Oure soverane lord, with avise and consent of the thrie estatis of this present parliament, ratefeis, apprevis and confermis the act of pacificatioun under writtin, maid, gevin and grantit to Alexander, lord Home, sone lawfull and air apperant to umquhile Alexander, lord Home, that last decessit, of the quhilk the tennour followis:
In the parliament haldin at the castell of Striveling, within the great hall thairof, upoun the xxv day of Julii, the yeir of God jM vC lxxviij yeris, oure soverane lord, with advise and consent of the thrie estatis of this present parliament, for diverse considerationis moving thame tending to the quietnes of this realme, have gevin and grantit and, be the tennour of this present act, gevis and grantis to Alexander, lord Home, sone lawfull and apperant air to umquhill Alexander, lord Home, quha last decessit, the elyk favour, grace and the benefite of pacificatioun maid at Perthe upoun the xxiij day of Februare, the yeir of God jM vC lxxij yeiris, and ratefeit and apprevit in his hienes parliament haldin at Edinburgh in the moneth of Aprill nixt thairefter in the yeir of God jM vC lxxiij yeris, and willis the samyn be als amplie extendit in his favouris in all respectis, conditionis, clause and circumstanceis thairof as the said umquhill Alexander, lord Home, had bene expreslie comprehendit and contenit thairintill. As alsua his hienes, with avise foirsaid, willis and grantis that the said pacificatioun be maist amplie interprete and extendit to him in all clausis thairof as said is, and speciallie that this present act of parliament, according to the said pacificatioun, be sufficient to rescind and retrait, likas oure said soverane lord and estatis foirsaidis, be thir presentis, retractis and rescindis the proces of foirfalture led aganis the said umquhill Alexander, lord Home, for certane crymis and treasoun and lesemajestie committit be him, and to restoir and redintegrat as his hienes, with avise foirsaid, restoris and redintegratis the said Alexander, lord Home, sone and apparent air foirsaid, aganis the samyn, siclyke and als frelie in all respectis as gif the said proces of foirfalture had nevir bene led and dome of foirfalture had nevir bene gevin, efter the forme and tennour of the said pacificatioun, quhilk, and everie claus thairof, is heirin haldin pro expresso, and ordinis this present act to be extendit in competent and dew form as effeiris, restoring fullelie the memorie, honour and fame of the said umquhile Alexander Home in the persoun of the said Alexander Home, his sone and air apperant, lyke as our soverane lord and thrie estatis of parliament rehabilitatis and restoris the said Alexander thairto, and findis and declaris him hable to enter and succeid as air of the said umquhill Alexander, lord Home, be brevis of our soverane lordis chapell and utherwayis, to all landis, heretageis, possessionis, rowmis, takis, offices and utheris to the quhilkis the said umquhill Alexander, lord Home, had richt, notwithstanding the said proces of foirfalture or ony uther thing following thairupoun, providing alwayis that oure soverane lord be on nawayis prejugeit of the waird and mariage of the said Alexander, nor of the haill proffitis and comoditeis thairof, and siclike that all the provisionis of benefices, personageis, vicareis, chaiplanreis and prebendareis pertening to the said Lord Homis presentatioun and providit be our soverane lord and regent to quhatsumevir personis sen the leding of the said foirfalture of the said umquhile Alexander, lord Home, stand to the present possessouris thairof in full forme, force, strenth and effect; notwithstanding this present restitutioun and benefite, providing alwayis that incace the said umquhill lordis father be culpable of the murthouris of our soverane lordis umquhill fader and tua regentis that than and in that cace the benefit of this present act and restitutioun, now as than and than as now, to have bene of nane availl, force nor effect in all pointis, clausis and articles specefeit thairintill, efter the forme and tennour thairof (exceptand that pairt and claus thairof berand this provisioun: that all the provisionis of benefices, personageis, vicareis, chaiplanreis and prebendareis pertening to the said Lord Homis presentatioun and providit be our soverane lord and his hienes regent to quhatsmuevir personis sen the leading of the said foirfalture of the said umquhile Alexander, lord Home, stand to the present possessouris thairof in full forme, force and effect, notwithstanding the said restitutioun and benefite), quhilk claus our said soverane lord, with avise of his saidis thrie estatis of this present parliament, decernis and declaris to be secludit and not to be comprehendit in the said ratificatioun abone expremit, siclike and in the samyn maner as gif the samyn wer left out thairof, sua that the said Alexander, now lord Home, may bruik and jois and off new grant, gif and dispone all provisionis of benefices, personageis, vicaregeis, chaiplanreis and prebendareis pertening to his said umquhile fatheris presentatioun and providit be oure said soverane lord and his regent to quhatsumevir personis sen the leading of the said foirfalture upoun the said umquhile Alexander, lord Home, notwithstanding the said claus and provisioun contenit in the said ratificatioun of the dait abonewrittin, siclike and in the samyn maner as the said provisioun had not bene contenit thairintill.

And for his better securitie, our said soverane lord, with avise foirsaid, hes ratefeit and apprevit and, be the tennour heiroff, ratefeis and apprevis the foirsaid pacificatioun gevin and grantit to the said Patrik Thonsoun in maner abonewrittin, in all pointis, efter the forme and tennour thairof, and declaris the samyn to have full strenthe, force and effect in tyme cumming and extendis the samyn pacificatioun to him in all respectis as the samyn is extendit to ony uther persoun of befoir, obtenare of the like, providing alwayis that the samyn extend not to the murthouris of our soverane lord and tua regentis the Erllis of Murray and Lennox, nor to the crymis of wichecraft and incest, bot be thir presentis speciallie and expreslie exceptis the samyn. And forder, our said soverane lord, with advise foirsaid, decernis and declaris that, notwithstanding of the said benefite of pacificatioun grantit and presentlie confermit be his hienes to the said Patrik, yit the samyn sall tak na forder effect nor executioun for entering or repossessing of the said Patrik to the hous and tenement of land liand within the burgh of Edinburgh quhilk pertenit to his umquhill fader and now possessit be Jonet Adamesoun, relict of umquhill Maister James McGill of Rankelour Nethir, clerk of register, nor salbe contenit in the decreit arbitrall to be pronunceit thairanent be James Adamesoun, James Ross and Alexander Wduart, burgesis of Edinburgh, chosin for the pairt of the said Jonet and Maister James MackGill, now of Rankelour Nethir, his sone, and Robert Ker, youngar, Henrie Chartour, burges of the said burgh, and Maister Johne Kene, writter, chosin for the part of the said Patrik, and of Schir Robert Malvill of Murdocarny, knycht, as odman and ourisman to quhom it is presentlie submittit. And to the effect the said decreit salbe pronunceit and that baith the parteis may be the mair diligent to caus thair arbitratouris convene to that effect upoun the awcht day of December nixtocum in the kirk of Edinburgh, it is statute and ordinit that gif the defalt of the convening of the saidis arbitratouris be in defalt of the said Patrik, he sall tyne the benefite of the foirsaid pacificatioun sa far, as it may be extendit to his restitutioun to the said tenement; and incace it be in defalt of the saidis Jonet and Maister James, hir sone, in that cace the said Patrikis restitutioun salbe full and absolute in his favour without respect of thair satisfactioun; and ordinis lettres to be direct heirupoun, gif neid beis, in forme as effeiris.

And for his better securitie, our said soverane lord, with advise foirsaid, hes ratefeit and apprevit and, be the tennour heirof, ratefeis and apprevis the foirsaid pacificatioun gevin and grantit to the said Adame MacCulloche in maner abonewrittin, in all pointis, efter the forme and tennour thairof, and declaris the samyn to have full strenthe, force and effect in tyme cumming, and extendis the samyn pacificatioun to him as the samyn is extendit to ony uther persoun of befoir obtenar of the like, providing alwayis that the samyn be not extendit to the murthouris of our soverane lordis father and tua regentis, nor to the crymis of wichecraft and incest, bot be thir presentis speciallie and expreslie exceptis the samyn; and also providing that the geving of this present pacificatioun and confirmatioun thairof on na wayis hurt nor prejudge Gilbert Guthrie, now Merchemont herauld, anent the bruiking of the office thairof during his lyftyme, conforme to the said Adame McCullochis renunciatioun and discharge following, subscrivit with his hand, of the quhilk the tennour followis:
I, Adame Macculloch, sumtyme Merchemont herauld, now Orknay herauld, be the tennour heirof, is content and consentis that in the pacificatioun to be grantit to me be our soverane lord at this present parliament thair salbe speciallie reservit and exceptit the office of Merchemont herauld, quhilk wes disponit be my foirfalture in the lait trubillis to Gilbert Guthrie, now Merchemont herauld, during all the dayis of his lyftyme, bot prejudice of the rest of the benefits of the said pacificatioun and of the first ordinar place to be gevin to me that sall happin to vaik; renunceand and dischargeand all rycht, titill, interes and kyndnes quhilk I have, or may have, to the said office of Merchemont herauld during the said Gilbertis lyftyme in his favouris be thir presentis.
