Anent the approbatioun and confirmatioun of the regiment

The quhilk day it is fundin, declarit and decernit be our soverane lord, with avise of the thre estatis and haill body of this present parliament, that the nominatioun, constitutioun, electioun and ordinatioun of the nobill and michtie lord James, erle of Mortoun, lord Dalkeith etc., in regent to our soverane lord, his realme and liegis thairof, during the tyme of his majesteis minoritie and les age, togidder with the consent and approbatioun of the erlis, lordis, prelattis, commissionaris of burrowis, barrounis and uther faithfull subjectis, convenit and assemblit to that effect, and the acceptatioun of the said office of regentrie be the said James, erle of Mortoune upon the xxiiij day of November last by past, was, is and in all tyme cumming, salbe haldin, repute and estemit lauchfull, sufficient and perfite; and all and quhatsumever thingis quhilkis he hes done be vertew of his said office of regentrie sen his acceptatioun thairof, or quhilkis he sall do heiretfer in our soverane lordis name and authoritie during the tyme of his hienes minoritie, to be als dewly, lauchfully, sufficiently and richteously done and to have als greit availl, strenth, force and effect in all respectis and conditiounis as ony thing done be quhatsumever regentis, governouris or protectouris of this realme in the minoriteis and les ages of ony utheris native princes of the samin. Quhilkis confirmatioun, nominatioun, electioun, constitutioun, acceptatioun, actis and procedingis our said soverane, with avise and consent of the saidis thre estatis and haill body of this present parliament, ratefyis, approvis and confirmes, for now and in all tyme cumming.

Anent the trew and haly kirk

Item, forsamekle as thair was ane act maid in the parliament haldin in the first yeir of our soverane lordis regne, that now is intitulat 'Anent the trew and haly kirk and of thame that ar declarit not to be of the same kirk', quhilk act, our soverane lord, with avise and consent of my lord regentis grace, the thre estatis and haill body of this present parliament, ratifyis, approvis and for his hienes and his successouris perpetually confirmis; and seing the educatioun of our soverane lord is in the trew religioun of Jesus Christ and that the samin religioun, be lawis and actis of parliament maid in his hienes regne, is establischit, and that it is baith godly and expedient that all his hienes subjectis worschip the only trew God in the uniformitie of religioun and his hienes obedience, thairfoir it is statute and ordanit be our said soverane, with avise of his said regent, the thre estatis and haill body of this present parliament, that the lauchfull archebischoppis, bischoppis, superintendentis and commissionaris of the dioceis and provinces of this realme, be thame selfis and the ministeris and reidaris serving at the kirkis within thair charges respective, with all diligence, efter the publicatioun of this present act, note the names of the persounis, asweill men as wemen, suspectit to be papistis or that hes not communicat with the sacramentis as thay ar now trewly ministrat in the reformit kirkis of this realme and, with the lyke diligence, lauchfully admonische thame according to the ordour of the kirk; and in case thay be furth of the realme, upon thre scoir dayis warning to recant thair papisticall errouris, gif the confessioun of thair faith according to the forme approvit in our soverane lordis parliament, be participant with the sacramentis and submit thame selfis to the discipline of the trew kirk within certane ressonable space, under the pane of excommunicatioun; and gif thay failye, to pronounce the sentence of excommunicatioun aganis thame. And in case of the contumacie and non comperance of ony persounis swa admonischeit or comperand, gif thay refuse to obey the admonitioun, and thay quha hes returnit to thair errouris efter thair confessioun anis gevin, that everie lauchfull archibischop, bischop, superintendent or commissionar present ane roll and cathalog of the names of the disobedientis, obstinat or relaps persounis to our soverane lord and his regent betuix and the first day of Junii nixt to cum, to the effect that the samin may be imprentit, divulgat and affixit on the tolbuith of Edinburgh and utheris tolbuithis and publict places of judgement within this realme, under the panis following: that is to say, everie archibischop or bischop that salbe fund remis or negligent thairin be the generall assemblie of the kirk, under the pane of tynsall of the frutes of his benefice for ane yeir to our soverane lordis use; and everie superintendent or commissionar, under the pane of tynsall of his stipend for ane yeir alswa to our soverane lordis use, and removing of him furth of his office and placing of ane uther mair diligent thairin. And that the disobedient, obstinat and relaps persounis to be contenit in the said catholog (efter the publicatioun thairof) salbe haldin, reputed and estemit infamous and unabill to sit or stand in jugement, persew, beir office, nor sall not be admittit as previs, witnessis or assysouris aganis ony professing the trew religioun ay and quhill thay have recounsallit thame selfis to the trew kirk, submittand thame selfis to the discipline thairof, and obtene testimoniall thairupon; quhilk inhabilitie being alledgeit aganis ony judges principall or deputis, members of court, officiaris, parteis or procuratouris, persounis of inquest or witnessis salbe relevant exceptioun of the law to declyne thame fra judgement, office, persute, procuratioun, inqueist or beiring witnes, without thay than presently produce sufficient testimoniall witnessing thame to be ressavit as members of the trew kirk. As alswa, the depute of the judge principall quha is the excommunicate, or the procuratour quha will compeir for the excommunicate, sall not be sufferit to proceid nor hard in judgement (the excommunicatioun being opponit and verifyit aganis the maker of the depute or constituant of the procuratour), except that the principall be quhome thay proceid or use thair procuratioun first be ressavit to the kirk and have sufficient testimoniall thairupon; and that the said exceptioun be not admittit aganis ony quhilk sall not be specially comprehendit in the said catholog. And in case the judge proceid, notwithstanding the said exceptioun, the samin being lauchfully proponit and ratifyit be the catholog foirsaid, sic contemptuous proceding testifyit be ane instrument and producit befoir the lordis of counsall salbe ane sufficient caus of suspensioun and discharge of the executioun of the decreit to be gevin in that mater.

Forsamekle as be ane act of parliament haldin and begun at Edinburgh, the ferd day of Junii the yeir of God ane thousand fyve hundreth thre scoir thre yeiris, it wes statute and ordanit that na person, vicar, nor uther ecclesiasticall person suld set in few or lang takkis ony of thair mansis or gleibbis pertenyng to the kirkis, and alsua that thay that war appoyntit or tobe appointit to serve and minister at ony kirk within this realme sould have the principall mansis of the persoun or vicar or samekle thairof as sould be fund sufficient for staiking of thame, to the effect that thai may the better await upoun the charge appoyntit and tobe appoyntit to thame, quhether the saidis gleibbis wer set in few or tak of befoir or not, or that ane ressonable and sufficient hous wer beigit to thame besyde the kirk be the persoun or vicar or utheris havand the saidis mansis in few or lang takkis; and forder, samekill land tobe annexit to the saidis duelling places of thame that servis and ministeris at the kirk as thairefter with gude advysement sould be appoyntit, lyke as the said act at mair lenth proportis; quhilk being in divers poyntis doubtfull and incertane, na gude executioun hes followit thairupoune in tyme bipast. And thairfor oure soverane lord, with avise of my lord regentis grace, the thre estatis and haill body of this present parliament, findis and declaris that the mansis other pertening to the persoun or vicar maist ewest to the kirk and maist commodious for duelling, pertenis and sall pertene to the minister or redar serving at the same kirk, together with foure akeris of land of the gleib at leist, liand contigue or maist ewest to the said manse gif thair be samekill; and failyeing thairof, samekill as thair is tobe merkit and speciallie designit be the archibischope, bischope, superintendent or commissionar of the diocie or province the tyme of thair nixt visitatioun, be the advise of ony tua of the maist honest and godlie of the parochinaris quhilkis thai sall require (not being possessouris of the saidis mansis or gleibbis thame selffis) to joyne with him in executioune heirof, quhether the saidis mansis and gleibbis be sett in few or takkis of befoir or not; and upoun the said marking and designatioun, the archibischope, bischeope, superintendent or commissionar sall gif his testimoniall, bering how he, with avise of sic tua of the parochinaris, hes visited the mansis and gleib of sic a kirk and findis the same occupiit be sic personis, and that thay have appoyntit, markit and designit the said manse, with foure akaris or sic quantitie of land adjacent thairto, to the use of the minister or redar that sall serve and mister at the said kirk in tyme cuming, and upoun the minister or redaris supplicatioune quhairwithall the said testimoniall salbe presentit to the lordis of counsall and sessioun, lettres salbe direct chargeing the occupiaris and possessouris of the saidis mansis and akeris of land, quhether the same be sett in few or takkis of befoir or not, to remove, desist and ceis thairfra, and enter the said minister or redar to the possessioun of the samyn within ten dayis under the pane of rebellioun; and gif thai failyie, to put thame to the horne; and in caise thai be denuncit, captioun and utheris executoriallis according to the lawis and consuetudes of this realme tobe directit aganis thame. Anent the reparatioun of the paroche kirkis

Forsamekle as thair was ane act maid in the parliament haldin in the moneth of Junii, the yeir of God ane thousand fyve hundreth thre scoir thre yeiris, declarand that quhatsumever ordour suld be maid and set furth be the lordis of secreit counsall for uphalding and reparrelling of kirkis and kirkyairdis, and the executioun to be declarit be thame thairupon, to be sufficient and have als greit strenth and effect as and the samin had bene expresly contenit in the said act of parliament, as the samin at mair lenth proportis. According to the quhilk, ane act of secreit counsall was maid for the bigging, mending and reparatioun of paroche kirkis, of the dait at Striviling, the xiij day of September, the yeir of God foirsaid, quhilk act as yit hes not tane executioun in na place because of the sleuth and unwillingnes of the parochinneiris, quhilkis war slaw and refusit to cheis persounis to taxt thair nichtbouris, and that alswa thair was not kirkmaisteris or deaconis appointit in the parochinnis to ressave the taxatioun appointit. For remeid quhairof, our soverane lord, with avise of my lord regentis grace, the thre estatis and haill body of this present parliament, ratefyis and approvis the foirsaidis actis of parliament and of secreit counsall in all pointis, with this additioun: that quhair the parochinneris being requyrit to elect and cheis persounis for making of the taxatioun to the effect foirsaid, and gif thay refuse or delayis or quhair thair is na kirkmaisteris or deaconis appointit, that than the archebisehop, bischop, superintendent or commissionar of the kirkis, in tyme of thair visitatioun, quhilk salbe betuix and the first day of Junii nixt tocum, sall, at thair discretioun, nominate and appoint persounis in everie parochin for making and setting of the taxatioun; as alswa for ressaving of the samin. And decernis and declaris the said nominatioun and appointment to be sufficient and siclyke executioun sall pas for compelling of thame as mycht have bene gevin and grantit be vertew of the said act of secreit counsall, in case they had bene electit be the parochinneris. And becaus thair hes bene divers paroche kirkis within this realme demolischit, cassin doun and destroyit for the maist part, and that certane particular persounis hes applyit the stanis, tymber and uther graith pertening thairto to thair awin particular use and profite, thairfoir ordanis ony ane of the parochinneris of sic kirkis to gif thair complaint to the archebischop, bischop, superintendent or commissionar thairof upon sic persounis as thay pleis to complene upon; and thay being lauchfully callit and just tryall takin in the said mater, and according to sufficient probatioun to be led and deducit thairintill, that the said archebischop, bischop, superintendent or commissionar pronunce and gif furth thair decreit thairintill; quhilk decreit, our soverane lord, with avise of his said derrest regent and thre estatis foirsaidis, decernis and declaris to be als sufficient as and the samin war gevin befoir ony juge ordinar, and ordanis the lordis of counsall and sessioun to direct letteris of horning or poinding thairupon at the will and plesure of the partie quha sall happin to complene. And siclyke our said soverane lord, with avise of his said derrest regent, the thre estatis and haill body of this present parliament, ordanis the persounis of all paroche kirkis within this realme to furneis breid and wyne to the communioun how oft the samin salbe ministrat within the samin kirkis.
