Taxatioun of xxM lib.

Forsamekill as the kingis majestie, being cum at Goddis pleasour to this estaite and aige, and understanding the necessar occasionis urgeing him to have the ayde and support of his estaittis tuiching the outred and releif of sic debtis as hes bein contractit in the trublous tyme bipast of his hienes young aige, as alsua for making of sic chargis as wilbe requirit toward the preparatioun for his mareage and utheris his maist neidfull and wechtie effairis concerning his hienes honnour and weilfair, his majestie, having now convenit a gude nowmer of his estaittis for thair gude advise in the premisis, sa as his hienes mycht be anis relevit of bigane debtis and gude ordour tobe prescrivit for the honourabill intertenyment of his estait heireftir, the saidis estaittis presentlie assembled, efter mature deliberatioun heirupoun, willing to gif his majestie thair best advise in all thingis according to thair bound dewtie and to condiscend to the support of his necessar and honorabill effairis to the uttirmest of thair habilitie, finding that the chargis requisite heiranent cravis the presence of a greittar nowmer of the estaittis, hes thocht expedient, thairfoir, that the finall resolutioun and advise upoun his hienes present propositioun salbe differrit quhill the assembly of his hienes estaittis in his nixt parliament to hald and begin, Godwilling, in the tolbuith of Edinburgh upoun Furisday, the xxiiij day of October nixtocum, with continuatioun of dayis, or to a new conventioun of the estattis in greittar nowmer nor is presentlie assembled; and in respect of sic neidfull chargis as necessarlie ar tobe providit for in the menetyme, quhilkis may not gudely suffer delay, the saidis estaittis presentlie convenit hes willinglie grantit ane taxatioun of tuenty thowsand pundis to be upliftit and pait be the saidis estaittis, to be comptit and allowit in the first end of that soum that salbe condiscendit upoun be thame at the nixt parliament or conventioun: that is to say, ten jM lib. be the spirituall estait, provyding that the thrid thairof be tane of the thriddis of benefices, sa that sic as payis thair thriddis sall only be astrictit in payment of the tua pairt of the saidis ten jM lib. and the ministrie tobe frie, forsamekle of the saidis thriddis as is assignit to thame in thair stipendis, and samekill as hapynis tobe defalkit throu that occasioun to be eiket to the pairtes respective ordanit to be pait be the utheris estaittis; sex jM vjC lxvj lib. xiij s. iiij d. to be payit be the baronis and frehaldaris, togidder with the kingis propirtie; and thrie jM iijCxxxiij lib. vj s. viij d. in compleit payment of the said taxatioun of tuenty jM pund be the burrowis; and that at ane terme, viz., upoun the first day of August nixtocum. And for inbringing of the spirituall menis pairt of the said taxatioun, that lettres be direct chargeing all and sindrie bischoppis, abbottis and utheris beneficit personis contenit in the taxt roll, thair chalmerlanis or factouris, personalie or at thair duelling places, and failyeing thairof, be oppin proclamatioun at the principall paroche kirkis of the benefice upoun ane Sonday befoir none in tyme of devyne service and at the mercat croce of the heid burgh of the schyre quhair the benefice lyis, to mak payment of that sowme that thai and ilkane of thame ar stentit to to the officiar exour of the saidis lettrez at the terme abonespecifeit, under the pane of rebellioun and putting of thame to the horne; and gif thai failyie thairin, the said terme being bypast, to denunce thame incontinent thairefter rebellis and put thame to the horne and to escheit etc., and to charge the saidis officiaris to pay the same, or at the leist to deliver lettrez dewlie execuit and indorsat upoun the personis astrictit to pay the same to Alexander Clerk of Balbirny, provest of Edinburgh, collectour generall appointit to the said haill taxatioun, within the space of twenty dayis eftir the said terme under the said pane of rebellioun and putting of thame to the horne; and gif thai failye thairin, the saidis xx dayis being bipast, to denunce thame rebellis etc. and to escheitt etc.; and that the prelattis and beneficit men, for thair releif, have lettres to charge thair frehaldaris, fewaris, vassallis, subvassallis, ladyis of terce, conjunct fearis, lifrentaris and pensionaris to mak payment of thair pairtis of the said taxatioun pro rata within ten dayis nixt after thai be chargit thairto, under the pane of rebellioun and putting of thame to the horne; and gif thai failyie etc., to denunce thame rebellis etc. and to escheit etc., and gif neid be to poynd and distrenyie thairfoir. And for payment of the thrid of the spirituall mannis pairt of the said taxatioun ordanit tobe uptaking of the thriddis of beneficeis, that lettres be direct chargeing all and sindrie ministeris, redaris and utheris personis quhatsumevir, quhometo the saidis thriddis of benefices in haill or pairt is assignit or disponit unto in fie, pensioun, stipend, remittit, gevin frie or restand in the generall collectouris handis, or utheris intromettouris with the saidis thriddis quhatsumevir of the crop and yeir of God jM vC lxxxij yeiris, to mak payment of thair pairt of the said taxatioun according to the stent roll to be maid thairupoun at the said terme, to the officiaris, executoris of the saidis lettres, within xv dayis nixteftir thay be chargeit thairto, under the pane of rebellioun and putting of thame to the horne; and gif thai failyie thairin, the saidis xv dayis being bypast, to denunce thame rebellis etc. and to escheit etc., and that the like executioun pas aganis the saidis officiaris for payment of the sowmes to be ressavit be thame to the said collectour of the said taxatioun. And for the baronis and frehaldaris pairt and oure soverane lordis propirtie, that thair be upliftit of everie pund land of auld extent within this realme, sex schillingis viij d., for payment quhairof that lettres be direct chargeing all and sindrie schireffis, steuartis and baillies and the baillies, chalmerlanis, ressavaris, fewaris and intromettouris with or soverane lordis propirtie, that thai and ilkane of thame within the boundis of thair offices raise and uplift the said sowme of vj s. viij d. of everie pund land of auld extent and inbring and deliver the same to the said collectour generall at the terme abonewrittin, under the pane of rebellioun etc.; and gif thai failyie thairin, the said terme being bypast, to denunce thame rebellis etc. and to escheit, etc.; and for thair releif, that lettres be direct chargeing all and sindrie erllis, lordis, baronis and frehaldaris, fewaris, fermoraris, occupiaris and intromettouris with oure soverane lordis propirtie to mak payment and deliverance to the saidis schireffis, steuartis, baillies, chalmerlanis and ressaveris of his majesties propirtie, ilk ane of thame for thair awin pairt, of the said sowme of vj s. viij d. of every pund land of auld extent within xv dayis nixteftir thai be chargit thairto, under the pane of rebellioun and putting of thame to the horne; and gif thai failyie etc., to denunce thame rebellis etc. and to escheit etc., or ellis that the shereffis, stewartis, and baillies poynd and distrenyie thairfoir as thai sall think expedient, and the saidis erllis, lordis, baronis and frehaldaris have siclike lettrez for thair releif aganis ladiis of terce, lifrentaris conjunctfearis and subvassallis. And for inbringing of the burrowis pairt, that lettres be direct chargeing the provest and baillies of ilk burgh to mak payment of the taxt and extent thairof to the said collectour generall at the terme abonespecifeit, under the pane of rebellioun and putting of thame to the horne; and gif thai failyie thairin, the said terme being bipast, to denunce thame rebellis etc. and to escheit etc.; and for thair releif, that lettrez be direct chargeing all and sindrie the inhabitantis of ilk burgh to convene and elect certane personis to stent thair nychtbouris and to command the personis electit to accept the charge upoun thame in setting the said rent upoun the inhabitantis of ilk burgh, and to convene and sett the samin and mak ane stent roll thairupoun as effeiris, within xxiiij houris nixteftir thai be chargit thairto, under the pane of rebellioun etc; and gif thai failyie etc., to denunce etc. and to escheit etc.; and siclike the said extent roll being maid and sett as said is, to charge the burgeses, nychtbouris and inhabitantis of ilk burgh to mak payment of thair pairt of the said extent to the saidis provest and baillies, conforme to the said taxt roll to be maid and gevin out thairupoun, within the space of thrie dayis nixteftir the charge, under the pane of rebellioun etc.; and gif thai failyie thairin, the saidis thrie dayis being bipast, to denunce etc. and to escheit etc.; and, gif neid be, that the saidis provest and baillies poynd and distrenyie thairfoir as thai sall think maist expedient. Attoure, the kingis majestie hes promittit and promittis that he sall not gif discharge to ony persoun or personis subject to the payment of ony pain of the said taxatioun, lyke as it is presentlie concludit be his majestie and the saidis estaittis that gif his hienes happin to gif ony sic discharge, that in that caice nane uther salbe haldin nor astrictit to mak further payment of thair pairtis of the said taxatioun, bot tobe simpliter discharget thairof, as gif the same taxatioun had nevir bein grantit. Alsua the kingis majestie, with avise of the saidis estaittis, requiris the lordis of counsale and sessioun to grant na suspensioun to ony personis chargit for payment of the said taxt, bot that thai remit the cravaris of the saidis suspensionis to seik the samin befoir the lordis of his hienes privie counsall, and thair, nane to have the saidis suspensionis grantit quhill thai consignne the sowmes chargit for, to remane consignit quhill the decisioun of thair complaint as accordis. Be it alwayis understand that the saidis lordis of counsall and sessioun, under prelaciis and the kirkis and rentis foundit to collegeis for upbringing of the youth in the study of gude lettres, ar heirby exemit frome all payment of thair pairtis of the said taxatioun.
