The kingis majestie, with avise and consent of the thrie estaitis of this present parliament, ratifeis, apprevis, confirmis and allowis the act of revocatioun maid be his hienes, with avise of the lordis of his secreit counsale, at Striveling, upoun the tent day of August last bipast, of all giftis, feis and dispositionis out of his majesties propertie, casualitie, thriddis of benefices or collectorie in pensioun or frielie dischairget, gevin be his hienes, with avise of his regentis for the tyme, or be him self sen the acceptatioun of the governament in his awin persone; and als, be the tennour heirof, revoikis the saidis giftis, feis and dispositionis sua that the samyne revocatioun may be of full strenth, force and effect in tyme cumming, efter the dait heirof, with the exceptionis specifiit thairin, of the quhilkis revocationis and exceptionis, the tennoure followis:
At the castell of Striveling, the tent day of August, the yeir of God jM vC lxxix yeiris, the kingis majestie and lordis of his hienes secreit counsale, considering the present estate of his hienes propirtie and casualitie, sa fer hurt and diminyshit throw the dispositionis thairof in pensionis and utherwise that neither can the chairges of the expensis of his hienes housis nor utheris, the necessar affairis of his estate and croun, be sustenit in tyme cummyng (howbeit the occasioun of the chairges and expensis daylie incresis) without sum present help and gude provisioun; as alsua calling to mynd how the thriddis of benefices within this realme wer first assumit and uptakin for the sustentatioun of the ministrie and to support the prince to interteny and sett furthward the commoun affairis of the cuntrie, and thairefter be act of parliament it wes providit that the haill thriddis of the haill benefices within this realme sould be first pait to the ministeris of the evangell and thair successouris, providing alwayis that the collectouris of the saidis ministeris sould mak yeirlie compt in the chekker of thair intromissioun, sua that the ministeris, being first pait of thair stipendis appertenyng to every ane of thame, the rest and superplus sould be employed to oure soverane lordis use; quhilk ordour continewit quhill certane abuses and corruptionis being considerit and espyed in the collectoris for the tyme, upoun the sute of the saidis ministeris, certane assignationes wes maid unto thame of thair leavingis and stipendis in the place maist ewest and commodious to thair residence, it being alwayis meanit and intendit that quhen God sould raise up ma qualifiit personis and godlie ministeris they sould be plantit in the places found maist convenient for thame and competent and sufficient levingis and stipendis modifiit, appointit and assignit to thame, and quhatever sould be assignit in the saidis stipendis, that the collectour generall of the superplus sould alluterlie desist fra further craving intromissioun or uptaking of the same of ony termes efter the said assignatioun; and albeit the superplus of the saidis thriddis attour the ordiner assignationis of the stipendis of the ministerie, contenit in the yeirlie buik of modificatioun, aucht to serve for the stipendis of sic qualifiit personis as God sall raise up from tyme to tyme, worthie to be admittit in the functioun of the ministrie, and to support the prince, to interteny and sett furthwart the publict affairis of the cuntrie, nevirtheles, throw the inoportune sute of sindrie personis mair respecting thair awin particular proffeitt then either the sustentatioun of the ministrie or the honorable estate of his majestie or the commoun weill of the realme, his majestie, be advise of his regentis in his minoritie, and partlie be him self sen he acceptit the gouvernament of his realme in his awin persone, hes bene moved to mak dispositioun of the said superplus in pensioun or to discharge and gif the samyne frie to sum personis, quhairthrow thair remanis litill or nathing to be disponit on, outhir to be modifiit, appointit and assignit in leavingis and stipendis to sic qualifiit personis as God sall raise up heirefter meit to entir in the functioun of the ministrie, or to supplie the publict and neidfull affairis of his hienes estait; quhilk being diligentlie and with gude deliberatioun advisit upoun be his majestie and the lordis of his privie counsale, it is found be thame that the said superplus of the saidis thriddis of benefices being assumit and takin in his majesties handis for the causis and affairis befoir specifiit, and alsua his hienes propirtie for the honorable sustentatioun of his hous and tryne aucht not, nor micht not, be disponit and gevin utherwise, bot applyed to the same use and effectis that they wer dedicat unto at the begynning, neither aucht his hienes casualities, quhairon the ordiner chairges of his estate utherwise aucht to be sustenit, be disponit at the inoportune sute of all askaris, bot his hienes commoditie maid thairof and sic discretioun had in the dispositioun as his majestie micht convenientlie leif on his awin. And thairfoir his hienes, be advise of his said counsale, revoikis, rescindis, casis, annullis and discharges all the saidis giftis, feis and dispositionis out of his said propirtie, casualitie, thriddis of benefices and collectorie in pensioun or frielie discharget as said is gevin be his hienes, with avise of his regentis for the tyme, or be him self sen the acceptatioun of the governament in his awin persone, declarand and decernand the same to be null and of nane availl, force nor effect in tyme cuming, and ordanis the comptroller, thesaurair and collectour generall of the said superplus to ask, crave, ressave, intromet and uptak his haill propirtie, casualitie and superplus to the use and effect befoir writtin of the crop and yeir of God jM vC lxxix yeiris present and in tyme cuming, without respect of ony gift of pensioun, fie or frie discharge of ony part of the saidis propirtie, casualitie or collectorie in tyme bigane preceiding the dait heirof, and that they answer and obey nane bot upoun new warrand, directioun and commandiment to be obtenit heireft; and that lettres be directit to officiaris of armes, schireffis in that part, to mak publicatioun and intimatioun heirof be oppin proclamatioun at the mercat croces of the heid burrowis of this realme and utheris places neidfull, that nane pretend ignorance of the same, inhibiting all and sindrie his hienes liegis that nane of thame tak upoun hand to answer, obey or mak pament of ony maner of pensionis gevin furth of the saidis propirtie, casualitie or collectorie or ony part thairof to ony persone or personis clamand the samyne be ony gift in pensioun, fie or frielie discharget as said is, bot to answer the said comptroller, thesaurair and generall collectour and his deputtis thairof, notwithstanding ony giftis, decreittis or lettres obtenit thairupoun in tyme bygane. Exceptand and reservand alwayis furth of his majesties revocatioun his hienes gift or discharge maid to his dearest and onlie greit uncle Robert, erle of Lennox, lord Dernly, of the superplus of the thriddis of the priory of Sanctandrois and bischoprik of Cathnes, attour the sustentatioun of the ministrie serving at the kirkis thairof; as alsua the gift of pensioun and assignatioun thairof furth of his propirtie and thrid of the archebischoprik of Sanctandrois maid be his majestie and ratifiit in his last parliament to his richt traist cousignace Annabell, countesse of Mar, gouvernant of his hienes persone and mowth in his infancy; and siclike the gift of pensioun maid furth of the thrid of the abbay of Scoone to his weilbelovit daylie servitour Maister James Halyburtoun, provest of Dundee, quhilkis his hienes declaris not to fall or to be comprehendit undir his said revocatioun, bot willis that the same giftis, penssionis and discharges sall stand in full effect and force in tyme cumming efter the forme and tennoure thairof, and now in this present parliament ratifeis and apprevis the same as of befoir, the said revocatioun or ony uther thing contenit thairin notwithstanding.

Forsamekle as the kingis majestie, with avise of his thrie estaitis of this present parliament, hes thocht gude, statut and ordanit that thair salbe ane penny or pece of gould prentit and cunyeit of xxj carrat fyne, and the same to have course and passage for xl s. money of this realme, contenand ten in the unce and to be callit the Scottis croune, havand on the ane syde the croune sceptour and sword, makand in the middis the forme of Sanctandrois croce, the ane half of the dait of the yeir in this forme '15', and on the uther syde the uther half of the dait of the yeir in this forme '79', with this circumscriptioun, 'Hactenus invicta miserunt', and on the uther syde of the pice, in the middis thairof, ane 'J' and ane 'R' laissit with the figour of '6' undir thame and writtin about 'Ad te centum et quinque proavi'. And siclike that thair be prentit and cunyeit ane penny of silver of the fynes of ellevin denneyris, in haill and half peces, the haill peice to have course and passage for xxvj s. viij d., weyand xvij denneyris and xj granys, and to be callit the tua merk pece, and the half pece to have course for xiij s. iiij d., and to be callit the merk pece, the said haill pece havand on the ane syd ane thrissell with ane 'J' on the ane syde of the thrissell and ane 'R' on the uther syde of the thrissell with this circumscriptioun, 'Nemo me impune lacesset', and on the uther syde of the said penny the kingis armes and this circumscriptioun, 'Jacobus 6 Dei gratia rex Scotorum', the said mark pece berand the like prent wecht and fynes in all thingis pro rata; quhairfoir oure said soverane lord, with advise of his saidis estaitis, ordanis publicatioun to be maid of the premisis be oppin proclamatioun at the mercat croces of the heid burrowis of this realme, and to command and charge all and sindrie his majesties liegis to ressave the said gould and money in rady and thankfull pament, and on nawyise to presume or tak upoun hand to refuise the samyne upoun quhatsumevir cullour or pretence, undir the pane of tressone; and siclike to certifie all his hienes liegis of the prices of gould and silver to be brocht in to his majesties counyehous, that is to say, the unce of utter fyne gould to be bocht for xxj lib. money of this realme, and all uther gould of quhatsumevir fynes to be aggreable in price according to the fynnes, the inlaik of courser gould nor is appointit to be counyeit beand modifiit, and the unce of utter fyne silver to be brocht for xxxvj s., and all uther silver of quhatsumevir fynes to be aggreable in price according to the fynes, the inlaik of courser sylver nor is appointit to be counyeit beand likewise modifiit; and that it salbe lesum to all his majesties subjectis to inbring to oure soverane lordis counyehous and deliver to his hienes maister counyear all sortis of gould and silver, ayther in plate werk or cunyie, upoun the prices abonespecifiit; and ordanis and commandis the generall maister cunyear wardanis, assayaris, sinkaris, meltaris, foirgearis and prentaris of the counyehous present and to cum, ilkane in thair awin offices, to do thair diligence in melting, foirgeing and prenting of the saidis peices of gould and silver as they salbe commandit be the said generall and maister counyear thairto according to the wecht and fynes abone mentionat, as they, and ilk ane of thame, will answer to oure soverane lord upoun the executioun of thair offices.

And the saidis counsellouris nominat and electit, with his hienes ordiner officiaris now present, hes maid fayth in presence of his hienes and his estaitis that they sall gif thair awfauld, leill and trew counsale in all thingis that salbe proponit in counsale tending to Goddis glory, the honnour and suretie of oure soverane lord, his estate and commoun welth of this realme. And his hienes, with avise foirsaid, grantis and gevis full pouer and commissioun to sa mony of his counsale as salhappyne to be present for the tyme to ressave the aythis of the lordis and utheris admittit be this acte to be in the counsalehous, now absent, quhen they salhappyne to compeir, declarand the same to have als greit strenth, force and effecte as gif the same wer presentlie done. It is ordanit alsua that the maister of requeistis and clerk of the counsale sall, every counsall day, remember the chancellair or president of the affairis of the estate, causse dependand and supplicationes present, that they may the better be proponit, hard and determinat as the necessitie of every thing sall require; and that the publict affairis concerning the king and the commoun weill be first treatit of in the foirnoune, and at after noune the billis red and particular causse of partiis hard, except thair be na publict affairis to be occupiit with in the foirnoune; and that all signatouris, lettres and missives to be subscrivit be his majestie be first deliverit to his officiar unto quhais charge they belang, or his depute, and they to present the same to the kingis majestie, and nane utheris to presume to urge his hienes with the subscriving of lettres not being first sene be his counsale or ordiner officiauris as heirin is appointit, bot that sic lettres as sould be considerit be the counsale be first red (according to the ordour befoir appointit be acte of parliament) in counsale sittand, subscrivit be tua of the counsalouris, gif they be grantit, and noted on the bak be the clerk as hard and allowit be the counsale sittand, quhairof alsua he sall mak a schort note in his buik, writtand likewise in the same the names of thame that daylie sittis in the counsale; and that the keiparis of the signet, privie and greit seillis answer the same to na signatouris or lettres bot sic as salbe thus subscrivit be the king and tua of the counsale and noted on the bak be the clerk thairof, except sic signatouris as ar appointit be the said former acte of parliament to pas ordinarly be the thesaurair and comptroller properlie belanging to thair offices without the counsale; and the foreyn missives, quhilkis ar onlie to be subscrivit be the king, being sene, allowit and presentit be the secretair, and to the effect that na Scottis missives salbe privilie purchest, the forme and mater not being first found gude be his hienes secretair, that all the saidis missives salbe subscrivit undir the kingis subscriptioun be the secretair or his depute, or ellis not to be signet or closit with his hienes caschet; and that all lettres commanding oure soverane lordis liegis to ony effect salbe direct be advise of the counsale and subscrivit in the counsale sittand be tua counsalouris and na utherwise inlikemaner. †Anent the supplicatioun gevin in be the chancellair, president and remanent senatouris of the college of justice, makand mentioun that quhair be the institutioun of the said college they ar authorizet to sitt and decide upoun all actionis civile, and nane utheris to have vote with thame, and oure said soverane lordis dearest gudesir King James the Fyft, of worthie memorie, institutar of the said college, promittit in the said institutioun thairof that he sould not be ony privat writting, charge or command at the instance of ony personis, desire thame to do utherwise in ony mater that sould cum befoir thame, bot as justice requirit, or to do ony thing that may brek the statutis maid be thair predicessouris, the first senatouris of the said college at his hienes command and doing of justice, and that he wald gif na credite to ony man that wald muremure the saidis lordis or ony of thame be doing of wrang and unhonestie, bot they sould be callit befoir him, and, gif they wer foundin culpable, to be punishit thairfoir efter the qualitie of the fault or dimerit; and gif they wer fundin clene and innocent, the personis complening to be punishit with all rigour and nevir to have credit agane with his hienes, as in the said institutioun, ratifeit be parliament, at mair lenth is contenit. Anent the complaint gevin in be Johnne, erle of Montroise, proportand and beirand that he is informit thair wes ane supplicatioun gevin in in the last parliament haldin at Striveling be the tennentis of the temporall landis of the bischoprik of Dumblane, makand mentioun in effect that the saidis landis being sett to him in few be the bischop of Dumblane, he wald not faill be proces of tyme to put out the kyndlie and native tennentis of the saidis landis (quhilk is not of veritie, nevir owthir meanit, thocht or done be him), and thairfoir desiring his few not to tak effect and not to be confirmit, bot to be stoppit at the seillis. To the quhilk the lordis of articles gaif thair answer, as he is informit in this maner, that his infeftment sould be considerit be the lordis commissionaris and not to pas the seillis quhill that he had aggreit with the tennentis quhat fassoun the said erle knew not. Anent the complaint gevin in be Patrik Fortoun, sone to Johnne Fortoun in Allansyd, berand and proportand that James Huntar, sumtyme in Nysbet, being convictit be ane condignn assys in ane justice court haldin be oure soverane lordis justice and his deputtis in the tolbuyth of Edinburgh upoun the vij day of Marche, the yeir of God jM vC lxxvij yeiris, for his tressounable remaning and abyding at hame fra oure sovrane lordis oist and army ordanit to convene at Dumfreis the tent day of November preceiding, the same expres contrair his hienes proclamatioun, incurrand thairthrow the panys contentit thairin, the said Patrik Fortoun obtenit oure said soveranis gift of the said James Huntaris eschaet for compositioun pait to his hienes thesaurair, thairfoir havand maist just occasioun sa to do be ressone the said James had takin the possessioun of his fatheris steiding and heritage ower his heid; conforme to the quhilk gift and lettres past be the lordis of sessioun thairupoun, officiaris of armes past to tua husband landis, myln and myln landis of Nysbet and their apprehendit sa mony of the said James guidis as wer then upoun that ground, quhilkis wer intromettit and uptakin as eschaet, conforme to the said gift, quhilk tuik effect in the said Patrikis persone. Nevirtheles, the said James in the moneth of Aprile last bipast, lang efter the obtening of the said gift, and that the samin had takin effect in the said Patrikis persone as said is be intromissioun with the saidis eschaet guidis, craftelie, be circumventioun of oure said soverane, tacita et suppressa veritate impetrat oure said soveranis pardoun and remissioun for abyding fra the said oist and army in prejudice of the said Patrik and his said gift of eschaet, he nevir being warnit to heir the samyn grantit, havand speciall entres thairto, bot rather maid the cullour in obtening the said remission that his eschaet wes takin up alrady as ane pane dew for the cryme of the quhilk he wes convictit. And yit now, taking advantage be the granting of the said remissioun, as thocht his eschaet fell not, allegeand dome wes not pronuncit upoun the convictioun and declaratioun of the assyis, hes sensyne intentit actioun of spulyie and ejectioun aganis the said Patrik and his assistaris in uptaking of the said eschaet, extending to the sowme of ten thousand markis, meaning thairby to elude and frustrat the effect of oure said soveranis gift, not declaring the order of the proces and convictioun led the gift of the eschaet and uptaking of the eschaet formalie, bot as it wer making the cullour of oure said soveranis remissioun that the eschaet wes alrady takin as a pane of the convictioun; quhairupoun the said Patrik meanit him to oure said soverane lord and lordis of secreit counsale of befoir at diverse tymes, and speciallie in the moneth of Julii lastbipast, at quhilk tyme he obtenit lettres be the saidis lordis deliverance requiring the lordis of counsale and sessioun to stay and superseid of all further proceiding in the said mater of spuilyie and ejectioun to oure said soveranis nixt parliament or conventioun generall, quhen his hienes officiares best skillit in this mater wald be present, that then his majestie and lordis gif thair resolute declaratioun upoun the claus and word that importis the difficultie, as the saidis lettres direct thairupoun schawin and producit befoir his hienes and lordis of articles heir present proportis; quhilkis lettres, being executit upoun the lordis of sessioun, they have, conforme thairto, stayit all further proceiding in the said mater quhill oure said soverane and lordis declaratour be gevin thairintill, desyrand thairfoir his hienes and estaitis to have consideratioun of the premises; and seing the effect of this questioun dependis upoun the interpretatioun of this word and claus, quhether the convictioun be ane assys makis the eschaet to fall without dome, or gif of necessitie dome mon be gevin in every criminall caus, althocht not comounlie to be punist be deith, that oure soverane lord and lordis foirsaidis wald gif thair declaratour thairupoun in this present parliament according to equitie and gude conscience as at mair lenth is contenit in the said complaint gevin in be the said Patrik Fortoun thairupoun. And siclike anent the complaint gevin in be James Huntar, sumtyme at the Myln of Nysbit, beirand and proportand that quhair Johnne and Patrik Fortownis pretending thame to have gift of the eschaet of all his guidis and geir for being absent from the cutting of the Harlaw wod, come with thair complices, bodyne in feir of weir, in the moneth of Junii, the yeir of God jM vC lxxviij yeiris, to his house in Nysbit, brak up the durris and kistis, spuilyeit his haill guidis, geir, coirnis, cattell, insicht and plenissing, and cruellie ejectit and put furth the said James Huntar, his wyf and bairnis furth of the said house as they wer liand in thair beddis, without aither claithis or ony uther thing sensyne, quhairby he hes bene constranit sensyne to leif as ane pure, miserable man, oppressit with seiknes, and thrie of his puyr bairnis deceissit for very hunger and povertie, he not havand to sustene thame as of befoir; and thairfoir he intentit actioun of ejectioun and spuilyie befoir the lordis of sessioun, quhilk is admittit to his probatioun, notwithstanding the said pretendit gift of eschaet; in respect, befoir ony dome and sentence pronuncit aganis him, he obtenit ane remissioun of oure said soverane lord quhairthrow na dome can be gevin now aganis him, and sua the said Johnne and Patrik Fortonis did manifest wrang to intromet with his guidis and geir and to oppres him, his wyf and bairnis sa miserablie, being ane honest man befoir, without ony sentence pronuncit aganis him. First, we ordane the New College for the studee of theologie allanerlie, in the quhilk five maisteris daylie teacheing sall in four yeiris compleit the haill cours of the New and Auld Testament and the comoun places in this ordour, viz., the first lectour in the first sex monethis sall teiche the preceptis of the Ebrew grammer and practize thairof in David, Salamon, Job; in the uther sex monethis, the preceptis of Caldaicque, Syraicque and use of the samin in Daniell, Esera, the Paraphrasis and Syriacque New Testament; the secund lectoure in the secund yeir and ane half sall interpreit out of the Ebrew and sensiblie oppin up the law of Moses and the historie of the Auld Testament, conferring with the Paraphrasis, Septuagintis and uther lernit versionis quhair neid beis; the thrid lectour in the last yeir and ane half sall, with the like diligence, expone the Prophettis, greit and small; the fourt lectour sall teiche the New Testament out of the Greik toung during the haill course, conferring with the Syriacque; the fyft lectour sall reid the commoun places during the haill cours swa that the studentis of theologie, heiring daylie thrie lessonis the space of foure yeiris, sall with meane diligence becum perfite theologians; to this end thair salbe daylie repetitionis, anys in the oulk publict disputationis, everie moneth declamationis, thrie solemne examinationis in the cours: the first in the end of the first yeir in the toungis and sa fer as they have hard of the Commoun Places and New Testament; the secund examinatioun efter the secund yeir and ane half in the law, historie and samekle as salbe red of the Comoun Places and New Testament; and the thrid examinatioun in the end of the cours in all the toungis, the haill Bible and Commoun Places; thir thrie solemne examinationis salbegyne the tent day of September, quhairin everie learnit man salbe frie to dispute. And becaus thair is greit raritie at this present of men learnit in the knawlege of the toungis and uther thingis neidfull for sic professouris, we have thairfoir electit certane of the maist qualifiit personis knawin to us as the saidis five maisteris for teacheing of the course of theologie in the order befoir writtin in the said New College, to begyne howsoune possibillie they may be transportit thairto; of the quhilkis, thrie to entir this present yeir, and ordanis the personis now occupeing the place of maisteris in the said college to remove thairfra withut dilay. Item, quhen it salhappyne ony of the five maisteris or professouris to inlaik or that the nowmer sall not be full, that the electioun of qualifiit personis thairfoir sall from this furth pertene to the Bischop of Sanctandrois, the conservatour of the privilegis of the said universitie, the rectour, deanis of facultie and remanent maisteris of theologie, or the maist pairt of thame that salbe present in Sanctandrois the day appointit for the electioun; for quhilk purpois, the rectour, or incaise of his absence or negligence the deane of facultie, within sex dayis efter the vaicanse of the rowme be disceise or utherwise, sall affix ane edict upoun ane monethis warning that all learnit men may convene furth of all pairtis of the realme, of quhome the worthiest efter dew examinatioun to be preferrit; and to the same personis, electouris sall belang the charge of depositioun and deprivatioun of sic as salbe thocht unworthie aither in doctrine or lyff or not doing thair dewitie faythfullie and diligentlie in that professioun quhairunto they happyne to be electit. Oure soverane lord, with advise and consent of the thrie estaitis of this present parliament, for divers considerationis moving thame tending to the quietnes of this realme, haif gevin and grantit and, be the tennoure of this present act, gevis and grantis to James Spens, sone lauchfull to umquhile David Spens of Wilmerstoun, the like grace and benefite of the pacificatioun maid at Perth upoun the xxiij day of Februar, the yeir of God jM vC lxxij yeiris, and ratifeit and apprevit in his hienes parliament haldin at Edinburgh in the moneth of Aprile, nixt tharefter in the yeir of God jM vC lxxiij yeiris, without exceptioun; and willis the samin pacificatioun, without exceptioun, to be als amplie extendit in the said James favouris in all respectis, conditionis, clauses and circumstances thairof as the said umquhile David had bene expreslie comprehendit and contenit thairin. And alsua his hienes, with advise of the estaitis of the said parliament, willis and grantis that the said pacificatioun, without exceptioun, be amplie interpretit and endit to the said James in all clauses thairof as said is, and specialie that this present act of parliament according to the said pacificatioun be sufficient to rescind, retreit, lyke as oure said soverane lord and estaitis foirsaidis retretis and rescindis the proces of forfaltour led aganis the said umquhile David for certane crymes of tressone and lesemajestie commitit be him, and to restoir and reintegrat as his hienes, with advise foirsaid, restoris and reintegratis the said James aganis the samin, siklike and als frilie in all respectis as gif the said proces had nevir bene led and dome of forfaltour had nevir bene gevin after the forme and tennour of the said pacificatioun, quhilk, and everie claus thairof, is heirin haldin pro express; and ordanis this present act to be extendit in competent and dew forme as effeiris, restoring fullelie the memorie, honour and fame of the said umquhile David in the persone of his said lauchfull sone, lyke as oure soverane lord and thrie estaitis of this present parliament restoris and rehabilitatis the said James sone foirsaid thairto; and findis and declaris the said James abill to enter and succeid as air to the said umquhile David, his father, be brevis of oure soverane lordis chepell or utherwyse, to the quhilkis the said umquhile David had rycht and possessioun thairof, notwithstanding the said proces of forfaltour or ony thing following thairupoun.†
