Efter the verificatioun of the quhilkis executionis, the said Maister David Makgill, advocat, producit thir twa wrytingis following, subscrivit be the kingis majestie, off the quhilkis, the tenouris followis respective: Rex. Maister David Makgill of Nesbet, oure advocat, forsameikle as we understand that thair is ane summundis of tressoun directit aganis diversis personis for the lait tumult and rebellioun laitlie comittit aganis us, and that oure servitour Robert Erskene is chargeit thairwithe to compeir in oure nixt parliament to be foirfalt for the causis contenit in the said summondis, nevirtheles, remembering the said Robertis gud and thankfull service done to us of befoir, and for certane gud considerationis, we ar movit nocht to insist aganis him in oure nixt parliament be the said summondis rasit aganis him, that ye deleit his name furthe of the samine and executionis thairof, to the effect he be nocht trublit thairby in ony sort, ye kepand thir presentis for your warrand. Forsamekle as thair is summondis of tressoun rasit and execut at oure and yow oure advocatis instance in oure name aganis Uthreid MacDowgall of Garthland and Uthreid MakDowgall, his sone and apperand air, for the tressonable supprysing and taking of or castell and toun of Striveling, being in cumpanie with diversis oure conspiratoris contenit in the summondis rasit thairupoun, at the leist art and pairt thairof, for diversis resollutions causis and considerationis moveing us, it is oure will that ye extinct and deleit furthe of the said summondis the saidis Uthreid MacDowgall and his sone and pas fra that pairt of the said summondis safer as concernis thame for the said cryme or ony ether crymes mentionat in the said summondis, dischargeing yow of all persewing or insisting aganis thame for the samine and of your office in that pairt, as alsua discharges the lordis of our parliament our justice generall and his deputis of all proeding aganis thame for the premisis simpliciter. And according to the comand of the saidis twa wrytingis, the said advocat, in presens of the kingis majestie and lordis of articles of this present parliament, past fra the persute of the saidis Uthrid MacDowgall of Garthland, Uthrid MacDowgall, his sone and apperand air, and the said Robert Erskene of Lytill Sauchy, and thairfoir thair saidis thrie nemmis, of command foirsaid war presentlie deleit furthe of the said summundis of foirfaltour. Upoun the productioun of the quhilkis twa wrytingis and deleting of thame furthe of the said summondis, the said advocat askit instrumentis.

The quhilk day, Schir Johne Maitland of Thirlestane, knycht, secrater to oure soverane lord, proponit in presens of the kingis majestie and lordis of articles that sum of the lordis of articles chosin in the last continewit parliament upoun the xxij day of Maii lastbipast ar now absent, thairfoir he desyrit the lordis present this day to advise gif thay mycht treit and conclude upoun the materis concerning the king and commoun weill of this realme in this present parliament, althocht sum of the saidis lordis of articles chosin of befoir be now absent. Quhilk propositioun being at lenth ressonit be the saidis lordis of articles present this day, thay, all in ane voce, findis and declaris that the lordis present this day mycht treit upoun all thingis in this present parliamet, thay being the maist pairt of the nowmer first chosin in the former parliament, siclyk as gif the haill lordis chosin to the articles the first day had bene present. The quhilk day, George erle of Huntlie declarit in presens of the kingis majestie and lordis of articles that he had, at the kingis majesteis command, tane James Arbuthnot of Lyntusk, quhome he had presentlie within this burgh of Edinburgh, reddie to be exhibit in presens of his grace and thrie estaitis presentlie convenit, and thairupoun askit instrumentis. The kingis majestie commandit the said Erle of Huntlie that he suld yit, as of befoir, keip the said James quhill his hienes and lordis of secreit counsale war forther advisit, as he wald anser to his grace upoun his obedience.
