†Oure soverane lord, with avise of his thrie estaitis of this parliament, hes ratefeit and apprevit and, be the tennour heirof, ratefeis and appreves of new all actis and consitutionis of parliament maid be quhatsumever our soverane lordis thair dicessouris of befoir, in favouris of the burrowis and burgessis of all this realme, inhabitantis of the samyn, with all prevelegis, fredomes, immuniteis and liberteis grantit and gevin to thame, and everie ane of thame; and decernis and declaris the samin to haif full strenth, force and effect in all tymes heirefter, sua that the samyn may be put to full and dew executioun in all pointis and to stand as ane perpetuall law to thame and thair successouris, with this additioun: gevand thame fredome and prevelege to convene four tymes in the yeir for sic materis as concernis thair estait, and that in quhat burgh it salbe thocht expedient to the maist part of the saidis burrowis, provyding alwayis, for eschewing of tumultis, that thair be present at the saidis conventionis for everie burgh in nowmer ane, except the toun of Edinburgh, to haif ane ma nor the utheris burrowis.

†Forsamekill as it is statute and ordanit be act of parliament maid in our soverane lordis derrest moderis tyme that na infeftmentis of kirklandis sett sen the aucht day of Marche, the yeir of God jM vC lviij yeiris suld be of ony force or effect without the samin wer dewlie and lawchtfullie confermit be oure soverane; and als forsamekle as it happinnis that dowbill infeftmentis of fewferme of ane portioun of landis gevin be ane ecclesiasticall persone to divers persones and sumtymes be divers ecclesiasticall persones, to witt, the predicessour and successour to divers personis in fewferme, and yit nather of the saidis infetmentis can tak effect or be of awale without thay be dewlie and lawchtfullie confermit be our soverane lord; and alswa it is oftymes sene that confirmatioun is grantit of bayth the saidis divers infeftmentis at divers tymes be the sutes of the parteis, lyk as it is fundin be sindrie ordinances of the previe counsall that our soverane lord and his hienes compositouris aucht not to deny his confirmatioun upoun the ressonabill expensis of the pairtie sutand upoun thair awin perrall; and lykwayis divers alienatiounis of landis haldin immediatlie of our soverane lord, being maid be ane persone to divers persones, dowbill confirmatiounis ar grantit be our soverane lord thairto, quhair as ane of the saidis confirmationis aucht and can only tak effect in all the causis abone specefiit; and notwithstanding it is the occasioun of grite debait amangis the liegeis, to thair grite expensis, alsweill in payment of thair compositionis as that the samin breidis occasioun of sic grite pley; for remeid thairof, it is concludit, statute and ordanit be our soverane lord and thrie estaitis of parliament quhasoevir obtenis or hes obtenit the first confirmatioun of ony infeftment, ather of kirklandis or uther landis haldin of our soverane lord, that that first confirmatioun salbe of availl, force and effect and sall prevaill to the secund, the said infeftment quhilk is first confirmit being valiabill in the selff and lawchtfullie maid; and in this cais, the last confirmatioun sall not be respectit, albeit the samin conferme the first infeftment, bot the first confirmatioun of the last infeftment sall prevaill to the last confirmatioun of the first infeftment be way of exceptioun or replay without ony summondis or proces of reductioun. It is alwayis providit that gif the principall infeftment first confirmit for ony uther substantiall caus by the foirsaid confirmatioun be of nane availl or unlawchtfullie maid, to the prejudice of ony uther pairtie haiffand entres the landis thairin contenit and quha may be excludit be ressoun of the said first confirmatioun be the pairtie haiffand entres, salbe hard to accuse or reduce the said infeftment first confirmit or utherwayis to mowe actioun aganis the sam as accordis of the law, quhidder thay haif obtenit confirmatioun of thair infeftment or not. It is alsua statute and ordanit that na dowbill confirmationis of infeftments of kirklandis or utheris haldin of our soverane lord be grantit heirefter, and dischargers the keparis of the signet, prewie and grite seillis that thai pas not dowbill confirmatiounis; and gif the saidis dowbill confirmationis pas in tyme cuming, oure said soverane lord, with avise of his saidis thrie estaitis, decernis and declaris the last confirmatioun to be of nane availl, providing as is abone specefiit.

Forsamekill as the provest, bailleis, counsall and communitie of the burgh of Irwin hes bene accustumat thir mony yeiris bigane to haif twa fairis in the yeir to be haldin within the said burgh, that is to say the first fair beginnand uponn the xv day of August, quhilk is the First Ladie Day, and the nixt upoun the viij day of September, quhilk is commonlie callit the Letter Lady Day, being only xxiij dayis betwix tham; and now becaus commonlie the said day of September is the tyme quhen the inhabitantis of the cuntrie may not gudlie resort and repair to the said burgh for doing of thair necessar bissines in the said tyme of fair be resson of the harvest, bot man await upoun the schering of thair cornis of the grund and winning thairof, and siclyk thair can be na commodious place appointit for the horse mercat and utheris bestiallis in respect that the cornes ar not separat than from the ground, quhairby ane ganand place may be appointit to that affect without destructioun of the saidis cornes; and als thair is sindrie utheris burrowis haiffand the samin Letter Ladie Day appointit to thame for thair fairis and mercattis, quhilk ar neir to the said burgh, quhairby thay ar damnefit of thair trafficque. For remeid quhairof, oure soverane lord, with avise of his thrie estaitis of this present parliament, hes alterit and changit the said fair and mercat of the said burgh of Irwin quhilk wes accustumat to be haldin in all tymes bigane upoun the said awcht day of September, namit the said Letter Ladie Day, to be haldin within the samin burgh yeirlie in tyme cuming, exceptand onlie for this present yeir, upoun the xxiiij day of October gewand fredome, facultie and power to the saidis provest, bailleis and inhabitantis to caus proclame thair said fair and mercat yeirlie in dew tyme to the said xxiiij day of October siclyk and in the samin maner as thai wer accustumat to do the samin the said awcht day of September, grantand to thame alsua all custumes, prevelegeis and immuniteis quhilkis as they had of befoir at the said fair appointit upoun the said awcht day of September. And oure said soverane lord and estaitis foirsaidis hes declarit and declaris the said fair and mercat, quhilk wes haldin of befoir within the said burgh upoun the said awcht day of September, to be abrogat and expirit fra this instant yeir furth, and the samin to be haldin perpetuallie and in all tymes cuming upoun the said xxiiij day of October, quhilk the kingis grace and estaitis foirsaidis declaris to be als lawchtfull and sufficient as the samin wes haldin of befoir upoun the said viij day of September, and that without dirogatioun, hurt or prejudice of the said burgh custumes, prevelegis or immuniteis grantit to thame of befoir our said soverane lordis predicessouris; and ordanes the lordes of counsall to direct lettres for publicatioun heirof, gif neid beis, in forme as effeiris.
