In parliamento currenti tento apud Edinburgh decimo octavo die mensis Novembris anno Domini millesimo quingentesimo octuagesimo tertio per dominos commissarios subscriptos, viz, Andream Commendatarium de Jedburgh, Magistrum Joannem Lyndsay rectorem de Menmure, Magistrum Joannem Maitland de Thirlstane et Magistrum Thomam Bannatyne de Newtyill, et magistrum Davidem MacGill de Neisbit advocatum Regium.

Judicial proceeding: summons of treason; asking of instruments

The quhilk day Maister David MacGill, advocat to our soverane lord, produceit ane summoundis of treasoun dewlie execute and indorsit, persewit at the instance of our soverane lord and his hienes justice aganis Alexander Jarden of Appilgirth, James and Johne Jardanis, his brether, Williame Bell, Niniane Jardane, William Talliefeir, his servandis, William Jardane, als Reid Will, Thomas Jardane of Birnok, Thomas Jardane, his sone, David Johnestoun of Mylbank, David Moffett in Sibbiebelsyid and Matthew Moffet in Wodend, callit Dameshaw, for certane crymis of treasoun and lesemajestie committit and done be thane, and everie ane of thame, quhairby they wer summound to have comperit befoir our said soverane lord, his hienes justice, the xxv day of October last bypast, in the hour of caus, with continowatioun of dayis, to have ansuerit to the saidis summoundis of treasoun dewlie execute and indorsat aganis thame, as at mair lenth is contenit in the saidis summoundis; and efter that the foirsaidis haill personis, defendaris abonewrittin, wer diversis and syndrie tymis callit at the tolbuithe windok and nane of thame comperand, the said advocat immediatlie thairefter produceit Richard Bynning, messinger, Nicoll Newhall and Ninane Swan, messingeris, for probatioun and verificatioun of the executioun of the saidis summoundis, quha, comperand personallie, maid faithe that thay and everie ane of thame maid the executionis and indorsationis as the saidis summoundis and indorsationis thairof proportis and beris; and siclyke comperit personallie Maister James Fiddes, writtar, Johne Davidsoun, messinger, Alane Denyis, Adame Ra, Matthew Ra, Petre Galbrayth, tailyeour, and Johne Layng, tailyeour, witneses contenit in the saidis indorsationis respective, and maid faithe that thei wer present, hard and saw the executionis and indorsationis abonewrittin in maner and forme as the samyn beris; and thairefter the saidis haill personis being of new callit at the said tolbuithe window and nane of thame comperand, the said advocatt protestit that he may be hard to use forther probatioun aganis the saidis personis at sic tymis and place as plesis the kingis grace, his estatis and commissionaris of parliament, to proceid and do justice in this present current parliament, and thairupoun askit instrumentis.

Procedure: continuation of parliament; asking of instruments

The quhilk day the saidis lordis commissionaris of parliament abonewrittin, yit as of befoir, declaris this present parliament to rin, with all actionis of summoundis of treasoun, summoundis of reductioun and utheris causis quhatsumevir depending thairupoun, with all utheris concerning the kingis majesties affairis and traitment thairof, anent the weilfair of his hienes realme and liegeis, ay and quhill the samyn be dissolvit in speciall be his hienes estatis of this realme or commissionaris foirsaidis. Upoun the quhilkis procedingis the said Maister David MacGill, advocat to his hienes, askit instrumentis.
