The erectioun of the landis of Doun in ane lordschip

Oure soverane lord, understanding that his hienes darrest mother in hir perfyte aige, with advise of the thrie estatis of hir parliament, gaif, grantit and in fewferme heretablie lent to his rycht traist cousing and counsalour Schir James Stewart of Downe, knycht, his aires and successoures specefeit in the chartour and infeftment of fewferme maid thairupoun, all and syndrie the landis underwrittin, with mylnis, multures, fischingis, pairtis, pendicles, tennentis, tenandreis and service of frie tennentis of the samyn: thay ar to say, all and haill the manis [of] Doun callit Drumcampsie and Bailekeroch, the Kerse of Cambis, the Bray and Miltoun of Cambis, the Parktoun, Ballmoreist, Calyeballquhalye, Caldhame, Westir Ardatie, with the mylne and cruifis of Downe, the Eistir Frew, the Myddle Frew, the Warde of Guddie, Murdochis toun, Ballindronoch, Blairgairie, Cultintegill, the xx s. land of Cambisbeg, the Westir Brigend, Dowart, Auchinhard, Grodich, the park of Doun, the keping of the castell of Doun and forrest of Glenfinglas, and all utheris parkis and walteris within the stewartrie of Menteith, sett to the said Schir James and his foirsaidis in few, with the fischeing in the river of Taith, Lochbannach, Luknach, annexis, connexis and pertinentis thairof foirsaidis all lyand within the stewartrie of Menteith, togidder with the office of the said stewartrie, as the said infeftment in the self at lenth proportis; quhilk chartour and infeftment foirsaid, haill pointis, articles and clausis thairin contenit, oure said soverane lord, with advise of the thrie estatis of this present parliament, ratefeis, apprewis and, for his hienes and his successoures, perpetuallie confermis, salffand to oure said soverane lord and his successoures the fewferme dewteis specefeit and contenit in the said Schir James infeftment of fewferme foirsaid aucht to oure said soverane lord and his predicessoures of before the said ratificatioun. Attour, oure said soverane lord for the gude, trew and thankfull service done be the said Sir James to his hienes self, his darrest mother and umquhile guddame, and to gif him the bettir occasioun to continew and perseweir thairin, and understanding it maist equitable that the advocatioun, donatioun and rycht of patronage of the cheplanrie of Sanct Phillane, situatit within the said castell of Doun, and [the chepell of] the cheplanrie of Sanct-Phillane, situatit without the samyn, be conferrit in the persone of the said Schir James and his foirsaidis heretable fewfermoraris of the foirsaidis landis, thairfore oure said soverane lord, with advise of the thrie estatis of this present parliament and be the tennour of this present act, gevis, grantis, disponis and confermis to the said Schir James, his aires and successoures foirsaidis, the advocatioun and donatioun of the said cheplanrie of Sanctphillane, situatit within the said castell, the chepell of the said cheplanrie of Sanctphillane, situatit without the samyn, and all and syndrie landis, hows, dewteis and annuelrentis pertening and belonging thairto, advocatioun, donatioun and rycht of patronage and all utheris kirkis, benefices and cheplanreis, tennentis, tenandreis and service of frie tennentis of the samyn, annexis, connexis, pairtis and pendicles thairof foirsaidis. Mairower, oure said soverane lord, hewand respect that the said Sir James is discendit of his awin blude, and being of gude will and mynd that he be promowit to sic honour and dignetie as he hes mereit, hes erectit, creat, uneit, annext and incorporat, lyke as his hienes, be this present act, with advise foirsaid, erectis, creatis, unetis, ann[...]tis and incorporatis all and syndrie the foirsaidis landis, offices and utheris particularie abonewrittin, advocatioun, donatioun and rycht of patronage of the said cheplanrie and of all utheris kirkis, benefices and cheplanreis, annexis, connexis, pairtis, pendicles, pertinentis, tennentis, tenandreis, service of frie tennentis of the samyn foirsaidis, in ane lordschip to be callit in all tyme cumming heireftir the lordschip of Doun, decernand and ordenand the said Sir James, his aires and successoures specefeit in the said infeftment, in all tymes cumming to be callit and intitulat lordis of Doun, quha sall have the honour, dignetie, place and preheminence of ane lord of oure soverane lordis parliament, in all parliamentis, essembleis and utheris conventiones, with his airmes efferand thairto, and gevand unto him all honouris, digneteis, preeminencis, quhilkis pertenit, or of rycht and consuetude, aucht to pertene to ane lord of parliament, but prejudice alwayes of the dewteis contenit in the said Sir James infeftment awand to oure said soverane lord, and alswa but prejudice to the said Schir James, his aires and successoures of the assignatioun, of ane part of the saidis dewteis for keping of the said castell, quhilkis, notwithstanding the premis, sall stand in the awin force and strenth, ordinand and constituand the castell of Doun foirsaid the principall messuage and cheifschimmeis of the said lordschip. And for the caus foirsaid, oure said soverane lord will and grantis and, for his hienes and his successouris, siclyk decernis and ordanis that ane seasing to be gevin be the said lord of Doun at the said castell of Doun and be his aires thairat in tyme cumming sall stand, extend and be sufficient seasing for all and syndrie the foirsaidis landis, mylnis, woddis, fischeingis, advocatioun, donatioun and rycht of patronage of the said cheplanrie of Sanct Phillane, situatit within the said castell and without the samyn, and all and syndrie landis, howsis, dewteis and annuelrentis pertening and belonging thairto, advocatioun, donatioun and rycht of patronage of all uther kirkis, benefices, cheplanreis and utheris foirsaidis now uneit, erectit and incorporat in the said lordschip of Doun, notwithstanding that the samyn not contigue, anent the quhilkis oure said soverane lord, with advise foirsaid, be the tennour of this present act, dispens for evir be thir presentis, and ordanes lettres of publicatioun to be direct heirupoun, gif neid beis, in forme as efferis.
