Oure soverane lord, with advise of his thrie estatis of parliament, remembring that be the ordinance maid be his hienes and lordis of previe counsell at Striveling immediatlie efter the recovering thairof, it wes ordinit that na signature of infeftment, confirmatioun or richt of ony landis quhairby his majestie mycht be interessit suld be exped but advise of his secrete counsall sittand, and that Adame Hepburne of Ballinhard hes obtenit ane confirmatioun of the infeftment of fewferme maid to him be umquhill Patrik, bishop of Murray, commendatare of the abbay of Scone for the tyme, off all and haill the landis of Durdeis and utheris contenit thairin, lyand within the regalitie of Scone and sherefdome of Perth, quhilkis ar ane part of the landis laitlie annexit to the erldome of Gowrie, now becummand in his majesties handis be proces and dome of foirfalture ordourlie led aganis umquhill Williame, sumtyme erll of Gowrie, lord Ruthven and Dirltoun, quhilk confirmatioun his hienes and thrie estatis foirsaidis have considerit to be purchessit contrare the forme and tennour off the said ordinance and to the great prejudice and hurt of our soverane lord; and thairfoir his majestie, with avise of his hienes thrie estatis, decernis and declaris the said confirmatioun, with all that followit or may follow thairupoun, to be null and of nane availl.

Anent the supplicatioun presentit to the kingis majestie and his thrie estatis be Maister Robert Montgomerie, makand mentioun that quhair he, havand faithfullie travellit in the ministrie of the evangell sen the reformatioun of the religioun and being ane pasture almaist the space of xxij yeris bypast, it pleasit our soverane lord gratiouslie to bestow upoun the said Maister Robert the archiebishoprik of Glesgow, then vacand be deceis of umquhill Maister James Boid of guid memorie, at the quhilk tyme the said Maister Robert, humblie craving of the ministeris, his fellow lawboraris, to have obtenit thair consent and agriement thairunto, conforme to his hienes lawis, not onlie wes delayit in that point contrare to equitie and justice, bot likwayis wes in ane pretendit maner excommunicat be Maister Johne Davidsoun, minister at Libertoun kirk, be ane pretendit allegeit commissioun from the generall assemblie to that effect; efter that, his majestie, with avise of the lordis of his hienes secrete counsell, be ane expres act, the parties having interes being callit, comperand and thair reasonis and allegationis hard and considerit, dischargeit the pretendit presbytereis of Edinburgh, Linlithgow and Dalkeyth and all utheris presbytereis, eldershippis, generall and synodall assembleis of all proceding aganis the said Maister Robert for allegeit aspyring of the said bishoprik of Glesgow or trubling or persewing of his brethir for the same or for ony promis maid be him thairanent or ony uther thing depending thairupoun in tyme bygane and of thair offices in that part; and albeit thir yeris bypast the said Maister Robert hes maid maist ernist and humble suit to the said generall assemblie to have bene absolvit fra the foirsaid pretendit sentence, yit wald he not at ony tyme be hard, for quhat caus he is ignorant; thairfoir his majestie and thrie estatis, being assemblit as the soverane jugement of his estate, and the speciall confort and releif to the afflictit and oppressit hes maist humblie suppliit to tak consideratioun of his petious complaint, and speciallie quhen besyid all guid ordour usit in onie reformit estate or be ony warrand of the word of God he wes in pretendit maner foirsaid excommunicatt, albeit in verie deid the said Maister Johne Davidsoun did at na tyme admonis the said Maister Robert to amend or repair ony offence committit be him aganis the law of God and his halie commandementis, with the breking quhairof he wes na wayis chargeit be the said ministrie, bot onlie upoun ane pretendit act of the generall assemblie, quhairby the estate of bischopis is be thame in thair pretendit maner declarit unlawfull, to the quhilk, becaus the said Maister Robert wald not subscrive and renunce oure soverane lordis benefice bestowit upoun him, he wes at that tyme sua wranguslie entraitit, the quhilk he sufferit with the grittar patience becaus our said soverane lord and his maist honorable previe counsell wes at that same verie tyme chargeit in ane presumptuous maner be certane pretendit commissionis, as from the kirk, that his hienes suld not in ony tyme cumming appoint onie bischopis to beir rule or charge in the kirk or comoun welth, threatning the same sentence aganis his hienes and counsell quhilk wes pretenditlie execute aganis the said Maister Robert, quhilk sentence albeit he had justlie deservit be his stubburne disobedience as he hopis, in Goddis merceis, nevir to do, yit guid ordour wald haif requirit that efter diversis admonitionis he suld had bene denunceit at his awin paroche kirk quhair he duellis and not in ane furtiuus maner at the paroch kirk of Libertoun, quhairof he culd haif na knawlege to provyid ony lawfull or godlie remeid thairfoir; and seing the sentence of excommunicatioun is maist feirfull and terrible and be his hienes lawis men thairby debarrit from all civill societie and benefite of his hienes lawis, it appertenis cheiflie to his princelie cair to sie that the same be not abusit to serv the indiscrete appetite of ony men under quhat cullour or pretext so evir; in respect quhairof, fallin downe maist humblie at the feit of his majesties clemencie and wisdome of his thrie estatis, craving that be gratious consideratioun of the treuth he may be relevit and fred from the said pretendit sentence and declarit be his majestie and his estatis capable sum benefice as he, off his gratious guidnes, pleisis to bestow upoun him, likas at mair lenth is contenit in the said supplicatioun. Oure soverane lord and his thrie estatis, efter mature deliberatioun of the contentis thairof, decernis and declaris that his majestie and previe counsell procedit ordourlie in commanding the censure of the ministeris upoun the said Maister Robert to be stayit during his hienes will, for syndrie great and wechtie considerationis moving him, conforme to the said act of secrete counsell; and sen the estate of bishopis is establissit now of new in this present parliament, it is found and declarit be our soverane lord and his estatis that the excommunicatioun deduceit aganis the said Maister Robert, in contempt of our soverane lordis foirsaid act of counsell, is null and of nane availl, force nor effect, and that he may bruik all honouris, dignities and benefices as gif the samyn had never bene done. Alwaysis to tak away all excuis, it is statute and ordinit that the bishoppis and commissioneris to be appointit be his majestie for deprivatioun of ony unworthie in the charge sall try the said Maister Robert in all uther thingis that may be layit to his charge; as alsua it is ordinit and statute that as his majesties counsell did in this mater, sa sall his hienes, his successouris and previe counsell heirefter haif power to stay and suspend the decreittis of ony jugementis inflicting pane and punisinent, alsweill ecclesiasticall as temporall, for ane certane space, upoun speciall causis knawin to him and his foirsaid previe counsell.

Oure soverane lord, with avise and consent of the thrie estatis of this present parliament, upoun wechtie and guid considerationis tending to the establissing of peax and quietnes and universall obedience of his hienes auctoritie within this realme, hes gevin and grantit and, be the tennour heirof, gevis and grantis to his weilbelovit cousigne Johne, lord Flemyng, the like favour, grace and benefite of pacificatioun sua that he may bruik and jois the like privilege and conditionis as ar contenit in the pacificatioun maid and accordit upoun at the burgh of Perth the xxiij day of Februar, the yeir of God jM vC lxxij yeris; and hes declarit the same pacificatioun to be als largelie and favorablie extendit and interprete in favouris of the said lord for suirtie of him selff, his lyff, landis, heretageis and possessionis, or as gif he had bene speciallie nominat or comprehendit thairin, or as gif the haill articles, clausis and conditionis of the samyn pacificatioun wer expreslie specefeit thairin; thairfoir, our said soverane lord, with avise of his saidis thrie estatis, hes ratefeit, confermit and apprevit and, be the tennour heirof, ratefeis, apprevis and confermis the foirsaid pacificatioun gevin and grantit to the said Johne, lord Flemyng, in maner abonewrittin, efter the forme and tennour thairof, and decernis the samyn to have full strenth, force and effect in all tyme cumming; and forder declaris the samyn pacificatioun to be extendit als largelie and favorablie to the said lord as to ony uther personis, obtenaris of the like benefite, of befoir, in ony of oure soverane lordis parliamentis preceding, to the effect the said lord may obtene and get siclike possessioun, richt and titill to all landis, heretageis, takis, stedingis, rowmis, possessionis, teyndis and utheris quhatsumevir takis quhilkis pertenit to umquhill Johne, sumtyme lord Flemyng, his fader, at the feild of Carbarrie Hill, as gif he had never bene foirfaltit of befoir; and ordinis the lordis of counsell to direct lettres to that effect in forme as effeiris.

Oure soverane lord, for diverse and guid considerationis moving his hienes tending to the quietnes of his realme and universall obedience thairof, hes gevin and grantit and, be the tennour heirof, gevis and grantis to Schir Johne Maitland of Thirlstane, knicht, his hienes secretare, the like favour, grace, privilege and benefite of pacificatioun concludit at Perth, the xxiij day of Februar, in the yeir of God jM vC lxxij yeiris, and ratefeit and apprevit in parliament haldin at Edinburgh in the moneth of Aprill nixt thairefter in the yeir of God jM vC lxxiij yeris, and willis the samyn be als amplie extenditin his favouris in all respectis, conditionis, clausis, circumstanceis and privilegeis thairof as gif the said Schir Johne had bene expreslie comprehendit thairin; and also we will and grantis that the same pacificatioun be maist amplie interprete and extendit to him in all clausis thairof that may tend to his securitie, notwithstanding of ony restrictioun or limitatioun comprehendit thairin, and speciallie that the samyn be sufficient to rescind, retract, casis and annull, likas his majestie be thir presentis retratis, casis and annullis the proces and dome of foirfalture led and pronuncit aganis the said Schir John for quhatsumevir crymis of quhatsumevir wecht, committit, done or assistit be him in ony sort, and to restore and reintegrat the said Schir Johne aganis the samyn, siklike and als frelie in all respectis as gif the said proces of foirfalture had nevir bene led and dome of foirfalture had never bene gevin nor pronuncit againis him; and will and grantis that thir presentis be als sufficient and valiable in all respectis as gif everie claus of the said pacificatioun had bene heirin contenit and expreslie comhendit, quhilk his majestie haldis heirin for expressit, fullie rehabiliting, reintegrating and restoring the said Schir Johne to his same honour, heretageis, offices, rowmis, takis and possessionis quhatsumevir, the priorie and benefice of Coldinghame onlie exceptit, remitting and for his hienes and his successouris frelie forgeving all crymis, transgressionis and offenceis of quhatsumevir wecht, lesemajestie and utheris committit, perpetrat, done or assistit to be him fra the moneth of Junii, the yeir of God jM vC lxvij yeris to the moneth of November in the yeir of God jM vC lxxiiij yeris, providing alwayis that thir presentis be not extendit to the murthouris of the kingis father and twa regentis.

Oure soverane lord, with avise and consent of the thrie estatis of this present parliament, upoun wechtie and guid considerationis tending to peax and quietnes and universall obedience of his hienes auctoritie within this realme, hes gevin and grantit to umquhill Patrik, bischop of Murray, commendatar of the abbay of Scone, his airis and bairnis procreat of his body, the benefite, richt, privilege and libertie of our said soverane lordis pacificatioun maid and concludit upoun at the burgh of Perth, the xxiij day of Februar, the yeir of God jM vC lxxij yeris, quhilk is ratefiit and apprevit be his hienes and thrie estatis thairefter in parliament; and forther, our said soverane lord and thrie estatis, for him and his successouris, hes grantit that the airis of the said umquhill Patrik, bischop of Murray, salbe enterit and servit be brevis of his hienes chancelarie to all landis and annuelrentis in the quhilkis the said umquhill Patrik deit vest and sesit, and sall succede to him to all his debtis and movable guddis and bruik all honouris, privilegeis, dignities quhilkis they micht have brukit befoir the proces of foirfalture led aganis the said umquhill Patrik; and that all infeftmentis, fewis, dispositionis, pensionis, takis and utheris richtis maid be the said umquhill bischop to quhatsumevir persoun or personis during his lyftyme salbe als valiable to thame and thair airis as gif the said proces of foirfalture had never bene led aganis the said umquhill Patrik, bischop of Murray, and gif his name had bene expreslie specefeit in the said pacificatioun as at mair lenth is contenit thairin.
