Ratificatioun and confirmatioun of the faire of Dalkeith

Oure soverane lord and thrie estaitis of this present parliament, understanding that the mercat day of the toun and burgh of Dalkeithe hes bene haldin ouklie in tymes bygane, past memor of man, one the Sonday, quhilk is the Sabboth day, and now becaus of the reformatioun of the religioun the people resorting thairto stoppis gretumlie the hering of the word of God, thairfore, our said soverane lord, with avise foirsaid, hes alterit and changeit the said mercatt day of the said toun and burgh of Dalkeyth fra the Sonday to be haldin ouklie in tyme cumming on the Thurisday, and for supporting of the said toun and inhabitantis thairof, have affixit, assignit and grantit ane fair yeirlie to be haldin in the said burgh upoun the tent day of October in all tymes cumming, with all fredomes, privilegeis and commodities siclike and als frielie as ony fair day is grauntit to ony burgh of baronie within this realme; and also decernis and declaris that it salbe lesum to all our soverane lordis liegeis reparing and resorting to the House of Mure with scheip, nolt or uther guidis on Thurisday, to bring the guiddis that sall remane unsauld the said day thairefter on Fryday to the said burgh of Dalkeith, thair to be sawld for furnissing of our soverane lordis liegeis, in respect of our soverane lordis liegeis awin reparing and resorting thairat; and ordinis lettres of publicatioun to be direct heirupoun in forme as effeiris.

Oure soverane lord, with avise of the thrie estaitis of this present parliament, ratefeis and apprevis the infeftment maid be our soverane lordis maist noble predicessour of worthie memorie, King James the Thrid, efter his perfite aige, of the infeftment of the toun of Myretoun pertening to Johnne Kennedy, now of Blairquan, and to his predicessouris, lyand within the schirefdome of Wigtoun, erectand the said toun in ane frie burgh of barony, and dotand the same with privilegeis as ony uther frie burgh in baronie joisit within this realme conforme to his said infeftment grantit to his predicessouris thairof, and efter the forme and tennour of the samyn in all pointis; of the quhilk the tennour followis:

Jacobus Dei gratia rex Scotorum omnibus suis ad quos presentes litere pervenerint salutem. Sciatis quod propter gratuita servicia per dilectum et fidelem nostrum Johannem Kennedy de Blairquhan nobis impensa in captione et importatione certorum rebellium nostrorum ad cornu nostrum existentium fecimus et infeodavimus, ac tenore presentium facimus et infeodamus, villam de Myretoun dicto Joanni pertinentem jacentem infra vicecomitatum nostrum de Wigtoun liberum burgum in baronia pro perpetuo. Concessimus etiam ac tenore presentium concedimus dictum burgum inhabitantibus et in posterum inhabitaturis plenam et liberam potestatem ad emendum in ipso burgo ceram, vinum, pannum latum, strictum, linium et laneum ac omnia alia quecunque bona et mercimonia illuc advenientia, cum potestate et libertate habendi et tenendi in eodem burgo pistores brasiatores, carnifices tam carnium quam piscium ac artium quarumcunque operarios ad libertatem burgi in baronia spectantes seu spectare valentes quomodolibet in futurum. Concessimus tenoreque presentium etiam concedimus burgensibus et inhabitantibus dictum burgum de Myretoun ut in ipso burgo habeant teneant et possideant crucem ac forum pro perpetuo singulis ebdomadis die Saboti, et nundinas publicas quolibet anno imperpetuum in vigilia Sancti Petri in estate cum tholoneis ac omnibus aliis libertatibus ac privilegiis ad huiusmodi nundinas spectantibus seu spectare valentibus in futurum; tenendam et habendam prefatam villam de Myretoun perpetuis futuris temporibus in merum et liberum burgum in baronia cum predictis privilegiis libertatibus ac concessionibus ac universis aliis libertatibus proficuis commoditatibus asiamentis ac justis pertinentibus quibuscunque tam non nominatis quam nominatis ad burgum in baronia spectantibus seu juste spectare valentibus in futurum, et adeo libere quiete plenarie integre honorifice bene et in pace in omnibus et per omnia sicut aliquis burgus in baronia in regno nostro quibuscunque retroactis temporibus infeodatur seu tenetur, et in revocatione quacunque futuris temporibus inde facienda, strictius inhibendo ne quis in contrarium premissorum aliqualiter devenire presumat sub omni pena que competere poterit in hac parte. Oure soverane lord, with avise of the estatis of this present parliament, hes ratefeit, apprevit and confermit and, be the tennour of the said act, ratefeis, apprevis and confermis the charter and infeftment grantit be his hienes darrest mother under his great seall, makand, constituand and confirmand the toun of Portsoy in frie burgh in baronie, off the quhilk chartour the tennour followis:

Oure soverane lord and thrie estaitis of this present parliament, understanding the complaint gevin in be the provest, bailleis, counsell and communitie of the burgh of Striveling that thair hes bene twa dayis grantit to thame for haldin of fairis yeirlie this lang tyme bipast in the moneth of September, viz., the ane being the Letter Ladie Day the aucht day thairof, and the uther the Ruid Day, being the fourtene day of the samin moneth, being bayth within sevin dayis efter utheris, and swa being so neir togidder and in tyme of harvest, sua that the samin hes nawayis bene proffitabill to the said burgh nor nawayis can serve to thair commoditie in tyme cuming, quhan na resort of pepill cumis thairto; thairfoir oure said soverane lord, with avise foirsaid, hes alterit and changit the said fair haldin of befoir yeirlie within the said burgh and fredome thairof upoun the said xiiij day of September, to be haldin in all tymes cuming upoun the xxij day of October yeirlie thairefter, and the first fair usit of befoir upoun the said viij day of September to stand and be usit in the same sort and maner as the samin wes of befoir; and ordanis lettres to be directit to mak publicatioun heirof in forme as effeiris at all places neidfull.

Oure soverane lord and thrie estaitis of this present parliament, understanding that the burgh of Uchtirardour is of auld erectit in ane frie burgh regall and that the samin is far distant fra the sey portis and hes not usit fairis nor mercat dayis, the samin is becumin decayit and the inhabitantis thairof pure sua that thai ar not abill to intertene the civill ordour of ane frie burgh nor yit execute sic justice as thay micht in the cuntrie about, being oppressit diverse tymes be brokin men and lymmeris quha makis incursiones and hereis mony cuntrey men and manassis oftymes the inhabitantis of the said toun and burgh; and thairfoir oure said soverane lord, with avise foirsaid, for help of the commoun welth of the said burgh and support of the inhabitantis thairof, hes gevin and grantit, lyk as his hienes, with avise foirsaidis, gevis and grantis licence, fredome and libertie to the provest, bailleis, inhabitantis and communitie of the said burgh of Uchtirardour to hald yearlie ane frie fair and mercat day upoun the xxv day of November, beginnand the samin upoun the xxv day of November nixtocum, and to continew yeirlie thairefter in all tymes cuming, declarand expreslie be thir presentis that all oure soverane lordis liegeis may resort and repair thairto for bying and selling of all guidis and merchandice thairintill, quhairby the polacie of the said burgh may the better incres and that the liegeis also may haif the better eisment and intertenyment for decoratioun of the realme; and ordanis lettres of publicatioun to be direct heirupoun in forme as effeiris.

Oure soverane lord, with avise of the thrie estaitis of this present parliament, being informit be the barones, gentilmen and utheris inhabitantis of the boundis of Glen Ilay, Mar and Bra of Angus, and utheris partis adjacent thairto, and that the haill liegeis duelland within the saidis boundis hes bene and ar accustumat to resort and repair at diverse and sindrie tymes of the yeir to the toun of Brigend in Glentrathin for bying and selling of cornis, nolt, scheip and sic uther necessar geir as is frequentit to be sauld and cost within the mercattis within the burrowis of this realme, be the quhilkis thay report alsmekill commoditie as ony utheris his hienes liegeis, be ressoun the said toun of Brigend lyis in the middis of the cuntrie and is maist commodeous and ewest to the haill inhabitantis of Badyenochis, Bray of Angus, Mar, Straspay and utheris pairtis thairabout, disyring thairfoir ane frie fair to be prescrivit, appointit and assignit anis in the yeir at the said place; quhairfoir oure said soverane lord, with avise of the saidis thrie estaitis of this present parliament, hes prescrivit, appointit and assignit the ellewint day of November yeirlie to be the fair day of the said toun of Brigend, sua that oure soverane lordis liegeis may resort and repair thairto for bying and selling of all guidis, merchandice and utheris; and ordanis lettres to be direct heirupoun for publicatioun to be maid in the saidis boundis in forme as effeiris.

Oure soverane lord, with avise of his thrie estaitis convenit in this present parliament, ratefiis and apprevis and, for his hienes and his successouris, perpetuallie confermis the prevelege and libertie grantit be his hienes to his lovitt Robert Diksoun, upoun his offer to bring in and to learne within this realme the airte of the making and working of silkis, to be als gude and sufficient as the samin is maid within the countreis of France or Flanderis and to be sauld within the same better chaip nor the lyk silkis ar sauld within this realme brocht heir or out of uther cuntreis, quhairupoun the said Robert mon bestow grite sowmes of money, quhilk salbe the occasioun that ane grite nowmer of young and pure pepill salbe virteouslie and honestlie sustenit be that occupatioun, and thairfoir gevand and grantand to the said Robert power, prevelege and libertie to use and exerce the said airt be him selff and his servandis and utheris in his name, be the space of threttie yeiris nixttocum, discharging all utheris during the said space to use or exerce the said airte without his leiff and guidwill first had and obtenit thairto; and that the raw and unwrocht silkis to be brocht hame be him salbe custome frie, with the dreggis for litting thairof, him selff to be maid frie burges and gild in Perth or sic uther places quhair he sall pleis to plaint without payment of sowmes of money thairfoir, and he and his servandis to be frie of warding, taxationis, impositionis and to transport the silkis wrocht be him custome frie, as in his said prevelege at mair lenth salbe contenit, providing that he enter to his work within yeir and day eftir the dait heiroff, with ane hundreth servandis, and continew in the said work thairefter, certefeing him and he do in the contrair, he sall tyne his prevelege.

Jacobus Dei gratia rex Scotorum omnibus probis hominibus suis ad quos presentes litere pervenerint salutem. Sciatis, cum animadverteret charissima nostra mater post instauratam religionem et officialitates atque ecclesiales jurisdictiones in hoc nostro regno abrogatas, subditis suis nullum patere aditum ad judices ordinarios qui testamenta confirmarent et de spiritualibus causis cognoscerent, ex sua dominorumque secreti consilii sententia in officialitatum abrogatarum vicem jurisdictiones commissariatuum in hoc regno suffecit et surrogavit, que res insigni fuit subditis commodo et emolumento quoniam vero in prima dictorum commissariatuum erectione homines quidam ad hec munera inepti et inutiles celsitudinem eius fraudibus et astu circumvenientes commissariatuum eorumue scribarum officia impetrarunt cum potestate maiora testamenta confirmandi que solis Edinburgi commissariis erant reservata, cum venia etiam et immunitate a reddendis rationibus quotarum partium ex testamentis que in supplementum stipendiorum destinate fuerunt dominis consilii, unde ordo per eius celsitudinem preclare institutus conturbatus est justicia depravata et frustrati stipendiis suis domini sessionis. Ea propter nos ex sententia dominorum secreti nostri consilii non modo probamus ratam habemus et confirmamus superiorem commissionem e charissimis nostris parentibus concessam senatoribus collegii justicie pariterque omnia que inde promanarunt et consequuta sunt aut post modum consequi possunt, sed hoc amplius denuo concedimus demittimus et indulgemus predictis cancellario presidi eorumque collegis, id est toti qui nunc est senatui quiue in posterum est futurus plenam et integram nostram potestatem authoritatem et mandatum speciale universos regni nostri commissarios eorumque scribas et alios jurisdicendi ministros ad se accersendi et convocandi ut proferant et exhibeant officiorum suorum provisiones et donationes e senatu visendas et explorandas que si aut illis ad omnem vite cursum fuerunt concesse aut etiam eorum liberis amicis aliisque in eorum vicem successuris, protinus ex sententia dicti senatus aboleantur abrogentur et irrite habeantur. Simili modo dictis senatoribus volumus permittimus et precipimus ut commissariatuum huius regni jurisdictionibus diligenti examine observatis et exploratis earum limites atque oras diminuant adaugeant immutent atque distinguant ut e re populi videbitur presertim ut commissariatus novos erigant atque instituant in urbibus cuiusque provincie vicecomitatus vel dioceseos primariis et celeberrimis, saltem quas ad eam rem aptas esse atque idoneas animadverterent, jurisdictionis autem cuiusque fines discriminent ac dimetiantur finibus ipsius vicecomitatus aliisue ad suum arbitrium tractibus et spatiis prout incolarum et locorum natura exigit atque invitat. Cui etiam precepimus ut omnes commissiones et donationes munerum in commissariatibus si que concesse sunt ad universum vite spatium aut etiam in gratiam posterorum aut substitutorum aut alia quavis ratione quam rogatu et presentatione dominorum consilii abroget evertat et invalidas irritasque denuntiet imperpetuum ac proinde commissarii omnes eorumque scribe ac ministri presentationes impetrent et commissiones novas duraturas quamdiu dumtaxat senatus voluerit et eorum administrationem probaverit, denique imminuet extendat immutet ac distinguat senatus jurisdictionum fines adeoque sedes ipsas commissariatuum ut ex sententia dominorum consilii conducere atque expedire videbitur ad populi utilitatem et justitie in hoc regno conservationem, perinde ut nobis ad reddendam harum rerum rationem parati esse velint, nos vero facturos precepimus et pollicemur ut hec nostra commissio collegio justicie concessa probetur confirmetur rataque habeatur primi nostri dehinc parliamenti authoritate. Oure soverane lord, with avise and consent of the thrie estaitis convenit in this present parliament, ratefiis and apprevis the heritable infeftment of fewferme maid to Capitane Thomas Crawfurd of Jordanhill be Maister Archibald Dowglas, sumtyme persoun of Glasgw, with consent of the dene, channonis and chaptour of the metrapolitane kirk thairof, of all and haill the ludgeing and mans, with the yaird thairof pertening to the said personage, lyand within the cietie of Glasgow of the dait the xx day of October, the yeir of God jM vC lxxi yeiris, togidder with the confirmatioun of oure soverane lord past upoun his charter and infeftment under his hienes grite seill, of the dait the xxj day of Maii, the yeir of God jM vC lxxij yeiris, in all pointis, pass, clausis and articlis specefiit thairintill, sua that the said Capitane Thomas may peciablie bruik and joyis the said ludgeing and mans, with the yaird thairof, siclyk and als lawchfullie and frelie as gif the said Maister Archibald had na wyis bene declarit culpabill of the cryme above writtin, notwithstanding quhatsumevir actis of parliamentis, quhairanent, in this cais, his hienes, with avise of his saidis estaitis, dispens for evir.
