Nam eodem die dictus Jacobus Hammiltoun de Wodhouslie sufficienter instructus per prefatos commendatarios ad prosequendum sceleratissimum facinus antedictum ascendebat super equo quodem velocissimo eidem commendatario de Abirbrothok spectante ac se super eodem equo ad dictum oppidum de Linlyghtgw quanta potuit diligentia contulit. Et ibidem tunc hospitium Joanni quondam Sanctiandree archiepiscopo incumbente secreto sub noctis silentio intrauit ubi latuit et se continuo occultavit tanquam in loco maxime idoneo ante electo et parato ad perpetrandum facinus antedictum usque in crastinum ameridie qui erat vigesimus tertius dies eiusdem mensis Januarii. Et tunc videns et prospiciens prefatum nostrum avunculum et regentem nihil mali suspicantem huiusmodi hospitium pretereuntem ipse e gradu anteriori eiusdem ubi interim infidiando stabat bombardam quondam longam duobus globis plumbeis suffultam intendebat et laxabat directe versus eius umbilicum et ventrem quibus duobus globis unico fulmine emissis nobilissimum et innocentissimum ipsius corpus in media sue turbe crudelissime perfossum erat adeo ut brevi eo ipso ictu seu fulmine interiit ad ingens impiorum solatium sed ad gravem bonorum lamentationem et formidabile status nostri discrimen. In verificationem premissorum quondam Arthurus Hammiltoun in Myrritoun (qui penultimo die mensis Maii ultime elapso pro suis proditoriis criminibus mortem subiit in dicto burgo nostro de Striveling) palam confessus est in eodem burgo non solum per aliquot dies ante eius accusationem et hoc in presentia quorundam dominorum nostri secreti consilii ad eius declarationem audiendam per nos directorum sed etiam in ipso accusationis tempore atque adeo in ipsa scena tempore sue executionis quod dicti commendatarii erant de consilio prefate proditorie murthure dicti nostri avunculi et regentis et quod dictus Jacobus Hammiltoun de Wodhouslie obtinuit infeosamentum centum librarum terrarum de Monktoun pro perpetratione huiusmodi nefandi sceleris in quibus dictus commendatarius de Abirbrothok infeodatus erat, et quod hec omnia didicit et intellexit a prefato Claudio commendatario de Paislay per eius expressum narrationem in nemore de Hammiltoun post decessum dicti nostri avunculi et regentis affirmando tunc temporis et loci dicto quondam Arthuro quod nunquam inquietaret dictum Jacobum Hammiltoun de Wodhouslie in sua possessione prefatarum terrarum de Monktoun eo que satis care easdem lucratus erat. Anent the supplicatioun gevin in be Jeane Discheingtoun, youngest dochtir and ane of the tua airis of umquhile Paull Discheingtoun, fear of Ardross, makand mentioun that quhair efter the deceis of hir said umquhile fader, hir waird and mariage became to the dispositioun of umquhile James, duke of Chastellerault, erle of Arrane, lord Hammyltoun, protectour and governour of this realme for the tyme, quha alsua obtenit possessioun of hir persone being then ane infant; and befoir she had discretioun or conference with hir freindis to chies ane pairtie aggreable, she wes mariit upoun Gawin Hammiltoun, sumtyme of Reploch, be the space xv yeiris syne, lang befoir ony cryme committit be him, quhairwith he is now chairget. Nochttheles, upoun the occasioun of his unhappie being at Striveling the tyme of the deceis of oure said soverane lordis dearest gudesir, hir said husband is now fugitive, his leving and all the portioun of land quhilk fell to hir be deceis of hir said umquhile father is becum in oure said soverane lordis handis, the said Jeane laitlie falling to a small portioun thairof be compositioun be the advise of freindis, viz., the manys of Kirkpotie, with mylne thairof, the landis of Tollennoquheis and Dewglie, with the myln thairof, as the decreit arbitrall and contract of divisioun beiris, upoun the quhilk she presentit hir supplicatioun to oure said soverane lord and lordis foirsaidis, quhairof she ressavit his gracious ansuer ordaning hir to produce the said decreit arbitrall and contract of divisioun befoir his hienes advocat to be sene and considerate, that it being knawin in particular quhat landis suld appertene to hir properlie, thairby oure said soverane lord, with avise of the lordis foirsaidis, wald of mercie and piety dispone the same to hir for hir lyftyme, howsonne the same suld becum in his hienes handis. Forsamekle as thair is sindrie lovable actis of parliament maid be oure soverane lordis maist noble progenitouris for the stancheing of the maisterfull and ydle beggaris, away putting of soirnaris and provisioun for the puyr, bearing that nane salbe thoilit to beg nouthir to burgh nor to land betwix xiiij and lxx yeiris, that sic as makis thame selffis fuilis and ar bairdis or utheris siclike rynnaris about, being apprehendit, salbe put in the kingis waird and yrnis salang as they have ony guidis of thair awin to leif on; and fra they have not quhairupoun to leif of thair awin, that thair earis be nailit to the trone or to ane uther trie and thair earis cuttit of and banist the cuntrie; and gif thairefter that they be found agane, that they be hangit. Item, that nane be thoilit to beg in ane parrochyne that ar borne in ane uther, that the heidismen of ilk parochyne mak teakynnis and gif to the beggaris thairof that they may be sustenit within the boundis of that parochyne, and that nane uther be servit with almous within that parrochyne bot they that beiris that teakyn allanerlie, as in the actis of parliament maid thairanent at mair lenth is contenit, quhilkis in tyme bigane hes not bene put to dew executioun throw the iniquitie and troublis of the tyme bipast. And be ressone that thair wes not heirtofoir ane ordour of punishment sa specialie divisit as neid requirit, bot the saidis beggaris, besydis the utheris inconvenientis quhilkis they daylie produce in the commoune welth, procuris the wraith and displesar of God for the wiked and ungodlie forme of leving usit amangis thame without mariage or baptizing of a greit nowmer of thair bairnis; thairfoir now, for avoiding of thir inconvenientis and eschewing of the confusioun of sindrie lawis and actis concerning thair punishment standing in effect, and that sum certane executioun and gude ordour may follow theiranent to the greit plesar of almichty God and commoun weill of the realme, it is thocht expedient, statutit and ordanit, alsweill for the utter suppressing of the saidis strang and idle beggaris, sa contageous innemyes to the commoun weill, as for the chearitable releving of aiget and impotent puyr people, that the ordour and forme following be observit: that is to say, that all personis being abone the aige of xiiij and within the aige of lxx yeiris that heirefter ar declarit and sett furth be this act and ordour to be vagabundis, strang and ydle beggaris, quhilkis salhappyne at ony tyme heirefter, efter the first day of Januar nixtocum, to be takin wandering and misordering thame selffis contrarie to the effect and meaning of thir presentis salbe apprehendit; and upoun thair apprehensioun be brocht befoir the provest and baillies within burgh, and in every parochyne to landwart befoir him that salbe constitutit justice be the kingis commissioun or be the lordis of regalities within the samyne to this effect, and be thame to be committit in waird in the commoun presoun, stokkis or irnis within thair jurisdictioun, thair to be keipit unlettin to libertie or upoun band or souirtie quhill thai be put to the knawlege of ane assyse, quhilk salbe done within sex dayis thairefter. And gif they happyne to be convict, to be adjuget to be scurget and brunt throw the ear with ane hett yrne, the proces quhairof salbe registrat in the court boukis, exceptit sum honest and responsall man will, of his charitie, be contentit then presentlie to act him self befoir the juge to tak and keip the offendour in his service for ane haill yeir nixt following, undir the pane of xx libris to the use of the puyr of the toun or parochyne, and to bring the offendour to the heid court of the jurisdictioun at the yeiris end, or then gude pruif of his death, the clerk taking for the said act xij d. onlie. And gif the offendour depart and leif the service within the yeir aganis his will that ressavis him in service, then being apprehendit, he salbe of new presentit to the juge and be him commandit to be scurgit and brunt throw the ear as is befoirsaid; quhilk punishment, being anys ressavit, he sall not suffer the lyk agane for the space of lx dayis thairefter, bot gif at the end of the saidis lx dayis he be found to be fallin agane in his ydill and vagabund trade of lyf, then, being apprehendit of new, he salbe adjuget and suffer the panes of deid as a theif. And that it may be knawin quhat maner of personis ar meanit to be strang and idle beggaris and vagabundis and worthie of the punishment befoir specifiit, it is declarit that all ydle personis ganging about in ony cuntrie of this realme using subtill, crafty and unlauchfull playis, as juglarie fast and lowis, and sic utheris, the idle people calling thame selffis Egyptianis, or ony utheris that fenyeis thame selffis to have knawlege of prophecie, charmeing or utheris abusit sciences, quhairby they persuaid the people that they can tell thair weardis deathis and fortunes and sic uther fantasticall imaginationes; and all personis being haill and stark in body and able to wirk, allegeing thame to have bene heryit or brunt in sum far part of the realme, or allegeing thame to be banist for slauchter and utheris wicked deidis, and utheris nouthir having land nor maister, nor useing ony lauchfull merchandice, craft or occupatioun quhairby they may wyn thair leavingis, and can gif na rekning how they lauchfullie get thair leving, and all menstrallis, sangstaris and tailtellaris not avowit in speciall service be sum of the lordis of parliament or greit barronis or be the heid burrowis and cieties for thair commoun menstralis, all commoun lauboraris, being personis able in body, leving ydillie and fleing laubour, all counterfaittaris of licences to beg, or useing the same knawing thame to be counterfaittit, all vagabund scolaris of the universities of Sanctandrois, Glasgw and Abirdene not licencit be the rectour and deane of facultie of the universitie to ask almous, all schipmene and marinaris allegeing thame selffis to be schipbrokin, without they have sufficient testimoniallis, salbe takin, adjuged, estemit and punist as strang beggaris and vagabundis. And gif ony persone or personis efter the said first day of Januar nixtocuin gevis money, harbry or ludgeing, settis housis or schawis ony uther releif to ony vagabund or strang beggar, merkit or not merkit, wanting a licence of the provest and baillies within burgh or juge within that parochyne, the same being dewly provin at the court, they sall pay sic unlaw to the use of the puyr of the parochyne as be the juge at the court salbe modifiit sa the same exceid not v lib. And alsua gif ony persone or personis disturbis or lettis the executioun of this act ony maner of wys, or makis impediment aganis the jugeis and ordiner officiaris or utheris personis travelling for the dew executioun heirof, they sall incur the same pane quhilk the vagabund sould have incurrit incais he had bene convictit; providing alwayis that schipmene and suldartis landing in this realme, haveing licence of the provest or baillie of the toun or juge in the parochyne quhair they wer schipbrokin or first enterit in the realme, sall and may pas according to the effect of thair licences to the rowmes quhair they intend to remane; and that the licences onlie serve in the jurisdictioun of the gevar, sa that gif the persone travelling have further jorney, he procuir the like licences of the juge of the nixt parrochyne or toun throw quhilkis he mon pas, and sa fra parochyne to parochyne quhill he be at his resting place. And that thair be certane personis, ane or ma, nominat in every paroche and burgh be the officiaris and juge thairof for searcheing, ressaving and convoying of the vagabundis to the commoun presoune, yrnis or stokkis upoun the commoun charges of the parochyne, quhilkis personis sa electit salbe haldin to do thair dewitie diligentlie as the saidis jugeis will ansar thairupoun. And sen charitie wald that the puyr, aiget and impotent personis sould be as necessarlie providit for as the vagaboundis and strang beggaris repressit, and that the aiget, impotent and puyr people suld have ludgeing and abyding places throchout the realme to settle thame selffis intill, it is thairfoir thocht expedient, statutit and ordanit that the lord chancellair, according to the directioun of sindrie lovable actis of parliament heirtofoir maid, sall call for the erectionis of all hospitallis to be producit befoir him, and inquire and consider the present estate thairof, reduceing thame sa far as is possible to the first institutioun as may best serve for the help and releif of the saidis aiget, impotent and puyr people. And als that the provest and baillies in ilk burgh and toun, and the justice constitutit be the kingis commissioun in every parochyne to landwart, sall betwix and the said first day of Januar nixtocum tak inquisitioun of all aiget, puyr, impotent and decayed personis borne within that parrochyne or quhilkis wer duelling and had thair maist commoun resort in the said parochyne the last sevin yeiris bipast, quhilkis of necessitie mon leif be almous; and upoun the said inquisitioun sall mak a register buik contening thair names and surnames, to remane with the provest and baillies within burgh and with the justice in every parochyne to landwart. And to the effect that the nowmer of the puyr people in every parochyne may be knawin, statutis and ordanis that all puyr people within xl dayis efter the proclamatioun of this present act at the mercat croce of Edinburgh repair to the parochyne quhair they wer borne or had thair maist commoun resort or residence the last sevin yeiris bipast, and thair settle thame selffis undir the pane to be punist as vagabundis, contravenaris of this present proclamatioun; and the said space of xl dayis being bipast, that then the provest and baillies within burrowis, and the juge constitutit be the kingis commissioun in ilk parochyne to landwart, mak a catholog of the names of the saidis puyr people, inquire the men and wemen quhair they wer borne, quhether they ar mariit or unmariit, quhen and be quhome they wer maryed, and quhat bairnis they have and quhair thair bairnis wer baptized, and to quhat forme and trade of lyff they addres thame selffis and thair saidis bairnis, gif they be diseased or haill and able in body, and quhat they get commonlie on the day be thair begging, and sic as necessarlie mon be sustenit be almous, to see quhat they may be maid content of thair awin consentis to accept daylie to leif on unbeggit and to provide quhair thair remaning salbe, be thame selffis or in hous with utheris, with avise of the prochynnaris quhair the saidis puyr people may be best ludged and abyd; and thairupoun, according to the nowmer, to consider quhat thair neidfull sustentatioun will extend to in the oulk and then, be the gude discretionis of the saidis provestis and baillies and jugeis in the parrochynnis to landwart and sic as they sall call to thame to that effect, to taxt and stent the haill inhabitantis within the parrochyne according to the estimatioun of thair substance, without exceptioun of personis, to sic ouklie charge and contributioun as salbe thocht expedient and sufficient to sustene the saidis puyr people; and the names of the inhabitantis stentit togider with thair taxatioun to be likewise registrat; and that at thair discretioun they appoint oversearis and collectoris in every burgh, toune and paroche for the haill yeir for collecting and ressaving of the said ouklie portioun, quhilkis sall ressave the same and deliver samekle thairof to the saidis puyr people and in sic maner as the saidis provest and baillies in burgh and juges in the prochyne to landwart respective sall ordane and command; and that ovrsearis of the saidis puyr people that be appointit be thair discretionis to continew alsua for a yeir, and at the end of the yeir the taxatioun and stent roll be alwayis maid of new for the alteratioun that may be throw deith or be incres or diminutioun of mennis guidis and substance. And that the provest and baillies in burrowis or townis and the saidis jugeis in the parochynnis to landwart sall gif a testimoniall to sic puyr folk as they fynd not borne in thair awin parochyne or making residence thairin the last sevin yeiris, sending or directing thame to the nixt parochyne, and sa fra parochyne to parochyne quhill they be at the place quhair they wer borne or had thair maist commoun resort and residence during the last sevin yeiris preceiding, thair to be put in certane abyding places and sustenit upoun the commoun almous and ouklie contributioun as is befoir ordanit, except leprous people and bedfast people quhilkis may not be transportit, providing that it be lefull to the puyr people sa directit to thair awin abyding places with testimoniallis to ask almous in thair passage, sa as they pas the directit way, not resting tua nychtis in ony ane place, without occasioun of seiknes or storme impeid thame; and gif ony of the puyr people refuis to pas and abyd in the places appointit, or efter the appointment be found begging, then to be punishit be scurgeing, impresonment or byrning throw the ear as vagabundis and strang beggaris; and for the secund falt to be punishit as thevis as is befoir appointit. And gif the personis chosyne collectouris refuisis the office, or, haveing acceptit the same, beis found negligent thairin, or refuisis to mak thair comptis every half yeir anys at the leist to the provest and baillies in burrowis and the saidis jugeis in landwart and to delyver the superplus of that quhilk restis in thair handis at the end of the yeir or half yeir to sic as salbe chosyne collectouris of new, then ilk ane of the collectouris sa offending sall incur the pane of xx lib. to the use of the puyr of that parochyne and inpresonment of thair personis during the kingis will, for quhilkis panes the saidis provest, baillies and jugeis sall poynd and distrenyie. And gif ony personis being able to further this chearitable werk will obstinatlie refuis to contribute to the releif of the puyr or discourage utheris from sa chearitable a deid, the obstinat and wilfull persone being callit befoir the provest and baillies within burgh or jugeis in the parochyne to landwart and convict thairof be ane assyis or sufficient testimony of tua honnest and famous witnessis, his nyghtbouris, upoun the supplicatioun of the saidis provest, baillies and jugeis to the kingis majesties and his privie counsale, the obstinat and wilfull persone or personis salbe commandit to waird in sic part as his hienes and his counsall sall appoint and thair remane quhill he be content with the ordour of his said parrochyne and performe the same in deid. And gif the aiged and impotent personis not being sa diseased, lame or impotent, bot that they may wirk in sum maner of werk, salbe be the oursearis in ony burgh or parrochyne appointit to wirk and yit refuis the same, then first the refusar to be scurget and put in the stokkis and for the secund falt to be punishit as vagabundis as said is. And gif ony beggaris bairne being abone the aige of v yeiris and within xiiij, maill or femaill, salbe lykit of be ony subject of the realme of honnest estate, the said persone salhave the bairne be ordour and directioun of the provest and baillies within burgh or juge in landwart parrochynnis, gif he be a manchylde to the aige of xxiiij yeiris and gif she be a woman chylde to the aige of xviij yeiris; and gif they depart or be takin or intysed fra thair maister or maistres service, the maister or maistres to haif the like actioun and remedy as for thair feit servand or prenteis alsweill aganis the bairne as aganis the taikar and entysair thairof. And quhair collecting of money can not be had and that it is ower greit a burding to the collectoris to gather victualis, meit and drink or utheris thingis for releif of the puyr in sum parochynnis, that the provest and baillies in burrowis and the saidis jugeis in the prochynnis to landwart, be avise of certane of the maist honest parrochynnaris, gif licence undir thair handwrittis to sic and samony of the saidis puyr people, or sic utheris for thame as they sall think gude, to ask and gather the chearitable almous of the prochynnaris at thair awin housis, sa as alwayis it be specialie appointit and aggreit how the puyr of that prochyne salbe sustenit within the same, and not to be chairgeable to utheris nor troublesum to strangearis. And seing be ressone of this present act and ordoure the commoun presonis, irnis and stokkis of every heid burgh of the schire and utheris townis ar like to be fillit with a greitair nowmer of presoneris nor of befoir hes bene accustumat in safer as the saidis vagabundis and utheris offendoris ar to be committit to the commoun pressone of the schire or toun quhair they wer taikin, the same peresonis being in sic townis quhair thair is greit nowmer of puyr people mair nor they ar weill able to sustene and releif, and sua the presoneris ar like to perishe in default of sustenance, thairfoir the expense of the presoner salbe pait be a part of the commoun distributioun and ouklie almous of the parochyne quhair he or she wes apprehendit, allowand to ilk persone daylie ane pund of aitbreid and watter to drink; for pament quhairof, the presentair of him or hir to presone sall gif suirtie or mak present pament. And that the schireffis, stewartis and baillies, lordis of regalities and thair baillies ourall the realme see this present act put to dew executioun in all poyntis within thair boundis and jurisdictionis respective as they will anser to God and our soverane lord thairupoun, and quhatevir doubt or ambiguitie salhappyne to arrys upoun this present act, or ony part thairof, oure soverane lord, with avise of his saidis estaitis, committis the interpretatioun, explanatioun and supplement and full executioun thairof to his majestie with avise of his privie counsale.

Forsamekle as the contempt of oure soverane lordis authoritie and of the lawis and ordiner justice of the realme is the ground and fontane, fra quhilk the maist part of all confusioun and disorder proceidis, and amangis utheris evillis the disobedience of the proces of horning is sa greit and commoun that the personis denunceit rebellis takkis na feir thairof and the partyis hurt and interest that hes obtenit decreittis and lettres with thair infinit expensis and coist can get na executioun nor redres; and howbeit be one act and ordinance maid be the lordis of sessioun it wes providit that all officiaris immediatlie efter thair denunciatioun of ony personis to the horne suld pas to the schireff of the schire quhair they dwelt and intimat to him the same, requiring him, in oure soverane lordis name and authoritie, to mak ane just inventair of all the saidis personis guidis, to the effect that the samyne mycht be inbrocht to his hienes use for thair contemptioun, and that the saidis officiaris sould deliver to the said schireff ane attentik copy of the saidis lettres, with the executioun of the same subscrivit with thair hand and within aucht dayis thairefter sould pas to the thesaurair or his clerkis and deliver to thame one uther copy of the saidis lettres, with the executioun of the samyn, inlikemaner subscrivit with the saidis officiaris handis to the effect foirsaid, conforme to the said act and ordinance. Nevirtheles, the samyne hes bene neglectit for the maist part and nawys followit be the saidis officiaris, swa that the impunitie of sic hanyous attemptattis and oppin rebellioun hes brocht oure soverane lordis auctoritie in contempt and maid the multitude of rebellis sa greit that it salbe difficill to knaw thame fra the kingis obedient subjectis without sum haisty remeid be providit, notwithstanding that be the foirsaid ordinance of the lordis of sessioun and utheris lovable lawis and actis of parliament establishit be his hienes and his maist noble progenitouris, gude ordour be takin for avoiding of the said confusioun, yit the negligence of the dew executioun thairof hes bred this greit inconvenient, quhilk now oure soverane lord, for the furtherance of his obedience and universall weill of his subjectis, presentlie intendis, as God sall grant opportunitie, to remeid. Thairfoir his hienes, with avise of his thrie estaitis in this present parliament, statutis and ordanis that all lettres of horning executit and indorsat, or that salhappyne to be executit and indorsat befoir the publicatioun of this present act, sall, within the space of fyftene dayis efter the publicatioun thairof and in all tyme thairefter within the space of fyftene dayis efter the denunciatioun, be brocht to the schireff clerk of every schirefdome quha sall registrat the same in the schireff buikis and deliver the principall lettres agane executit and indorsat, noted on the back, registrat sic a day and subscrivit with his hand, and within xxiiij houris efter the ressait thairof, sall ressave fra the party, awner and presentair of the saidis lettres, for his lauboris onlie vj s. viij d.; the quhilkis lettrez and executionis thairof sua registrat and subscrivit on the bak be the said schireff clerk, or the copy thairof autentiklie extractit furth of the saidis schireff buikis subscrivit be the said schireff clerk, salbe estemit as autentik, and salhave effect and force in quhatsumevir jugement they happyne to be producit ay and quhill the partie sua denuncit to the horne obtene him self ordourlie relaxt thairfra, quhilk relaxatioun sall alsua be maid publictlie at the mercat croce of the schire quhair he duellis and quhair the denunciatioun of hornyng wes maid; and that the said relaxatioun and executioun thairof sall be likewise registrat in the said schireff buikis within xv dayis efter the publicatioun thairof at the said mercat croce and be alsua registrat and subscrivit on the bak in maner foirsaid, utherwayis the saidis lettres of horning and relaxatioun sall nawise be haldin lauchfullie and orderlie executit, bot the executionis thairof null. And that all schireffis have honest, famous men to thair clerkis quha, be thame selffis or thair sufficient deputis, salbe haldin to be alwayis resident within the heid burgh of the schire for ressaving and registring of the saidis horningis and relaxationis as they sall occur, and sall do the same trewly and orderlie within xxiiij houris undir the pane of pament of the dannage and interest that the party skaythit happynnis to sustene in thair default, at the sicht and modificatioun of the lordis of counsale and sessioun; and that ilk schireff caus the names of the haill personis sua denuncit and remaning in his register to be oppinlie publishit and proclamit at the mercat croce of the heid burgh of the schire upoun the mercat dayis preceiding the thrie heid courtis yeirlie, and affix the catholog of thair names baith on the mercat croce and the tolbuyth, that gif ony of thame hes actionis to persew they may be repellit ab agendo and namys to be deleit furth of the said catholog quhill they be lauchfullie and dewlie relaxit fra the horne. And that every schireff, within the space of xv dayis efter the heid court, send the catholog of the names of the rebellis registrat in his buikis and a breif note of the causis for quhilkis they ar denuncit to oure soverane lordis thesaurair or his clerk, quha salbe haldin with all diligence to raise lettres and caus uptak the eschaetis of the rebellis to oure soverane lordis use. And quhen oure soverane lordis comptroller, collectour generall or ony uther persone presentis lettres of horning dewlie exectutit and indorsat to the said lord thesaurair or his clerk for speciall sowmes of money or debt, the thesaurair sall caus rais lettres thairupoun at his instance for uptaking of the eschaet directit outhir to the schireff of the schire and his deputtis or to officiaris of armes, as it may best serve, be advise of the complener; of the radiest and first end of the quhilk eschaet, the party complener salbe pait of his just debt, with the officiaris expensis and the superplus of the said eschaet to be brocht in to his majesties thesaurair within the space of ane moneth thairefter, providing that the party complener and presentair of the lettres to the thesaurair mak the first expensis upoun the schiref or officiar that salbe directit for uptaking of the saidis eschaet guidis quhill the eschaet it self may releif the saidis expensis, and then the same to be tane and allowit of the eschaet. For remeid quhairof, oure soverane lord, with avise of his thrie estaitis in this present parliament, statutis and ordanis that the saidis unjust persewaris sall pay the panes and unlawis respective following incaise the personis accusit happynnis to be acquite of the crymes laid to thair charge, to be equalie devidit betuix oure soverane lord and the partie acquite: that is to say, gif the pairty acquite be onlie ane persone, or ma of or within the nowmer of ten, the sowme of ten pundis; and gif the nowmer acquite be past the nowmer of tene, the sowme of twenty pundis; and that dome be gevin thairupoun befoir the justice without further calling and the persewar haldin in waird quhill he mak pament. Forsamekle as thair is sindrie lovable and gude actis maid be oure soverane lordis maist noble progenitouris, specialie be his gudeschir, King James the Fift of gude memorie, anent planting of woddis, forestis and orcheardis, sawing of broume, aganis the distroyaris thairof, brekaris of dowcattis, cunnyngharis, parkis, stankis, yairdis, orcheardis, slaying of hairis, makaris of mureburne in forbiddin tyme and sindry like uther thingis for punishment of the distroyaris of planting, hanyng and policie, quhilkis actis oure said soverane lord, with avise of his thrie estaitis in this present parliament, ratifeis, apprevis and confirmis and ordanis thame to have effect and executioun in tyme cummyng not onlie upoun the contravenaris thairof, bot alsua upoun the distroyaris and steillaris of beis and cutters and pullers of brwme, with this additioun: that quhatever persone steillis, peillis and distroyis grenewod or pullis or cuttis hanyt, brwme, brekkis yairdis and orcheardis without the gude will of the awner, that the offendour being takin reidhand may be persewit and put to the knawlege of ane assyisis befoir the baroun or landislord of the landis and ground, quhether the offendour be his tennent unto quhome the wrang is done or not, within thrie dayis efter the apprehensioun; and utheris not takin reidhand, to be alwayis persewit befoir the schirref, stewart or baillie within quhais boundis and jurisdictioun the wrang doar duellis; and gif he that ressavis the wrang and hurt beis schirref, stewart or baillie him self, then the wrang doar to be persewit befoir the unsuspect deput of the said schirref, stewart or baillie ressaving the wrang. And for the first falt, beand convict be his awin confessioun or witnes, sall pay to the awner of the wod, brume or yaird the availl of the skayth done, togider with tene pundis; for the secund falt sall pay to the said awner xx lib. and the availl of it that is distroyit; and for the thrid falt sall pay to the said awner xl lib. and the availl of it that is skaythit; and frathynefurcht, sa oft as the offendour failyeis, thaireft the said thrid penaltie to be pait to the awner of the wod, brume or yairdis. Bot incais the committar of the wrang be unresponsall, he sall for the first falt be put in the stokkis, presoune or yrnis aucht dayis on breid and wattir; and for the secund falt xv dayis; and for the thrid falt a moneth to ly in stokkis as said is, and to be scurgit at the end of the said moneth; and this but prejudice to be callit at justice courtis at oure soverane lordis instance conforme to the former use and auld actis, and that the panes for breking of the dowcattis, cunnyngharis, parkis be according to this present act and additioun above writtin. Item, oure soverane lord and thrie estaitis of parliament, considering the hurt quhilk hes cummit to the commoun weill of this realme and liegis thairof be haveing and keiping of cruvis and yairis, slauchter of reid fische in forbiddin tyme and smoltis, and that divers actis and constitutiones hes bene maid be his hienes maist noble progenitouris in tyme bigane towart the distructioun and away putting of the saidis cruvis and yairis and eschewing of slaying of reid fische and smoltis, quhilkis actis hes not ressavit executioun in tyme bigane, bot hes bene neglectit and oversene, thairfoir ordanis the saidis actis to be extendit and have effect and executioun in tyme cuming aganis the transgressoris thairof efter the forme and tennour of the same, as alsua aganis all that slayis the saidis reid fische in forbiddin tyme be blaisse, casting of wandis or utherwise, or that distroyis the smoltis and fry of salmond in myln, dammis, or be polkis, creillis, trammelnettis and herry watteris, and that the landislordis and awnaris of the saidis cruvis and yairis, betuix this and the first day of Marche nixtocum, put doun and hald doun the saidis cruvis and yairis conforme to the saidis actis and undir the panes contenit thairin; and gif they failyie thairin, the said day being bipast, ordanis and commandis his hienes thesaurair to persew and uptak the saidis panes. And als ordanis the schirreffis, stewartis and baillies in the schyres, lordis of regalities quhair the saidis cruvis and yairis ar and the provestis and baillies of the nixt burrowis, conjunctlie or severaly, to pas with convocatioun of his majestes liegis and cast doun and distroy the saidis cruvis and yairis and hald thame doun as they will ansuer to oure soverane lord upoun thair obedience; and gif neid be, that lettres be direct aganis thame to that effect within ten dayis undir the pane of rebellioun; and gif they failyie, to put thame to the horne. And this act to serve for sufficient commissioun to the saidis schirreffis, stewartis, baillies, lordis of regalities, provestis, aldermen and baillies of burrowis to the effect foirsaid, and that they nawyse salbe callit or accusit thairfoir nor incur ony skaycht or danger thairthrow in tymmcuming. And commanding all oure soverane lordis liegis to ryse, concur and assist to the saidis shireffis, stewartis, baillies and their deputtis, provestis, aldermen and baillies of burrowis and thair officiaris in putting of the said act to executioun in all poyntis efter the tennour thairof. Item, oure soverane lord and thrie estaitis, undirstanding that divers and sindrie his liegis, namelie within burgh, ar becum sa wilfull, obstinat and malicious that they will not be content to pay and satisfie thair nychtboris and creditoris of sic debt as ar auchtand justlie to thame without calling and compulsioun of the law and extremitie thairof, thairfoir statutis and ordanis that the pairty aganis quhome decreit beis gevin in burgh sall pay to the support of the puyr xij d. of every pund efferand to that quhilk beis obtenit and recoverit befoir the juge, and alsua the expensis of the party obtener of the decreit at the modificatioun of the said juge; and gif ony pairty allegis, producis or gevis in befoir the juge within burgh ony defence or exceptioun quhilk hes bene of befoir proponit to the dilay of his party, the producear thairof sall pay the sowme and pane of xx s. to be employit to the help of the puyr, and that sa oft as failyie beis maid, and this to extend alsweill to the procuratour as principall pairty in tyme cummyng.
