Procedure: ambassadors' reports

In the presence of the said lords compeared Master Alexander Kinghorn, dean of Roskilde, ambassador to a right high and mighty prince Christian [II], king of Denmark, as procurator and factor for John Matheson and Clement Anderson, captains and governors under God of a ship called The Peter Hull, and produced his letters of procuratory in the form of an instrument under the sign and subscription of Master John Chapman, together with a letter of summons under our sovereign lord's signet, raised upon the provost and committee of Aberdeen and others, for diverse goods and artillery being in the said ship called the The Peter Hull at the time she shipwrecked near Aberdeen, and desires the said lords to proceed upon the said summons.

Compeared John Scrimgeour, master, and asked instruments that he advertised the lords foresaid how that the time of his being in Denmark he knew that the discharge of Orkney and Shetland might have been surely to the king's grace and that, therefore, the lords should now labour for the same. Regarding the summons made at the instance of Master Alexander Kinghorn, ambassador and servant to a mighty prince Christian [II], king of Denmark, and as procurator and factor for Clement Anderson, captain and skipper of a ship called The Peter Hull, and John Matheson, also captain of the said ship, against Gilbert Menzies of Findon, sheriff deputy of Aberdeen, Thomas Menzies, his son, alderman of the said burgh of Aberdeen, William Rowan, Alexander Rutherford, bailies of the same, Master Andrew Tilliedaff, Andrew Crawford, burgess of the said burgh, Alexander Seton of Meldrum, William Lyon of Bahelwise and Henry Irvine, to answer at the instance of the said Master Alexander for the wrongful violent and masterful spoiling, away taking, intromitting and withholding by themselves, their servants and accomplices, of their causing, commanding and sanctioning from the said captain, skipper, quarter-masters and mariners of their said great ship, of their anchors, cables, sails, artillery, powder, money and other goods being in the said ship, as is contained at more length in the summons thereupon, the said Master Alexander, procurator foresaid, being personally present, and also the said Gilbert Menzies, Thomas Menzies, his son, William Rowan, Alexander Seton of Meldrum, being personally present, for themselves and as procurators for the rest of persons written above; and similarly, the lords being at length fully advised with diverse writings sent to them by Frederick [I], king of Denmark, alleging that the said ship and goods, with the artillery and munitions being therein, pertained to him and desiring restitution to be made to him thereof, as is contained at more length in his letters thereupon, the said lords ordain letters be written to charge Alexander Rutherford and Master Andrew Tilliedaff to deliver the chests and goods being in their possession or intromitted with by them, which were in the said ship called The Peter Hull, and that all goods and artillery specified in an inventory delivered to the said Master Alexander and all other goods and artillery of which knowledge can be gotten, in whoever's hands they be, or that can be salvaged or recovered from the sea, sand or other places, shall be put in the hands of [Thomas Menzies of Pifodels], provost of Aberdeen, [Alexander Seton], laird of Meldrum, and William Rolland, burgess of the said burgh, by authentic inventory made in the manner of an indenture and before witnesses, who shall be held to answer to the king and lords of council for the said goods to be delivered to those having right thereto; and continue the said summons in the same form, force and effect as it is now, without prejudice of any party, until 20 October next to come, with continuation of days, and the parties above-written by themselves and their procurators are warned of this continuation by the acts, and that our sovereign lord's letters be directed for uptaking and bringing in of the said goods and artillery, both to burgh and land, wherever they may be found to the effect foresaid.
