Submissioun of the contraversie betuix the Erle of Angus and Lord Flemyng

Anent the supplicatioun gevin in and presentit to oure soverane lord and lordis of articlis of this present parliament be Johnne, lord Flemyng, makand mentioun that quhair it pleasit his majestie of his gude grace and favour to grant him the benefite and privilege of the pacificatioun concluidit at Perth, and thairefter ratifiet and apprevit in parliament, restoirand and rehabilitand the said lord to all landis, heretageis, offices, honouris, rowmes and possessionis quhilkis pertenit to umquhile Johnne, lord Fleming, his fader, without ony reservatioun or exceptioun, as the last act of parliament maid thairupoun the penult day of November lxxxj yeiris at mair length contenis; and now being informit that his majestie is to grant the benefite of the said pacificatioun to Archibald, erle of Angus, as air maill or of tailze to umquhile James, erle of Mortoun, or utherwyse to restoir and repone him as successour to the said umquhile erle in the said erldome of Mortoun, quhairby he may pretend sum interes to the said Lord Flemyngis landis and barony of Kilbocho, notwithstanding that upoun the xix day of Julii, the yeir of God jM vC lxxxiij yeiris, he obtenit decreit befoir the lordis of sessioun aganis Johnne, erle of Mortoun, lord Maxwell, his majesties thesaurair and advocat for his hienes entres, reduceand and annulland ane pretendit decreit of redemptioun of the saidis landis and barony, quhilk the said umquhile James, erle of Mortoun, purchest aganis the said lordis umquhile fader, for the tyme he wes captaine and keipair of the castell of Dunbartane, quhen as he mycht not compeir and defend aganis the samin, as the said decreit will testifie; and thairfoir desirand, in consideratioun thairof and of his full restitutioun foirsaid quhairby it is certane he hes undoubtit richt to the saidis landis and barony, that his majestie and the saidis lordis will, in quhatsumever benefite, favour or restitutioun now to be grantit in this present parliament to the said Erle of Angus of the said erldome of Mortoun, caus specialie provide in the act thairof that the samin sall nawayes be hurtfull nor prejudiciall to the said Johnne, lord Flemyng, anent ony richt or title his predicessouris and he had and have of the saidis landis and barony of Kilbocho, nor to the foirsaid decreit of reductioun obtenit be him and his curatouris for the tyme annulland the pretendit redemptioun allegeit usit be the said umquhile James, erle of Mortoun, thairof; and to ordane the clerk of registri and his deputtis to forme and extend the said provisioun in the said restitutioun in dew and ample forme for his securitie, as at mair lenth is contenit in the said supplicatioun. Quhilk being hard, sene and considerit be his hienes and lordis of articles and thai thairwith being at lenth avisit, oure said soverane lord, with avise of the saidis lordis of articles, thinkand maist expedient that the foirsaid supplicatioun, contentis and desiris thairof be decydit and aggreit amicable for better amytie to stand betuix the foirsaidis pairtiis in tyme cuming, desirit baith the saidis pairties, being persounallie present, ather of thame to chuse certane freindis for intreating and aggreing of the foirsaid mater in amicable wyse, and according thairto, the said Archibald, erle of Angus being personallie present as said is, nominat and chusit Johnne, erle of Mar, and Thomas, maistir of Glammis, thesaurair, for his part, and the said Johnne, lord Flemyng, being in lykmaner personallie present, nominat Johne, erle of Montrois and Schir Johnne Maitland of Thirlstane, knicht, secretair to oure soverane lord, for his part, as amicable jugeis, to quhome baith the saidis pairteis referrit the contentis and desir of the foirsaid supplicatioun and quhat ather of the saidis pairteis aucht to do to utheris thairanent, and howsoever the foirsaidis juges all in ane voice decerne and pronunce thairintill, baith the saidis pairties band and oblist thame to obey and fulfill thair sentence and decreit arbitrall to be pronuncit be thame anent the premisis. And oure said soverane lord and lordis of articles hes interponit and interponis thair auctorite thairto, and gevis and grantis full power to the foirsaidis judges to the effect foirsaid siclike as his hienes and lordis mycht have proceidit thairintill in this present parliament. And forder, his majestie and lordis of articles declairis that this present submissioun on na wyse salbe prejudiciall to the generall act of abolitioun, pacificatioun and ratificatioun thairof maid in this present parliament, bot the samyn to have full effect and to be frelie extendit to all personis thairin mentionat unto quhome the benefite thairof apertenis siclike and als frelie as gif this present supplicatioun had nevir bene present in parliament, nor the said submissioun followit thairupoun.

Act annulling the richtis and titillis of the landis and rentis of Dumfermling maid be the Maistir of Gray, with certane exceptionis

Oure soverane lord, with avise of the thrie estaittis in this present parliament, hes ratifiet and apprevit, lyk as his majestie and thre estaittis foirsaid ratifeis and apprevis ane act of parliament maid at Linlythgw, the tent day of December the yeir of God jM vC lxxxv yeiris, be the quhilk it is statute and ordanit that all personis to be providit to bischoprikis, abaccis, prioreis or quhatsumever uther inferiour benefices being at his hienes presentatioun sall, befoir the expeditioun or registratioun of thair signatouris, find souirtie to the clerk, kepare of the register, that thai sall leif the said benefice at thair deceis or dimissioun unhurt or vitiat in the quantitie of the yeirlie rent thairof as thai find it at thair entre thairto, as at greittair lenth is contenit in the said act; decerning and ordaning the samen haill claussis and conditionis contenit thairintill to stand in the full strenth, force and effect as ane law in tymes cuming, notwithstanding ony act maid in this present parliament quhilk may in ony sorte appaer to derogat thairto. And siclik oure said soverane lord and thre estaittis foirsaidis, understanding perfitely that Patrik, maister of Gray, sumtyme commendatair of the abbacie of Dumfermling, quha wes providit laitlie befoir the making of the said act, in defraude of the said former act, hes ratifiet, apprevit, confermit and of new gevin divers fewis quhilkis of befoir wer invalide, and lykwayes sett divers takkis and gave sindrie pensionis furth of the said abbacie, quhairof ane greit pairt wes daitit befoir the said act, to the effect the samin suld nawayes haif bene comprehendit thairintill, quhilk wes all done to the grite detriment of the said benefice, hurt of his hienes croun and prejudice of his successouris; for remeid quhairof, oure soverane lord and thre estaittis foirsaidis hes annullit, like as his majestie, with avise of his saidis thre estaittis, annullis all and quhatsumever fewes, takkis and pensionis gevin be the said Patrik sen his provisioun, quhairby the rent and patrimonie of the said benefice is diminissit, and siclike annullis all and quhatsumever ratificationis and confirmationis of fewis quhilkis wer frome the begining invalide and mycht have bene querrellit and annullit of befoir for ressounable causis competent of the law.

And nevertheles, oure said soverane lord and his saidis thrie estaittis in parliament decernis and declairis that the heretable infeftment of the landis, lordschip and regalitie of Mussilburgh schyre, maid to Schir Johnne Maitland of Thirlstane, knycht, chancellair and secretair to oure soverane lord, his airis and successouris specifiet thairin, quhilk is alsua ratifiet and apprevit be ane speciall act and ordinance of this present parliament, and als the uther infeftment maid be the said Maistir of Gray to the said Schir Johnne, his airis and assignais specifiet thairin, of the heretable baillierie of the said lordschip and regalitie, assignatioun of the feis and dewties thairin contenit, and confermit be oure said soverane lord be his charter under his hienes greit seill, and als that the heretable infeftment maid be Johne Fentoun, yconimus of the said abbey of Dumfermling for the tyme, with consent and assent of Williame, commendatair of Pittinweme, baillie and convent of the said abbey, to Schir Robert Melvile of Murdocairnie, knicht, his airis and assignais of Garvokwod, with the landis, schawis, busis and utheris pertening thairto, lyand within the lordschip of Dumfermling, and als ratifiet and apprevit be the said Patrik, maister of Gray, and renewit be him the tyme he stude commendatair of the said abbey and convent of the samyn, sall stand in full strenth and force, and the samin hes bene frome the begynning and salbe in all tymes cuming valide and effectuall in thame selffis, notwithstanding of ony clause or provisioun contenit in this present act or ony uther objectioun that may be maid in ony uther respect aganis the saidis infeftmentis or ony ane of thame.

Anent the supplicatioun presentit to oure soverane lord and lordis of articles be David, erle of Craufurde, makand mentioun that quhair, be ane chartour of alienatioun of fewferme fra Johnne Fergussoun, provinciall of the Gray Freris of Dundie, with the consent of the rest of the freris of the said place, annaliit to his said umquhile fader, David, last erle of Craufurde, all and haill thair yairdis, toftis, croftis and medowis, with thair pertinentis, liand on the north side of the said burgh of Dundie, gevin out to thame of befoir be his predicessouris, upoun the quhilk alienatioun of fewferme his said umquhile fader obtenit confirmatioun, quhilk is reddie to be producit befoir his majestie and lordis; nochttheles as the said erle is informit be ane generall gift gevin to the burgh of Dundie of all the giftis and annuellis etc. pertening to ony freris or alterages within thair said burgh, quhilk thai desir to be confermit be ane generall act in this present parliament, and thairby thai intend to tak fra the said erle his said rycht and title, thairfoir desiring gif the said act be not past bayth thair titillis be sichtit befoir his majestie and lordis that it may be knawin quhilk of thame hes the best rycht for eschewing of langair proces; and incais it be past becaus the said erle knew not of the samin and it is done in his prejudice, he desiris presentlie to be harde in thair presence afoir ony furder voitting in the said mater, as at mair lenth is contenit in the said supplicatioun. Quhilk being hard, sene and considerit be his hienes and estaittis, oure said soverane lord, with advise of his saidis estaittis of parliament, understanding the confirmatioun of the generall gift grantit to the burgh of Dundie of the saidis freir landis and annuellis etc. onnawyse yit to be past nor grantit, ordanis the said David, erle of Craufurde, to be harde upoun the contentis and desir of this present supplicatioun, and the samin to be red how sone or at quhat tyme the toun of Dundie or ony utheris in thair names gevis in or suittis confirmatioun to be grantit to thame of thair said generall gift of the saidis freir landis and annuellis liand within the said burgh appertening to the samin; quhairupoun the said David, erle of Craufurd, askit instrumentis.

Act in favour of the Erle of Mar

Anent the supplicatioun gevin in and presentit to oure soverane lord and thre estaittis in this present parliament be Johnne, erle of Mar, lord Erskin etc., makand mentioun that quhair umquhile Dame Issobell Dowglas, countes of Mar, wer heretably infeft the tyme of hir deceis in all and haill the erldome of Mar, lordschip and regalitie of Gareauch, haldin immediatlie of oure soverane lordis predicessouris, as his infeftment at mair lenth proportis, lyk as efter hir deceis umquhile Robert, erle of Mar, lord Erskin, the said Johnne, erle of Maris predicessour, wes lauchfullie servit and retourit air to the said umquhile Issobell of the said erldome of Mar, lordschip and regalitie of Gareauch, to quhome likwayes umquhile Johnne, erle of Mar, the said complenaris fader, wes lauchfullie retourit air, swa nixt he as air to his said umquhile fader, quha wes air to the said umquhile Robert, erle of Mar, lord Erskin, his predicessour, and sua air be progress to the said umquhile Dame Issobell Douglas, countesse of Mar, hes the undowtit heretable rycht to the said erldome of Mar and lordschip and regalitie of Gareauch, albeit his predicessouris hes bene wranguslie debarrit frome the possessioun of the saidis landis, erldome and lordschip, pairtlie be the occasioun of the trubles occurrand and interveneand, and partlie be the iniquitie of tyme and staying of the ordiner course of justice to thame be the partiall dailling of sic personis as had the governament of oure soverane lordis predicessouris and realme and thair officiaris for the tyme, notwithstanding the humble supplicationis and frequent interpellationis maid be the said Johnne, erle of Maris predicessouris, alsweill in parliament as in counsall, for the possessioun of the saidis landis as salbe sufficientlie verefeit be authentick writtis and evidentis. The quhilk being advisitlie considerit be oure soverane lordis derrest mother, efter hir perfite aige, and hir hienes movit of conscience, as become of hir princelie dewetie, to restoir the lauchfull airis unto thair just heretage and possessioun, efter mature deliberatioun, diligent tryall and inquisitioun tane of the premisis, gaif, grantit and disponit heretablie to umquhile Johnne, erle of Mar, lord Erskin, the said complenaris fader, the said erldome of Mar, with the landis of the lordschip and regalitie of Gareauch, with thair pertinentis, annexis, connexis and utheris speciftit in the charter, grantit be his hienes derrest moder under the grite seill to him thairupoun, and seing for the said erlis better securitie and that his hienes derrest moderis gude intentioun may tak the better effect toward the possessioun of the saidis lands, necessar it is that he be servit air to his predicessouris quha deit last vest and seisit in the said erldome, lordschip and regalitie, and that ane sufficient rycht and actioun be establischit in his persone and his airis for recovering of the saidis landis and possessioun thairof, notwithstanding the diuturnitie and lenth of tyme that hes intervenit, considering that be the lawes and custume of the realme the richt of blood nor yit ony heretable title fallis under prescriptione, nor is tane away be quhatsumevir lenth of tyme or laik of possessioun, and thairfoir desirand his majestie and estaittis, in respect of the premisis, to tak tryell of the richtis and infeftmentis quhilkis the said umquhile Dame Issobell Dowglas, countesse of Mar, had of the said erldome of Mar, lordschip and regalitie of Gareauch, and siclyk to tak triall gif the said umquhile Robert, erle of Mar, lord Erskin, his predicessour, wes dewly servit and retourit air to the said umquhill Dame Issobell of the said erldome, regalitie and lordschip and that umquhile Johnne, erle of Mar, the complenaris fader, wes servit and retourit air to the said umquhile Robert, erle of Mar, and that his hienes derrest mother, haveing consideratioun of the saidis richtis, gaif and disponit the said erldom of Mar, lordschip and regalitie of Gareauch, to the said umquhile Johnne, erle of Mar, his fader, the quhilkis richtis beand tryit be his majestie and estaittis of parliament to be lauchfull, valide and sufficient, that the samyn mycht be ratifeit, approvin and confermit in this present parliament and the samin declairit to haif als grite strenth, force and effect in the said complenaris persoun as the samyn had or mycht have in the persoun of the said umquhile Dame Issobell Dowglas or umquhile Robert, erle of Mar, lord Erskin, hir air, and the said Erle of Mar, complener, to haif full richt thairby as air be progres to his saidis predicessouris to all and haill the saidis landis quhairin the saidis umquhile Dame Issobell Dowglas, countesse of Mar, or umquhile Robert, erle of Mar, hir air, deit vest, seisit and retourit, notwithstanding the lenth and diuturnitie of tyme quhilk hes intervenit sensyne, during the quhilk space he and his predicessouris, be the iniquitie of the tyme, hes bene wranguslie debarrit from the saidis landis and possessioun thairof, and to declair be ane act of parliament that his richt to the said erldome, lordschip and regalitie and actioun for recovering thairof and possessioun of the samin hes not nor sall not prescrive be the course of the said tyme, bot that the said erle and his airis hes, and salhave, als guid richt, entress, title and actioun in and to the said erldome, lordschip and regalitie as gif he wer immediat air to the said Dame Issobell Dowglass or to umquhile Robert, erle of Mar, lord Erskin, his air, or had persewit for the samyn within yeir and day efter thair deceis, notwithstanding onie exceptioun of prescriptioun or laik of possessioun that may be allegeit in the contrair, without prejudice alwayes of all uther lauchfull defensis competent to the pairties haveand interess, as at mair lenth is contenit in the said supplicatioun. Quhilk being hard, sene and considerit be his hienes and estaittis of parliament, and efter diligent tryall and consideratioun had be thame of the richtis and infeftmentis quhilkis the said umquhile Dame Issobell Dowglas had of the said erldom of Mar, lordschip and regalitie of Gareauch and of the retouris grantit to the saidis umquhile Robert, erle of Mar and Johnne, erle of Mar, of the samyn successive and infeftmentis grantit to the said erles fader of the samin erldome and lordschip, and of all utheris writtis abonewrittin mentionat in the said supplicatioun and producit be the said complenair for verefeing of the contentis thairof, and thai thairwith being ryplie advisit, oure said soverane lord and thre estaittis of parliament, findand the richtis abonespecifiit to be lauchfull, valide and sufficient to preif and verifie the pointis of the said supplicatioun, ratifeis, apprevis and confermis the samin, and decernis and declairis the foirsaidis richtis to have als grite force, strenth and effect in the persoun of the said Johnne, erle of Mar, as the samin had or micht haif in the persone of the said umquhile Dame Issobell Dowglas or umquhile Robert, erle of Mar, lord Erskin, his air, and he to have full richt thairby as air be progress to his saidis predicessouris to all and haill the saidis landis quhairin the said umquhile Dame Issobell Dowglas, countesse, or umquhile Robert, erle of Mar, hir air, deit, vest, saisit and retourit, notwithstanding the lenth and diuturnitie of tyme quhilk hes intervenit sensyne, during the quhilk space the said erle and his predicessouris, be the iniquitie of the tyme, hes bene wranguslie debarrit from the saidis landis and possessioun thairof; and als decernis and declairis that the said complenairis richt to the said erldome, lordschip and regalitie and actioun for recovering thairof and possessioun of the samin hes not, nor sall not, prescrive be the course of the said tyme, bot that he and his airis hes, and salhaif, als gude richt, interess, title and actioun in and to the saidis erldome, lordschip and regalitie as gif the said erle wer immediat air to the said Dame Issobell Dowglas or to umquhile Robert, erle of Mar, lord Erskin, hir air, or had persewit for the samin within yeir and day efter thair deceis, notwithstanding ony exceptioun of prescriptioun or laik of possessioun that may be allegit in the contrair, but prejudice alwayes of all uther lauchfull defensis competent to the pairties haveand interess.
