Forsamekle as in the parliament haldin at Linlythgw in the moneth of December the yeir of God jM vC fourescoir fyve yeiris, oure soverane lord and thre estaittis of parliament than convenit, for extinctioun of all factionis, seditionis and stryff fallin out be civile trublis that had occurrit within this realme sen his hienes coronatioun, and for uthers verie guid and necessar causis contenit in the act of pacificatioun maid thairanent, decernit, declairit and ordanit not onlie that the personis foirfaltit of befoir during the saidis trubles, sa mony as ar onlyve, and the airis of thame quhilkis ar deceissit, and all uthers dispossessit of thair possessioun, quhilk thai and thair predicessouris had befoir respective the foirfaltouris led aganis thame or truble movit to thame in thair levingis and the beneficeit personis, to be restoirit and repossessit likewyse to thair benefices, notwithstanding quhatsumever decreitis and sentences intervening that mycht appeir to impeid the full effect of the said repossesioun, bot also decernit, declairit and ordanit that all and sindrie personis yit onlyff quhilkis wer providit to benefices and pensionis and wer debarrit thairfra be sentence of foirfaltour or barratrie etc. salbe restoirit in integrum to thair saidis benefices and pensionis; and than his hienes and estaittis foirsaidis retreitit and reducit quhatsumevir provisioun thairof to ony uther personis be ressoun of the saidis sentences, and restorit the saidis personis first providit and debarrit thairfra in integrum to the saidis benefices and pensionis and in the samin estait and cais quhairin the samin wer befoir the saidis sentences etc., as the samin act of parliament at mair lenth proportis; notwithstanding quhairof, mony of the saidis beneficeit personis provisionis, richtis, titillis and utheris evidentis, alsweill of thair benefices as of thair landis, being amittit, tint or distroyit throw thair absence and trubles foirsaidis at the tymes of the apprehensioun, douncasting and spuilyeing of thair housis and fortalices, or utherwayes be the saidis trubles, utheris personis in thair absence craftilie obtenit and procurit new provisionis and utheris pretendit titillis of thair saidis benefices quhairunto the saidis personis, purchessaris thairof, nevir had onie rycht, title or provisioun of befoir, and thairby hes movit grite questioun and pley aganis the foirnameit personis dispossessit be the saidis trubles in thair saidis benefices, quhilk will not faill to tend to thair grite hurte without tymous remeid be providit. And forsamekle as it is notourlie knawin that Lord Claude Hammiltoun, commendatair of Paislay, wes providit to the personage and vicarage of Cambuslang and wes in possessioun of the samin and haill teindis, fruitis and emolumentis thairof as persoun of the samyn, sua repute and haldin be the space of sevin yeiris and mair preceiding the pretendit dome of foirfaltour led aganis him in the saidis last trubles, and als his rychtis, titles and provisionis thairof sua skatterit, tint and dispersit be his absence and trubles foirsaidis that he can not, efter sufficient diligence, find the samyn agane, quhairthrow Maistir Johnne Howisone, minister, procuirit and obtenit fra the kirk or utherwyse sum presentationis, gift, dispositioun and provisioun of the said personage and vicarage of Cambuslang during the said Lordis Claudis absence and trubles abonementionat, and thairby daylie hes movit actioun and contraversie aganis the said Lord Claude Hammiltoun for the samin. For remeid quhairof, our said soverane lord and thre estaittis of parliament retreitis, rescindis, casis and annullis all and sindrie presentationis, giftis, provisionis, admissionis, institutionis and uthers titillis quhatsumever maid or grantit to the said Maistir Johnne Howesone or onie utheris of the saidis personage and vicarage of Cambuslang during the tyme of the said foirfaltour, banishement or absence of the said Lord Claude Hammiltoun, quhairof the said Lord Claude wes in peceable possessioun as titulair thairof, sua haldin, repute and commounlie estemit but contradictioun of ony uther haveing or pretending title to the saidis personage and vicarage be the space of sevin yeiris immediatlie befoir he wes dispossessit thairfra be the saidis trubles and foirfaltour, but interruptioun, and quhairunto the said Maistir Johnne Huesoun had nevir ony richt, title nor provisioun befoir the samin trubles, with all decreittis following or that may follow thairupoun; and in that cais oure said soverane lord and estaittis of parliament decernis and declairis that the said Claude, commendatair of Paislay, as he quha wes foirfaltit and dispossessit and sevin yeiris of befoir in peceable possessioun as said is, but interruptioun, as haldin repute and estemit titulair of the said benefice of Cambuslang, the premisis being verefiet and provin, sall never be astrictit in tymes cuming to schaw ony provisioun or uther title of the saidis personage and vicarage of Cambuslang, nather in persuit nor defence of onie actionis concerning the teindis, fruitis and rentis thairof, bot to brouke the samin as foundit in jure communi, but forder questioun or contradictioun during his lyvetyme as he did befoir the said foirfaltour led againis him and befoir he wes dispossessit as said is.
