Concerning the thesaurair anent ratificationis and uther materis past in this present parliament

It is statute and ordanit be oure soverane lord and his estaitis in this present parliament that albeit sindrie ratificationis be past and pronuncit in this present parliament in the favour of sindrie of the estaitis or privat personis upoun simple articles, as alsua sum favour grantit to the vassallis of personis foirfaltit in the same parliament, and to the burgesis and inhabitantis of Edinburgh being infeft in landis or annuelrentis annaleit to thame be ony of the saidis personis now foirfaltit or thair predecessouris under reversioun, yit sall nocht the same ratificationis be registrat in the parliament buikis, nor have effect without the signatures of infeftmentis or articles grantit or ratifiet be subscryvit be his hienes thesaurair, or his tiket send to the clerk of registrar testefeand the thesaurair to be satisfiit that his majesties commoditie may be respectit as appertenis; and that betuix and the first day of August nixtocum utherwayis the saidis ratificatiounis to be null as gif thay haid not bene grantit nor pronuncit in parliament; and that the trew rentalis of thingis ratifiit to burrowis, collegis or hospitallis be presentit to his hienes and his counsaill betuix and the said first day of August nixtocum with a declaratioun how the same is employed, utherwayis the same ratificatioun to be null.

Concerning the kingis chappell royall of Striviling and his hienes musicianis

Oure soverane lord, with avise of his estaitis in this present parliament, ratifies, apprevis and, for his hienes and his successouris, confermis the lettres maid and grantit be his hienes, with advise of the lordis of his secreit counsaill and of his collectour generall, makand and constituand his hienes dalie servitour Thomas Hudsoun musiciane maister of his hienes chappell royall and commissioner to the effect specifiet in the said lettre, and of the yeirlie fie thairin contenit, as the samyne of the dait the fyft day of Junii, the yeir of God jM vC fourscoir sex yeiris at mair lenth beris, in all pointis, articles and clauses thairof, efter the forme and tennour of the same; and ordanis the said lettre to have full effect, strenth and executioun in tyme cuming, nocht onlie concerning his majesties chappell royall of Striviling, bot his hienes uther chantorie collegis, quhairupoun his majestie grantis lyk power and commissioun to the said Thomas as upoun his hienes awin chappell royall. And becaus thair is ane greit pairt of the fruittis and rentis of the kirkis and benefices pertening to the said chappell royall disponit and assignit to the ministeris serving the cure of the saidis kirkis, thairfoir his majestie, with avise foirsaid, ordanis and commandis his hienes collectour generall and thesaurair of the new augmentationis to answer and mak payment yeirlie to the said Thomas of samekle as he sall want of the yeirlie fruittis and rentis of the saidis kirkis and teyndis thairof be the benefices or stipendis assignit or disponit to the ministeris furth of the same, and for the remanent prebendaries and rentis of the said chappell royall foundit upoun temporall landis and disponit to quhatsumevir utheris nor to the said Thomas and use of the saidis musicianis at ony tyme sen the dait of his said gift, findis and declaris that he hes guid richt and actioun to persew for reductioun and annulling thairof to the effect the same may be josit and usit according to the effect and meaning of the said gift and provisioun in all pointis, and becaus it is speciallie provydit be the said lettre that the said Thomas salhave payit to him yeirlie in his fie be the collectour generall off the superplus of the thriddis of benefices within this realme the sowm of tua hundreth pundis monie, ay and quhill samekle of the rentis of the same chappell royall be recoverit be him as will extend to the same sowme, thairfoir his majestie, with avise and consent of his saidis thre estaitis, hes thocht meit, statute and ordanit that his hienes sall not dispone at na tyme heireftir nane of the prebendaries of the same chappell royall to quhatsumevir personis, ather vacand be deceis or utherwayes, bot hes ordanit the said Thomas to intromett with the fruittis and rentis of the same, ever as they salhappin to vaik, and to be comptable thairof to his majestie and his chekker, allowand thairin his awin fie contenit in the said lettre ay and quhill his hienes have declarit quhat nowmer of musicianis he wilhave to serve him in his hous and chappell, and quhat fie everie persone salhave, and that it be found thair is samekle of the rentis of the same prebendaries extant as to pay the same fies with. And incace it salhappin his majestie to mak ony new dispositioun of ony of the same prebendaries utherwayis nor is befoir provydit, in that cais his majestie, with advise foirsaid, decernis and declaris the same to be of nane availl, strenth, force nor effect, and ordanis and commandis the said Thomas to refuis thair admissioun.

Anent the productioun of rentallis and fewis

Forsamekle as in oure soverane lordis umquhile darrest motheris tyme the thriddis of all benefices within this realme wes be act appointit to the sustentatioun of hir majesties hous and of hir hienes successouris, safar as hapnit to rest frie thairof by the sustentatioun of the ministrie within this realme, and siclyk, oure said soverane lord and his said umquhile darrest mother and utheris his hienes predecessouris of guid memorie hes foundat, confermit and augmentit dyvers hospitalities within this realme with the giftis and donationis thairto, quhilkis his majestie is willing to stand for evir without ony hurt or dirogatioun, as alsua in the lait parliament haldin at Edinburgh in the moneth of Julii, the yeir of God jM vC fourscoir sevin yeris, the haill temporall, ecclesiasticall landis of this realme ar annexit to his hienes croun, and his majestie ordanit to have present possessioun thairof, payand to the lyverentaris pennie for pennie and boll for boll. And becaus his hienes can nocht understand quhat cours to follow out anent the premises, and can not knaw perfitlie quhat the saidis thriddis will extend to, nor quhat will be the rent of the saidis hospitalis, nor quhat present commodities will fall to his hienes be the said act of annexatioun, nor how the ministrie of this realme salbe deulie provydit according to his guid will, mynd and intentioun, without his majestie and his hienes commissionaris to be appointit to that effect have the sicht of the rentaillis of all bischoiprikis, abbacies, prioriis, provestries, personages, vicarages, alterages, chaiplanries, templaries and utheris benefices, and of all masondewis and hospitallis within this realme and of the rentis thairof, fundatiounis of the samyn and of all thingis foundat, gevin and mortifiit thairto, and of all infeftmentis, takkis, tytillis, richtis and securities maid to quhatsumevir persoun or personis anent quhatsumevir kirklandis, tempillandis, teyndis and utheris ecclesiasticall rentis and possessionis quhatsumevir; thairfoir it is statute and ordanit be his hienes, with avise of his majesties estaitis in this present parliament, that all and sindre personis within this realme as thay salbe chargit thairto in speciall or in generall be oppin proclamatiounis at the heid burrowis of the schyres quhair in thay duell, compeir, bring and produce with thame, befoir his hienes commissionaris, ane or ma to be appointit be his majestie to that effect, sic day and place as salbe appointit to thame to that effect under the pane of rebellioun and putting of thame to the horne, with certificatioun to thame and thai failyie that thay salbe put thairto, and to put thame to the same in cais of failyie, the rentaillis of the saidis bischoiprikis, abbacies, prioriis, provestries, personages, vicarages, alterages, chaiplanries, templaries and utheris benefices, and of all hospitallis and masondewis within this realme, and of the rentis thairof, fundatiounis of the same and of all thingis foundat, gevin and mortifiet thairto, and all and quhatsumevir infeftmentis, takis, tytillis, richtis and securities maid to thame anent quhatsumevir kirklandis, tempill landis, teyndis and utheris ecclesiasticall rentis and possessionis quhatsumevir, and all richtis and titles that thay or ony of thame may pretend thairto, and to deliver to the saidis commissionaris inspectioun of the same and the autentike copies thairof, with certificatioun and thay failyie lettres salbe direct simpliciter as said is.
