Act for remitting of the mater betuix Johnne Gilbert and Robert Gray, burgess of Edinburgh, to the lordis of sessioun

Anent the supplicatioun gevin in be Johnne Gilbert, goldsmyth, burges of Edinburgh, makand mentioun that quhair in the parliament haldin at Striveling Castell upoun the xxv day of Julii, the yeir of God jM vC lxxviij yeiris, thair wes ane act maid remittand the caus persewit at his instance befoir the lordis of counsale aganis Robert Gray, burges of the said burgh, his wyf and bairnis, to the lordis appointit for viseing of the lawis, and be the said act the saidis lordis of sessioun dischairget of all proceiding in the said mater, as the said act at mair lenth proportis. Sen the making of the quhilk act, the said Johnne finding him self dilayit of proces and justice, meanit him to the lordis of secreit counsale of new in Striveling and then ressavit thair deliverance, ordaning him to meane him to the saidis lordis, visitouris of the lawis, at thair convening in Sanctandrois as the said deliverance thairof in lykwise beris; and according thairto, the said Johnne meanit him of new to the saidis lordis and visitouris of the lawis at thair last conventioun in Sanctandrois, quha haveing considerit the haill estate of the caus and how the said mater wes remittit to thame to tak triell thairintill, and they, undirstanding that the mater wes proceidit to probatioun and solistatioun maid thairin befoir the lordis of sessioun lang befoir the making of the said act of parliament, fand and declarit that they could not mell with the said mater and that the saidis lordis of sessioun sould proceid and minister justice thairin quhair they left, in respect that litis contestatioun wes maid thairin befoir thame of befoir as said is, as the act and ordinance of the saidis visitouris of the lawis of the dait at Sanctandrois, the xxiij day of Aprile, the yeir of God jM vC lxxix yeiris, inlikemaner at mair lenth proportis. Quhilkis the haill actis and ordinances abone writtin, being sene and considerit first be the lordis of articles and thairefter be the kingis majestie and thrie estaitis, oure said soverane lord, with avise of his three estaitis of this present parliament, hes remittit and remittis the foirsaid mater persewit be the said Johnne Gilbert aganis the said Robert Gray and his colligis agane to the saidis lordis of sessioun, quhair the samyn tuik first begynning, and ordanis thame to proceid and do justice thairintill quhair it left befoir thame to the finall end and decisioun thairof as they will answer to the kingis majestie upoun the executioun of thair offices, notwithstanding the said act and ordinance maid at Striveling upoun the said xxv day of Julii, the yeir of God jM vC lxxviij yeiris foirsaid, and ordanis lettres to be directit heirupoun, gif neid beis, in forme as effeiris.
