†Anent the supplicatioun gevin in and presentit to oure soverane lord and thrie estaittis of this present parliament be David Fergussoun of Glenschynroch, eldair, and David Fergussoun, younger, makand mentioun that quhair they intentit actioun befoir the lordis of sessioun aganis Johnne, erle of Mortoun, lord Maxwell, and Robert Charteris of Kelwod, for the wrangus, violent and maisterfull spoliatioun fra thame of divers and sindrie nolt, scheip, nagis, plenissing, gold, silver, writtis and evidentis extending to divers availlis, quantities and prices, contenit in the summoundis raisit thairupoun, quhilk being admittit to thair probatioun and divers termes assignit to thame for preving thairof, and the said erle and Robert Charteris persaving that thai wald preve the samin aganis thame, compeirit be thair procuratouris and allegit that thei sould be assoilyeit thairfra in respect of the act of parliament maid at Linlythgow, the tent day of December the yeir of God jM vC fourescoir fyve yeiris, be the quhilk all deidis, wrangis, oppressionis and utheris faultis allegeit, committit and done be the said erle, or ony utheris contenit in the said act sen oure said soverane lordis coronatioun, suld be remittit and dischargit, and the said spuilyie wes committit within the samin tyme and thairfoir the samin suld be takin away; to the quhilk it wes anserrit for the saidis David Fergussoun, elder and younger, that the said allegeance aucht not to be hard, seing thair is litiscontestatioun maid in the cause lang of befoir and thair summoundis admittit to thair probatioun, notwithstanding the haill defensis proponit be the said erle and Robert and sindrie witnesses examinat in the caus lang of befoir the said act of parliament; and als the said act of parliament can nawyse be extendit to particulair pairties actionis quhilkis proceidit not upoun the commoun causis betuix the Maxwellis and Johnestonis, and seing the saidis David Fergussoun, eldair and younger, wer nawyse pairtakeris with the said commoun trubles, the same act of parliament upoun gude conscience can not be extendit to tak away the said spuilyie; quhilk allegeance, with the anser maid thairto, being sene and considerit be the saidis lordis, they remittit the decisioun of the said allegence foundit upoun the said act of parliament to oure said soverane lord and thre estaittis of this present parliament for geving of his hienes declaratioun and interpretatioun gif the said act maid in favouris of the said erle takis away the said spuilyie, and quhill the samyn be done, hes superceidit all forder proces in the said mater, as ane act maid thairupoun beiris; quhairthrow the saidis complenaris ar heavelie damnifiet and skaithit throw the want of thair haill guidis and geir intromettitwith be the saidis erle and Robert, and can gett na process nor justice in the said mater without oure said soverane lord and thre estaittis foirsaidis provide remeid, requiring thame, thairfoir, seing the said mater nawayes concernis the said act of parliament, that his hienes will tak trial thairinto and remit the samin to the sessioun to be discussit be the lordis thairof, commanding thame to proceid and do justice thairintill and all uther actionis persewit or to be persewit be the saidis David, elder and younger, aganis the saidis erle and Robert Charteris, or ony utheris, the saidis erlis servandis, spuilyearis of thair guidis and geir fra thame, notwithstanding the said act of parliament, as at mair lenth is contenit in the said supplicatioun.
