compellis thame to pas ane myle or tua about to the greit hurt and prejudice of the saidis leigis; heirfoir his majestie, with avise foirsaid, in corroboratioun of the said former act and to the effect that the samyn may be put to full executioun in tyme cuming, statutis and ordanis that nane presum or tak upoun hand heireftir to stop or impeid the saidis publict and commoun passageis pertening to the saidis frie burrowis, and namelie to the saidis sey portis, and gif ony salhappin to do in the contrair, the parties grevit salhave thair recourse to the lordis of counsaill and sessioun, quha sall grant sunmar lettrez in thair favoris upoun sex dayis warning allanerlie, to caus and compell the committaris of the said oppressioun to decist and ceise thairfra, and to heir and sie thame selffis decernit to have done wrang in stopping of the saidis passagis and to find cautioun actit in the saidis lordis buikis, under sic panis as salbe modifiet unto thame, nevir to commit the lyk wrang be thame selffis, thir men, tennantis or servandis and utheris quhome they may lett, the ane half of the said penaltie to appertene to his hienes, and the uther half to the partie grevit; and the probatioun of the said wrang in stopping of the saidis passageis to be ressavit be famous witnesses allanerlie and not be ane assyiss; and the tryall thairof to appertene to the saidis lordis of counsaill and all utheris inferior juges to be dischargit fra proceding in the saidis causes, nochtwtstanding ony quhatsumevir statute or constitutioun maid anent molestationis in propirtie or commontie, in nowmer quhairof his hienes will nawayis that the saidis oppressionis and staying of the publict passages salbe comprehendit; and ordanis publicatioun to be maid heirof in forme as effeiris.
