Ratificatioun to the burgh of Edinburgh

Oure soverane lord, now efter his perfite aige of xxj yeiris compleit and generall revocatioun maid in parliament, being movit with the cairfull zeale and godlie intentioun of the provest, baillies, counsall and communitie of the burgh of Edinburgh in the provisioun for the ministrie serving within the said burgh quha hes na appoyntit stipendis furth of the thridis of the benefices, and that they haif also employed large sowmes of money upoun the bigging of ane hospitall, quhair the college callit the Quenis College stude befoir, for sustening of puir and miserable personis, and further, haif laitlie erectit within the said burgh ane college quhairin gude lettres and sciences ar professit for the commoditie of the realme and augmentatioun of the policie of the said burgh of Edinburgh, being the principall towne quhair oure said soverane lord and his estaittis makis maist residence, quhilkis ministrie, hospitall and college can not be guidlie interteneit without oure said soverane lordis help and support, notwithstanding the greit expensis already bestowit be the saidis provest, baillies, counsall and communitie, alsweill of the commoun gude as be the particulair contributioun of sic as wer bent to the help and supplie of the saidis godlie warkis; and oure said soverane lord, having now consideratioun that his umquhile derrest mother and him selff dotit, gaif and mortifiit to the sustening of the saidis ministrie, hospitall and college divers landis, rentis, teindis and annuellis quhilkis his hienes is willing sall remane with the saidis provest, baillies, counsall and communitie in all tyme cuming, the samin being exceptit fra the lait annexatioun of the kirklandis to the crown and furth of the generall revocatioun, for the quhilkis causis oure said soverane lord hes, with expres advise of the saidis thre estaittis of parliament, ratifiit and apprevit and, for him and his successouris, perpetuallie confermit, lyk as his hienes, be the tennour heirof, ratifies, apprevis and, for him and his successouris, perpetually confermis the gift, infeftment and mortificatioun maid and grantit be his umquhile derrest moder in hir perfite aige to the saidis provest, baillies, counsall and communitie of the said burgh and thair successouris, for help and supplie of the ministeris and puir within the samin, of all landis, tenementis, annuelrentis and utheris proffittis and emolumentis quhatsumever situat within the libertie and fredome of the said burgh quhilkis pertenit befoir to ony college, prebendarie, chappellanrie, freiris of quhatsumevir ordour and utheris beneficeit personis, as the said gift, donatioun and mortificatioun of the dait the xiij day of Merche, the yeir of God jM vC lxvj yeiris, under the grite seill of oure said soverane lordis umquhile derrest moder, at mair lenth proportis; togidder with the uther gift and dispositioun maid be oure said soverane under his grite seill to the saidis provest, baillies, counsall and communitie and thair successouris of the college kirk, callit the Trinitie College, with the kirkyaird thairof, the mansionis, the housis and yairdis thairof, the hospitall, callit the hospitall of the Trinitie College, and yaird, to the effect that the saidis provest, baillies and counsall mycht big and erect ane hospitall upoun the samin for sustentatioun of the puir, honest, aiget and decayit personis within the said burgh and utheris haveing neid of support, as the said donatioun and gift of the dait the xij day of November, the yeir of God jM vC lxvij yeiris, in lyk maner at mair lenth proportis; and siclyk the uther gift, mortificatioun and annexatioun of the benefice of the provestry of the said Trinitie College, with all landis, rentis, proffittis and emolumentis, advocatioun and donatioun of all hospitallis of the said hospitall and all uther richtis and privileges pertening to the said provestrie, as the said mortificatioun of the dait the xxiij day of Junii the yeir of God jM vC fourescoir fyve yearis, with oure said soverane lordis confirmatioun and new gift of the samin provestrie, and of all landis, proffittis and emolumentis pertening thairto, and to the prebendaries and chaiplanreis of the samin college in propertie or communitie as the samin confirmatioun and new gift of the dait the xxvj day of Maii, the yeir of God jM vC fourescoir sevin yeiris, at mair lenth beiris; and in lykmaner the annexatioun of the archidenry of Lowthiane, landis, rentis and teindscheves pertening thairto, annext and mortifiet to the said college laitlie erectit within the said burgh for instructioun of the youth in learning, as the samin of the dait the ferd day of Aprile, the yeir of God jM vC lxxxiiij yeiris, beiris; togidder with the decreit of the lordis of his hienes counsall and sessioun be the quhilk the saidis provest, baillies, counsall and communitie ar decernit and declairie to haif rycht to the teyndis, fruitis and emolumentis of the personage of the kirk of Donbarnie for the ressonis and causis contenit in the said decreit, quhilk is of the dait the xxix day of Merche the yeir of God jM vC fourescoir thre yeiris, in all and sindrie pointis, headis, claussis and circumstances of the samin, quhilkis oure said soverane lord and his saidis thre estaittis haldis for expressit in this present act and ordanis all and sindrie the saidis giftis and ratificationis to be at lenth insert thairin gif neid be. Attoure, oure said soverane lord, with advise of his saidis thre estaittis of parliament, of new gevis, disponis and mortifies to the saidis provest, baillies, counsall and communitie of the said burgh of Edinburgh and thair successouris, for sustentation of the ministrie, of the puir and for sustening of thair said college laitlie erectit be thame, all and sindry the landis, rentis, teyndis and utheris proffittis and emolumentis of the particulairte contenit in the saidis former giftis, donationis and mortificationis and in the decreit foirsaid gevin be the saidis lordis of counsall of the dait the xix day of Merche, the yeir of God jM vC fourescoir thre yeiris, to remane with thame for the use specifiit and mentionat thairin and na uther wyse, efter the forme and tennour thairof for evir, providing that thai sustene the ministeris serving at the saidis kirkis or pay to thame the thrid of the fruitis of the samin kirkis at thair optioun and plesour. Attour, oure said soverane lord, with advise of his saidis thre estaittis, ratifies, apprevis and confirmes all and sindrie infeftmentis of fewferme maid be the saidis provest, baillies and counsall of the said burgh of Edinburch to quhatsumevir persoun or personis of the commoun mure of the said burgh pertening unto thame as a part of the commoun landis thairof, and findis and declairis the samin to be sett for the weill, utilitie and commoun proffeitt of the said burgh, and thairfoir statuitis and ordanis that nane of oure soverane lieges, of quhatsumevir degree or qualitie, and specialie the schireff of Edinburgh and his deputtis, mak the saidis provest, baillies, counsall and communitie and thair few fermomaris foirsaidis ony truble, molestatioun or impediment in the peceable josing and bruiking thairof in ony tyme cuming, providing alwayes that this ratificatioun be nawayes hurtfull nor prejudiciall to ony uther mannis title or richt of the landis, benefices and utheris foirsaidis mortifiit to the said burgh for sustening of the saidis ministrie, hospitall and college; and ordanis lettres to be direct heirupoun, gif neid beis, in forme as effeiris.
