Act in favouris of Johnne Hammyltoun of Drumry

Anent the supplicatioun gevin in be Johnne, lord Hammyltoun and Johnne Hamyltoun of Drumry to the kingis majestie and lordis of articles, beirand that the said lord, with ane greit numer of his surname, kyne and freindis, hes bene, of lang tyme past, baneist and exilit of our soverane lordis presens and, be the injurie of tyme and occasioun of the civill trublis of sa lang continewance within this realme, hes sufferrit greit loss and damnage in the possessioun of thair guidis, landis and levingis, all frie repair and access to our said soverane lordis persoun, counsall and sessioun and utheris his majesteis offices being alluterlie refusit to thame for expeditioun of thair benefices; and speciallie the said Johnne Hammyltoun of Drumry, quha, being undoutit fewar of the landis of Craigfudeis and Myddlefudeis, quha, be rycht of his infeftment (albeit unconfirmit be malice of the tyme), wes in possessioun thairof fra the dait of the samyn, quhilk was the tent day of Julii, the yeir of God jM vC thriescoir sewin yeiris, he haifing maid instant sute be his freindis offering greit sowmes of mony at sindry and diverse tymes to our said soverane lordis thesaurar to haif the confirmatioun thairof exsped, unto the tyme that Patrik, now archiebischop of Sanctandrois, aganis the dewatie and professing of his calling, yea, eftir the said Johnne had obtenit the said signatour componit and exped, espying the tyme propir and commodious to mak his conques upoun the said Johnnes rowmes and possessionis of the saidis landis of Craigfudeis and Myddlefudeis, sett the samyn agane in few to his awin sone and spous and to certane utheris personis, the said Johnnis grittest inemeis for the tyme, procuring the laitest sett fewis to be first confirmit, that be the act of parliament procurit be him selff in prejudice of the said Johnnis few maid at Striviling, the xxv day of Julii the yeir of God jM vC lxxviij yeiris, anent double confirmatiounis of fewis, be the quhilk it is provydit that the first confirmatioun of the last few sall prevaill, the first few laitest confermit the said Johnnis infeftment cled with sa lang ane kyndes and possessioun mycht be maid unproffitable to him for evir; and thairfoir, to the end that sic fraud may be disapointit and the said Johnne reponit and reintegrat in the rycht of his infeftment, few and possessioun foirsaid, and for mony just and lauchtfull impedimentis quhilk he had to procure his confirmatioun at ony tyme befoir, our said soverane lord, with advise and consent of his thrie estaitis of this present parliament, hes statuit and ordanit and, be the tennour heirof, statutis, ordanis and declairis that it salbe lesum to the said Johnne Hammyltoun to purches confirmatioun of his said few, and that the samyn salbe als effectuall, valid and sufficient as gif the samyn had bene exped befoir ony uther few sett to the said Patrik, archiebischop of Sanctandrois, to his spous, bairnis or quhatsumevir uther personis, nochtwithstanding the lait act of parliament maid anent double confirmationis of fewis or quhatsumevir uther law, statuit or constitutioun maid in the contrair, anent the quhilkis oure said soverane lord and estaitis foirsaidis dispensis thairanentis be thir presentis, reservand alwayis to sik as hes tane ony portion of the saidis landis in few of the said archiebischop, thair actionis of warrandice, as accordis of the law, for repetitioun of the sowmes of money ressavit be him for thair saidis fewis allanerlie; and thairfoir our said soverane lord, with advise foirsaid, ordanis his hienes thesaurer and his depuitis present and that salbe for the tyme to pas confirmatioun upoun the said Johnne Hammyltonis fewis without ony stop or impediment upoun his expensis, as accordis, for the ressonis and causis foirsaidis notourlie knawin to our said soverane lord and thrie estaitis, but prejudice of the said act of parliament in onywayis to utheris oure soverane lordis leigis, bot that thay may bruik the benefite thairof nochtwithstanding the premisis.

Oure soverane lord and his thrie estaitis of parliament speciallie declairis that under his majesteis generall revocatiounis maid in parliament and secreit counsall is, and salbe, speciallie comprehendit the pretendit infeftment or infeftmentis of fewferme or utheris maid be his hienes in his les aige to William Stewart of Fyntillach, hes airis and assignais heretablie, of all and sindrie the landis of Almerlandis, extending to ten pund land of auld extent, lyand within the stewartrie of Kirkcudbrycht, as being sett in hurt of his office, in prejudice and hurt of William Douglas of Drumlangrig and kyndlie tennent, taxman and possessour thairof, and thairfoir declairis, decernis and ordanis that all and sindrie the saidis infeftmentis, with the preceptis and instrumentis of sesing fallowing thairupoun, haif bene fra the begynnyng, ar, and salbe in tyme cumyng, of na strenth, force and effect.

Ratificatioun of the landis of Ormstoun to the Laird of Cesfurde

The kingis majestie, with consent of the thrie estaitis convenit in parliament, understanding that thair was infeftment grantit of lang tyme past to William Ker of Cesfurde, warden of the myddle marchis of this realme, and his airis heretablie, off all and haill the landis and barony of Ormstoun, with annexis, connexis, pairtis, pendiclis and pertinentis, outsettis, tennentis, tennendreis and service of frie tennentis, togidder with the tour, fortalice, manis and fischeingis of the same and all thair pertinentis, lyand within the sherefdome of Roxburgh, and siclyke all and haill the tuentie mark land of Maxtoun, callit Gevanis Landis, lyand within the sherefdome foirsaid, quhilk infeftment, with all sesingis, rychtis and utheris titillis maid to the said William and his foirsaidis, was ratifiit, apprewit and confermit in the parliament haldin at Edinburgh, the xxviij day of November, the yeir of God jM vC fourscoir ane yeiris, lyk as his majesteis intentioun and fuill mynd is that the samyn sall stand in full strenth and force in all tyme heireftir, albeit laitlie thair was ane pretendit rycht and infeftment maid of the saidis landis to James Ormstoun and his airis contenit thairintill, proceding upoun the revocatioun of the uther infeftment maid be us to the said William of befoir; thairfoir our said soverane lord, willing that the said William salbe fullie reestablissit in his rycht of the saidis landis in plane parliament, hes revokit and annullit and, be the tennour heirof, revokis, rescindis, casis and annullis all and quhatsumevir infeftmentis, chartouris, preceptis, instrumentis of seising, rychtis, titillis and utheris securiteis maid or grantit to the said James, his bairnis posteritie or freindis in quhatsumevir maner or ordour or ony utheris personis quhatsumevir of the saidis landis or ony pairt thairof, with all and quhatsumevir fallowing or proceiding thairupoun at ony tyme sen the first rycht thairof acquirit be the said William, quhilk was grantit to him upoun guid and wechtie considerationis, and for the trew and thankfull service done be the said William to his majestie at all tymes and in recompance thairof; and to the effect the said William and his airis may remaine in the fuill integritie of thair rycht foirsaid, oure said soverane lord, with advise of his haill three estaitis in present parliament, ratifeis, apprevis and confermis all and sindrie the infeftmentis, rychtis, titillis and securiteis maid to the said William and his foirsaidis of the saidis landis, with thair pertinentis, ather proceiding upoun ane resignatioun of umquhill Capitane Robert Anstruther or utherwayis grantit in quhatsumevir maner or ordour, decernis and declairis the samyn to haif fuill force, strenth and effect as is contenit thairintill in all tymes cuming, nochwithstanding of ony revocatioun, generall or speciall, maid be his grace heirtofoir and of the said James Ormestoun infeftment proceiding thairupoun, grantit ather to the said James, his bairnis, freindis or ony utheris personis foirsaidis, quhilk his majestie declairis sall nevir effect in tyme cuming; bot the said William and his airis to be in siclyke estait and conditioun as gif the samyn had nevir bene maid, and as the said Williamis infeftment had bene maid in his majesteis perfyte aige and sall not be subject to ony revocatioun in tyme cuming.

Oure soverane lord, understanding that James Murray of Pardowis hes ane yeirlie pensioun disponit to him furth of the third and superplus of the abbacie of Cowper, to be possedit and intromettit with be thame, and willing that he bruik and joyse the samyn in tym cuming, thairfoir our said soverane lord, with advise of the thrie esteatis of this present parliament, ratefeis, apprevis and confermis the foirsaid gift of pensioun maid and grantit to the said James, with decreit gevin be the lordis of counsall conforme thairto, swa that he may peceable bruik and joyse the samyn in all tyme cuming conforme to his gift of the same, nochwithstanding quhatsumevir revocatioun maid or to be maid be our said soverane, anentis the quhilkis his hienes, with advise of the thrie estaitis, dispensis be thir presentis, provyding alwayis that the said James wes in possessioun of his said pensioun the yeir imediatlie befoir his depairting furth of this realme.

Oure soverane lord, with advise of the thrie estaitis of this present parliament, ratefeis, confermis and, for him and his successouris, perpetuallie confermis the gift of pensioun gevin and grantit be umquhill Mathew, sumtyme erll of Lennox, his darrest guidschir and regent for the tyme, with the gift alswa grantit be Patrik, archiebischop of Sanctandrois, to George and Andro Halyburtonis, lauchfull brethir to Schir George Halyburtoun of Pitcur, knycht, of the sowme of fyve hundreth pund money and victuall assignit for the said sowme contenit in the said Patrik, archiebischop of Sanctandrois gift of pensioun, yeirlie to be upliftit be thame furth of the landis underwrittin contenit in the saidis giftis, swa that thay may peceable bruik, joise and posses the samyn in all tyme cuming, with fuill power to thame to transfer the samyn at thair plesure in ony uther persoun or personis thai pleise according to thair saidis giftis als frelie as gif the same had bene speciallie exceptit in thair saidis giftis furth of the former act of parliament maid in the moneth of Maii, the yeir of God jM vC lxxxiiij, for annulling of all pensionis gevin furth of the said archiebischoprik, quhilk sall nawayis be extendit to the saidis giftis now confermit, providing alwayis that this present confirmatioun unnawayis extend to the fruictis of the said pensioun off the croppis and yeiris of God jM vC lxxxiiij yeiris last bypast and fourscoir fyve yeiris instant, quhilkis giftis oure said soverane, with advise and consent foirsaid, ratefeis and apprevis as said is, nochwithstanding quhatsumevir act of parliament maid in the contrair thairof preceiding the dait heirof:

Forsamekle as we and our darrest guidschir, Mathow, erll of Lennox, lord Darnelie, our lauchfull tutour and regent to us, our realme and leigis, understanding the guid, trew and thankfull service of our weilbelovit Maistir James Halyburtoun, provest of Dundie, in defence and furthsetting the auctoritie alsweill of us as of the quene, our moder, in hir minoritie, not only to the hazard of himselff and his freindis, bot to the greit tinsell of thair guidis and substance, for the quhilk ane greit and honorable rewaird being oftymes promisit to him at last ane pley aganis our couising Patrik, lord Gray, wes put in his handis, the persute quhairof was na les skaithfull and sumptuous to him nor his former panes and service in publict service of our realme and yit nathing to his commoditie; quhair the mater being referrit amicable to the decisioun of our darrest cousing James, erll of Murray, lord Abirnethie, umquhill regent to us, our realme and leigis, he nawayis willing to sie the overthrow or hurt of ony noble or auncient house, nor yit that sic as hes done guid service in the commoun weill suld be unrewairdit or that ony variance, discord or actioun suld ly over amangis ony parteis affectionat to our service, thairfoir, be his decreit arbitrall, reconsiliat the said Lord Gray and Maistir James for all actionis, causis and querrellis bygane and our name. promittit to provid him of the sowme of ane thowsand pundis of yeirlie rent for all the dayis of his tyme in maner fallowing: that is to say, fyve hundreth pundis furth of the fruictis of our abbay of Scone, quhilk is alreddy assignit to him be our gift under our privie seall, and the uther fyve hundreth pundis furth of the first and reddiest fruictis of the bischoprik of Murray, howsone the samyn sall happin to vaik be deceise of the present possessour. Forsamekle as upoun greit and wechtie considerationis tending to the continewance of the weill and honour of the auncient house of Erroll, it was befoir fund necessar and expedient that Frances Hay, secund sone lauchtfull to umquhill Andro, lait erll of Erroll, lord Hay, constable of this realme, sould be infeft in all landis, lordschippis and barroneis and offices pertening to the said erldome, lyke as he is infeft thairin of lang tyme bypast, immiediatlie haldin of our soverane lord, as his infeftmentis in thame selffis at mair lenth proportis; and be ressoun that the said Frances wes, for necessair and urgent causis, speciallie in consideratioun of the manifest inhabilitie of Alexander Hay, his eldar brothir, promovit to the same erldome, as he bruikis the landis and leving pertening thairto, swa it is necessar that he suld be endewit and dotit with all the honouris and digniteis quhilkis pertenit to his antecessouris of the said noble house. Anent the supplicatioun gevin in be bailleis, counsall and communitie of the burgh of Anstruther be eist the burne, to our soverane lord and his thrie estaitis of parliament, makand mentioun that quhair it hes pleisit his hienes, with advise of the lordis of his secreit counsall, to mak, creat and erect the burgh of Anstruther, being ane burgh of baronie of befoir, in ane frie burgh regall and hes dotit the samyn with diverse and sindrie priveligis, liberteis and fredomes, as the chartour and infeftment of erectioun under the greit seill grantit thairupoun, presentlie schawin, at mair lenth beiris; and seing it is our soverane lordis guid will and mynd that the said erectioun remane and tak effect in all tyme cumyng, for the bettir securitie thairof, it is werry necessar that the samyn, and chartour grantit thairupoun, be ratefeit and apprevit in this present parliament, quhilk hes not bene refuisit to sic personis quhair the lyk commoditie is not lyke to result, to wit, to Johnne Betoun of Balfour, confirming the lait infeftment and erectioun maid to him and his airis of the toun of Kilrinne and porte of Skynfischetoun, and diverse utheris of the lyk conditioun. In consideratioun of the lyke premisis, our said soverane lord and thrie estaitis of this present parliament ratefeis, apprevis and confermis the said erectioun, chartour and infeftment grantit thairupoun, and haill priveleges, conditionis, clausis and provisionis contenit thairin, eftir the forme and tennour thairof in all poyntis, provyding alwayis that this present ratificatioun onnawayis sall be prejudiciall to the burgh of Craill, thair rychtis and actioun quhilk they have alriddie dependand, or to be intentit aganis the said toun of Aunstruther tuiching thair privilegis befoir the lordis of counsall and sessioun, as accordis of the law.

Forsamekle as anent the supplicatioun gevin in to our soverane lord and lordis of this present parliament be James Murray, brothir germane to umquhill William Murray of Touchaddame, and Agnes Cunynghame, lady Polmais, that quhair it is not unknawin to our soverane lord and lordis foirsaidis thair was laitlie ane act maid for repossessing of sic personis as hes bene forfaltit to thair landis, rowmes and possessionis etc., quhilk act and benefite thairof, as we ar informit, is to be ratefeit in this present parliament and ordinance to be maid for anulling and rescinding of all decreittis gevin aganis the saidis forfaltit personis and sic utheris as wer justifeit in justice courtis for ony cryme of treasoun; quhilk act and ordinance not being ryplie considderit, and the boundis thairof not being limitat, sall be prejudiciall to mony our soverane lordis liegeis and speciallie to the saidis James Murray and Agnes Cunynghame, seing it is of treuth that thay, lang befoir the convictioun of umquhill Johnne Cunynghame of Drumquhassil for crymes for the quhilkis he was justifeit to the deith, they, eftir thrittie yeiris dependence, obtenit diverse decreittis aganis him befoir the lordis of counsall, ane pairt thairof for reductioun of certane his pretendit and forgeit titillis maid be him for thair awin landis of Polmais Cunynghame, alias Marschell Polmais, Sinclair and certane utheris landis and utheris for redemptioun of certane utheris comprisit landis, viz., ane pairt of the saidis landis of Polmais Cunynghame, Sinclair, Slamannan Mure, Bohaldeis and certane utheris, quhilkis decreittis the saidis James and Agnes obtenit befoir the saidis lordis of counsall aganis the said umquhill Johnne in foro contradictorio, quhair his haill defensis wer herd, Maistiris Johnne Scharp and Johnne Russell being his procuratouris and knawing of the pronunceing of the samyn; and swa the saidis decreittis wer obtenit be thame aganis the said umquhill Johnne Cunynghame, not eftir nor be ressoun or ony cause proceiding upoun his forfaltour, bot be the saidis James and Agnes awin rychtis and titillis, and thairfoir the samyn aucht nawayis be comprehendit under the said act and benefit thairof, and nathir yit aucht the samyn and confirmatioun thairof in parliament wirk ony thing in favour of the said umquhill Johnis airis and successouris, to the hurt and prejudice of the saidis James and Agnes, thair rychtis, titillis, decreittis or actionis that thai haif, hes or may haif aganis thame, as at mair lenth is contenit in the said supplicatioun; quhilk being first sene and considderit be our said soverane lord and lordis of articlis, and thaireftir be his hienes and thrie estaitis of this present parliament, oure said soverane lord, with advise and consent of his saidis thrie estaitis convenit to this parliament, decernis and declairis the foirsaidis rychtis and decreittis obtenit be the saidis James Murray and Agnes Cunynghame and ather of thame in maner foirsaid, and that the samyn nor nane of thame to be comprehendit under the said act, ordinance and ratificatioun, and that the samyn act and benefite thairof sall not be extendit thairupoun, nor in nawayis be prejudiciall to the saidis James and Agnes or ather of thame and thair decreitis; and declairis the samyn to haif fuill strenth, force and effect in all tyme cuming.

Anent the supplicatioun gevin in befoir the kingis majestie and lordis of articlis be Jane Hamyltoun, lady Lamyngtoun, makand mentioun that quhair the said lady beleifis it is not unknawin to his hienes and counsell, present and being for the tyme, of the innumerall oppressionis committit aganis hir bairnis, familie, servandis, tennentis, guidis and geir thir mony yeiris bygane, not only be burning of thair housis slaying, hoching, stikking and shutting of thair cattell and guidis, mawing of thair grene cornis, leveing of thair bairnis, tennentis and servandis for deid, and utherwayis spuilyeing, reveing and oppressing of thame, bayth nycht and day, sa oft and mony tymes that it is impossible be writ or word to repeit the same without larger proces then evir hes bene red or presentit at anis in our said soverane and lordis of counsellis audience, and that be the Laird of Apilgirth and his complices, and nevirtheles hes bene commendit to this hour, bot rather intendis to persiveir in forther cruelteis and oppressionis as nowther the law of God nor his majestie suld resist the contrair. Maist humble, thairfoir, beseikand his majestie and lordis of articles, for the mercie of God in Jesus Crist, to haif consideratioun of the premisis and nocht only for respect heirof, bot for the simpillis caus, to tak sic summar ordour heirintill that scho may haif sum ressounabill assythment and satisfactioun of byganis, conforme to the money decreitis and lettres obtenit be hir aganis the said laird and his complices, and may be frie and quytte fra thair forder cruelteis and oppressionis in tyme cuming, as at mair lenth is contenit in the said supplicatioun. Quhilk supplicatioun, being first sene and considderit be the lordis of articlis, and thaireftir be the thrie estaitis of this present parliament, thay have remittit and remittis the foirsaid complaint to the will and gude consideratioun of our said soverane lord, to do, decerne and ordane thairin as his hienes sall think maist expedient and requisite; and als hes declairit and declairis that his hienes ordinance to be maid thairintill salbe of als greit strenth, force and effect as gif it war done, statute and ordanit be his majestie with advise of the thrie estaitis of this present parliament, nochtwithstanding quhatsumevir favour grantit to the said Laird of Apilgirth this present day.
