Anent oure soverane lordis privie counsall

Oure soverane lord, with avise of his thrie estaitis assemblit in this present parliament, statuitis and ordanis that his hienes privie counsall in tyme cuming sall consist of the nowmer of [...] personis and not exceid the same: thay ar to say, of noble men and prelattis to be alwayes of the said privie counsall quhen thai happin to be present, or ar send for be his hienes, sextene, viz., the Lord Hammiltoun, the Erllis of Angus, Huntly, Craufurde, Erroll, Merschell, Bothuill, Montroise, Mar and Rothes, the Archibischope of Sanct Androis, the Bischop of Dunkeld, the lordis of Doun and Hereis, the commendataris of Paislay and Pluscardin. And thir uther personis efter mentionat to be of his hienes ordiner and daylie privie counsell: thay ar to say, the Bischope of Orknay, the commendatair of Culross, the Laird of Sagy and the Laird of Coldenknowis, captaine of the castell of Edinburgh, and [...] ma quhome his majestie sall pleis elect, nominat and adde heirefter with the officiaris of the estait underwrittin, viz., the chancellair, quha is alsua secretair, the thesaurair, comptrollair, collectour, lord keipare of the previe seill, maistir of requestis, justice clerk, advocate, the thesaurair depute and the clerk of registri, off the quhilkis, fyve at the leist to be present at the heiring or ordouring of ony mater quhair ane act or decrete salhappin to be maid; and that nane presume nor tak upoun hand to abyde in the counsalhous during the tyme that the counsall sittis bot the lordis and utheris counsallouris nominat and admittit be his majestie, not exceiding the number abonewrittin, nor that nane injyre him self to be ane of the nowmer of the said privie counsall, except he be ane erle, lord of parliament, knycht or ane of the senatouris of the college of justice, and that efter the death and deprivatioun of ane of the personis abonewrittin and na utherwayes; nor that na personis remane in the counsalhous in the tyme of the sitting thairof bot the saidis lord and counsellouris, the clerk of the counsall, the secretairis depute and the depute of the maistir of requeistis without his majesties speciall leve, under the pane of repruif and incurring of his majesties indignatioun; and that na thing subscrivit be his majestie be a suffcient warrand to the signet, privie or great seillis, nor in na uther jugement nor compt, quhairever the samin is presentit, quhill the samin be subscrivit by that officer unto quhais charge and office properlie it appertenis; certefeing thame that dois in the contrair, thay sall anser thairupoun at ther heachest charge and perrell.

Act in favour of the sessioun for ratificatioun of thair privileges

Oure soverane lord, now being of his perfite aige of xxj yeiris compleit, with advise and consent of the thre estaitis of this present parliament, hes ratifiet and apprevit and, be the tennour heirof, ratifies and apprevis of new all actis and constitutionis of parliament maid be quhatsumevir his hienes predicessouris of befoir in favouris of the senatouris of the college of justice, thair memberis and officiaris, with all privileges, fredomes, immunities and liberties grantit and gevin to thame, and specialie the institutioun, privilegeis and commodities grantit to the college of justice be oure soverane lordis guidschir, King James the Fyift. Item, the gift gevin thame of the quottis of all testamentis and power and jurisdictioun ower the haill commissaris within this realme, the privilege and power grantit to thame to elect and cheis ane president maist apt and worthie thairfoir furth of thair haill nowmer; and decernis and declairis the samyn to haif full strenth, force and effect in all tymes heirefter, sua that the samin may be put to full and dew executioun in all pointis and to stand as perpetuall lawes to thame and thair successouris.

Act in favour of sic of the lordis of sessioun as sall becum ageit and unhable

Anent the propositioun maid on the behalf of the ordiner senatouris of the college of justice, that thair privileges and immunities may be continewit and stand in thair favouris quhen thai salbe ageit and unhable to attend ordinerlie in the sessioun, oure soverane lord, now efter his lauchfull and perfite aige of xxj yeiris compleit, with avise and consent of his thrie estaitis in parliament, will, grantis and declairis that the absence of ony of the ordiner senatouris of the college of justice (how sone thai salbe found be a sufficient nowmer of the lordis ageit and unhable to mak continewall residence) sall nawayes be hurtfull or prejudiciall to thame towardis thair places, levingis and enjoying of all privilegeis quhilkis thai haif had throw thair being of the ordiner number of the said college; and ordanis the lordis of counsall and sessioun now being, or that salhappin to be for the tyme, upoun the nominatioun and recommendatioun of oure soverane lord or his successouris, to ressave, place and admit uther qualifiit personis in the ordiner places of the saidis ageit and diseasit senatouris during thair absence, reserving alwayes to thame during thair lyftymes thair places and voitis in counsell and sessioun quhen thai may be able to ryde or salhappin to be present, with all richtis, commodities, privileges and immunities quhilkis thai, as senatouris ordiner, had in tyme bigane, sua that thai may brouk and possess all thair benefices (under prelaciis) frie, without payment of ony thridis, taxationis or uther charges during thair lyftymes, sen ordour is to be takin anent the sustentatioun of the ministery of the kirkis belanging to thair benefices as utheris of the spirituall estait of the lordis of sessioun; and quhen thay ar present, that the utheris personis quhilkis salbe appointit to supplie thair absences gif place to thame sa lang as thai ar present.
