Protestatioun of the commendatair of Paislay for the Lord Maxwell

The quhilk day, in presence of the kingis majestie and thrie estaittis of this present parliament, compeirit personallie Claude, commendatair of Paislay and Williame Ballie of Lamingtoun, and in name and behalf of Johne, erle of Mortoun, lord Maxwell, protestit that be the generall act of restitutioun and rehabilitatioun of the airis of all personis foirfaltit in his hienes minoritie sen his coronatioun for quhatsumevir offence, exceptand as is thairin specialie exceptit, and specialie be rehabilitatioun grantit to Archibald, erle of Angus, as nerrest air to succeid to umquhile James, erle of Mortoun, in and to the erldome of Mortoun, lordschip of Dalkeyth etc., that the said Johnne, erle of Mortoun onnawyse be prejugeit of that pairt of the landis, erldome and regalitie of Mortoun or lordschip of Dalkeyt pertening or competent to him lauchfullie be birthrycht, ather as air to umquhile James, erle of Mortoun, lord Dalkeith, his guidschir, or as air to Dame Beatrix Dowglas, lady Maxwell, his moder; and siclyk protestit that the premisis onnawyse alter nor infringe onie conditioun of the said Lord Maxwellis licence grantit to him befoir his lait depairting furth of this realme in Maii last wes, and that na thing done in this parliament micht be hurtfull or prejudiciall to the said lord in ony wayes; quhairupoun the said Claude, commendatair of Paislay and Williame Baillie of Lamyngtoun, in name and behalf of the said Lord Maxwell, askit and requirit act and instrumentis.

The quhilk day, in presence of the kingis majestie and thrie estaittis of this present parliament, compeirit personally Robert, lord Boyd, for him selff and thir personis underwrittin: thay ar to say, Thomas, Maistir of Boyd, Robert Boyd of Badinhauch, James Boyd of Kippis, George Elphingstoun of Blythiswod, Hew Craufurd of Clobarhill and Alexander Boyd, bruther germane to Adame Boyd of Pinkill, and the said Lord Boyd, for him selff and in name of all the speciale personis abonespecefiit, protestit that the benefite of pacificatioun and restitutioun grantit to James Betoun, archebischope of Glasgw onnawyse hurt nor prejuge the said lord and foirsaidis anent quhatsumever richt, title, tak, rentale or few grantit to thame, or ony of thame, be umquhile James Boyd, archibischop of Glasgw for the tyme, or ony uther, his predicessouris, in ony sorte, bot that thair saidis richtis may stand in full effect in tyme cuming, notwithstanding the constitutioun foirsaid; and thairupoun the said Lord Boyd, for him selff and remanent personis abonewrittin, askit actis and instrumentis.

The quhilk day, in presence of the kingis majestie and thre estaittis of parliament, compeirit persounallie Johnne Betoun of Balfour, and protestit solempnitlie that the benefeit and favour of restitutioun grantit in this present parliament to James, archibischop of Glasgw sall onnawyse be hurtfull or prejudicall to the said Johnne Betoun of Balfour, servit and retourit nerrest and lauchfull air maill and of talze to umquhile Johnne Betoun of Balquharg, his guidschiris bruther, off all and haill the landis of Achmuthies, South and North Carreis, Grange of Connan and thair pertinentis, liand within the regalitie of Abirbrothok and schirefdome of Foirfair, quhairupoun infeftment hes followit, with possessioun in the said Johnnis persoun anent his rychtis and titles of the saidis landis, notwithstanding the act of ratificatioun of the pacificatioun, restitutioun and abolitioun past generallie in this present parliament; and thairupoun askit actis and instrumentis.
