Item, the kingis grace, with avise and consent of the thre estatis of parliament, forsamekle as thare was diverse statutis, constitutionis and actis maid in the last parliament for the honour of God and Halikirk, wele of oure soverane lord, zele of justice and concerning the commoune wele of this realme and liegis therof, quhilk remanit at that tyme unpronuncit and auctorizate be his grace and thre estatis, tharefor hes divisit, statute and ordanit that the saidis actis be now pronuncit in his hienes presens and thre estatis, swa that the samin may be kepit in tyme tocum as law in this realme, with auctorite of the hale body of parliament, off the quhilkis statutis the tenouris are precedant.

We, James, be the grace of God, king of Scottis, understandand clerlie the privilege of the canoune law, actis and statutis of oure realme, providit and gevin to the succours of all maner of personis to revoik, cassis and adnull all thingis done be thame in thare youthheid and lesse aige, quhare throw thai ar gretlie and hevilie dampnagit and scaithit in thare heretagis be imprudent alienationis, donationis and venditionis of the samyn, and that thai may at thar perfite aige revoik the samin of all thingis done be thame prejudiciale in thair menorite and lesse aige and, tharefor, oure predecessouris, kingis of Scotland, at thar perfit aige of xxv yeris past hes, in tymes bigane, maid revocatioune of all sic thingis that hes bene done be thame in hurt and detriment of thare crowne, landis, rentis and possessionis pertening to the samin, and uther thingis quhare intill thai, be circumventioune, war dampnagit and scaithit, maid thair revocatioune cassand and adnulland all sic giftis, alienationis and donationis; herefor, we, at oure perfite aige of xxv yeris byrunnyn, beand for the tyme furth of oure realme in the partis of France, maid oure generale revocatioune schortlie at Rowane, the thrid day of Aprile, the yeire of God jM vC xxxvij yeris, as at mare lenthe is contenit in one instrument maid tharupoune subscrivit with the hand of Maister George Cuk, notare publicte, off the quhilk the tenour followis:

We, for certane grett and resonable causes moving ws and haifand respecte to the welle of oure croune and commoune wele of oure realme, revokis all maner of giftis, infeftmentis and dispositionis quhatsumevir we haif maid, or hes bene maid, be our tutouris and governouris for the tyme during oure minorite and lesse aige, in quhatsumevire cause or caise that thai man cum under revocatioune be the commoune law or consuetude of oure realme, protesting solempnitlie that oure absence furth of the samin at this tyme and the solempniteis requirit on that behalf nocht being done be to ws na prejudice anentis the said revocatioune, with the quhilkis we dispence and suppleis all faltis tharwith be oure kinglie power and auctorite riale, and will that this stand for oure generale revocatioune of all maner of thingis done be ws or oure saidis tutouris, and the samin to be extendit in the maist ample and large forme as ony utheris revocationis maid be oure maist nobill fader or oure progenitouris kingis of Scotland. The quhilkis oure said generale revocatioune we, in this present parlliament, with the avise and consent of oure thre estatis, ratifiis and apprevis, and yit as eftir followis revoikis, cassis and annullis in generale and als in speciale.

In the first, we revoik, cassis and adnullis all infeftmentis, donationis, alienatiounis and dispositionis maid be ws, oure tutouris or governouris or regentis in oure lesse aige in ony maner of way in fee, fewferme or franktenement of ony landis, lordschipis, custumes, annuellis, fischeingis, burrow malis and castell wardis annext to oure croune or ony part therof, als weill gevin be oure fader, quhem God assolye, as be ws to ony persoune or personis incontrar the actis maid tharupoune of befor, to be reducit agane to ws and to oure croune be vertu of the actis and statutis maid of annexationis and eftir the forme of the samin.

Item, we revoik all alienationis of ony rentis, landis and heretagis annext to the principalite and to the prince, secund persoune of the realme, maid be ws in maner forsaid.

Item, in likwise we revoik, cassis and adnullis all donationis, alienationis, fewfermes and giftis quhatsumevir in lifrent or uther wayis in oure nonaige, of the landis, rentis, annuellis or ony uther revenois that oure fader had in his possessioune the tyme of his deceise, be gift or utherwayis, and of all offices sic as chalmerlawris, ballieriis and custumaris maid for ma yeris bot fra one chakker quhill the compte be maid in the nixt chakker therefter followand, and als all assedationis and takkis maid for longer termes nor five yeris.

Item, inlikwise we revoik and cassis all talyeis maid fra the airis generale to the airis male of ony landis within or realme aganis the law and gude conscience.

Item, we revoik all new infeftmentis of landis gevin in blanchferme that war haldin of ws of befor be service of ward and releif.

Item, we revoik all regalitiis and confirmationis of the regaliteis, and of all offices gevin be ws in heretage or be oure fader aganis the actis and statutis that na regalite suld be gevin in heretage without avise and deliberatioune of the hale parliament.

Item, we revoik all alienationis maid of ony heretages in oure nonage that become lauchtfullie in oure handis be resoune of forfaltoure, bastardrie or uther wayis, and lifrentis gevin therof in oure minorite.

Item, we revoik all new creationis of landis and baroneis and annexationis and unionis of diverse landis into fee in prejudice of oure dew service aucht to ws and oure progenitouris of befor. And siclik we revoik all dischargis of service of sutis of courtis aucht of auld to oure progenitouris.

Item, we revoik all new infeftmentis gevin of creatioune of baronis in the landis and lordschipis annext to oure crone.

Item, we revoik all giftis and confirmatiounis gevin be ws of quhatsumevir landis and heretages be evill and fals sucgestioune be the expreming of ane fals cause, quhare gif thai had bene expremitt ane trew cause and the verite, we had nocht gevin the samin and, therthrow, we ar gritumlie and enormlie hurt.

And generalie we revoikes, cassis and adnullis all and quhatsumevire thingis done be ws in oure lesse aige in detriment and harms of oure saule and conscience, hurting of the privilege of our crowne, prejudiciale to the samin and to ws in oure patrimonie therof, and quhat the commoune law and consuetude of oure realme levis ws to revoik. And this oure revocatioune to be of als grett effecte and als largelie extendit, in generale and in speciale, as ony revocationis maid be ony oure progenitouris, kingis of Scotland, of befor, and specialie be oure darrest fader of gude mynd, quhem God assolye, and King James the Secund. And protestis, suppois we, of oure favoris and benevolence, suffer ony persoune or personis to use or posside ony privilegis or possessionis of landis, rentis and offices that ar fallin under oure revocatioune, it sall mak na rycht to the usaris or halderis therof, bot it sall be lefull to ws to put our handis tharto quhene evir it sall pleise ws, but ony contradictioune be vertu of oure said revocatioune, actis and constitutionis of our realme maid of befor.

Item, it is statute and ordanit for augmenting, strenthning and helping of the acte maid upoun cursit folkis and geving of the kingis lettres thareupoun, and to meit frivole appellationis, that the kingis lettres sall haif place to poynd and distrenze etc., supposis it be dewlie appelit, yere and day being bipast, the appelland nocht bringand hame his commissioun within yeire and day cessante justo impedemento; and the party quhomefor the kingis lettres sall happin to be gevin, findand sufficient cautioune befor the lordis of counsale to refound the gudis and geir that sall happin to be poyndit be vertu of the saidis lettres, geif it sall happin the sentence quhare upoun the saidis lettrez salbe gevin to be retretit be the juge delegate, notwithstanding ony appellatioun therfra, the party appellatioune being warnit and callit to hear the souritie and cautioune tane and that the party appeland schawand befor the saidis lordis the sentence retractatoure, lettres be directed to poynd the saidis soureteis therfor.

Item, for the manteining of justice and putting of gude ordour tharto outhrouch all this realme, it is statute and ordanit that all stewartis, balyeis and schireffis hald all thare thre heid courtis be thame self in proper persoune, without thai haif just and lauchtfull excuise throw being in the kingis grace service and to testife the samin be his gracis writting, or throw seiknes that thai may nocht travell. And that the kingis grace auctorite be nocht lychtleit and his liegis want detfull administratioune of justice, it is siclik statute and ordanit that all baronis and fre halderis that aw sute and present in the saidis courtis be thare personalie and the absentis to be amerciate with all rigour; and quham that aw bot sute, that thai send thare sutouris, honest and qualifeit men hable to decide upoune ony cause conformand to the said law, and that the saidis schireffis, stewartis and balyeis admitt nane utheris, as he will ansuer to the kingis grace; and quha that cumis to the court, that he ansuer for himself and remane quhill the samin be done and endit, and to pass upoune inquestis and assise and assist to the kingis schireffis, stewartis and balyeis in the administratioune of justice and doing of thare offices and service conforme to thare infeftmentis as thai will ansuer to the kingis grace upoune thare utirmest charge.

Item, that all schireffis, stewartis and balyeis cause thare maris and officiaris quha sall execute the kingis lettres and chargis, or thare awin preceptis, to haif ane signet and in it gravit the first lettre of thare name or first of thare surname, or ellis sum uther thing that salbe universale knawin to be thare signet, with the quhilkis thai sall signett all lettrez and preceptis execute be thame and indorsaited in times tocum; and that na indorsatioune sall haif faith nor be admittit bot thai ar signet with the saidis signettis; and siclik that all officiaris of the kingis haif thare signettis in maner forsaid and signett all lettrez and chargis executed and indorsaited be thame under the pane of deprivatioune of thame fra thare offices that makis any sic executionis without thare signettis forsaid, and gif any of thare executionis wantis thare signet, the samin sall haif na faith.

Item, for eschewing of grett inconvenientis and fraude done to oure soverane lordis liegis be summoning of thame at thare duelling places, and oft tymes falslie, and gettis never knawlege therof, it is statute and ordanit that in tymes cuming, quhare any officiar or schireff in that part passis at the command of the kingis lettrez or the schireffis, stewartis, baronis or balyeis precepte to summond any party, geif thai can nocht apprehend thame personalie, thai sall pass to the yett or durr of the principale duelling place quhare the persoune to be summond duellis and has thair actuale residence for the tyme, and thare sall desire to haif enteres, quhilk, gif it be grantit, thai sall first schaw the cause of thare cuming, and gif thai can nocht gett the party personalie, thai sall schaw thare lettres or precepte befor the servandis of the house or uther famouse witness and sall execute thare offices and charge, and thereftir sall offir the copy of the saidis lettrez or precepte to any of the servandis, quhilk, gif thai refuse to do, that thai affix the samin upoune the yett or dure of the personis summondit; and siclik, gif thai gett na enteres, thai first knokand at the dure vj knokis, thai sall execute thare office befor famouse witnesses at the said house and duelling place and affixt the copy upoune the yett or dure therof as said is, quhilk salbe lauchtfull and sufficient summoning and delivering of copy, and the party nor officiar sall nocht be haldin to gif ony uther copy bot at thare awin plesoure; and every officiar in his indorsatioune sall mak metioune of his executioune in maner forsaid; and the party at quhais instance the lettre or precept is directed sall pay to the officiare executour the expense of the copy affixt as said is, and salbe taxt and gevin agane to him at the geving of the decrete or sentence gif he happinnis to optene; and gif the officiar beis fundin culpable in the executioune of his office, he salbe put in oure soverane lordis presoune and punist in his persoune and gudis at the kingis grace will.

The acte of annexatioune

Item, becaus it is understand and wele avisitlie considerit be the kingis grace and the thre estatis of his realme, beand assemlit in this present parliament, that the patrimonie of his croune and revenois therof being augmentit is the grett weill and proffitt baith to the kingis grace and all his liegis, and therfor it is thocht expedient that oure said sovirane lord, followand the gude exemple of his predecessouris, suld annex to his crone for the honorabill support of his estate riale in all aventouris and caises, baith in weir and paice, sic landis and lordschipis as ar now presentlie in his handis that ar nocht annext of befor, and the saidis landis being annext to remane perpetualie with the crowne may nowithir be gevin away in fee nor franktenement to ony personis, quhatevir estate or degre thai be of, without avise, decrete and deliverance of the hale parliament, and for the grett resonable cause concerning the welefair of the realme first to be avisit and degestlie considerit be the hale estatis; and albeit it sall happin oure sovirane lord that now is, or ony his successouris, kingis of Scotland, to annalie and dispone the saidis lordschipis, landis, castellis, townis, donationis and advocationis of kirkis and hospitalis, with thare partinentis, to the crowne as said annext, that the alienatioune and dispositioune salbe of nane avale, bot it salbe lefull to the king for the tyme to ressaif tha landis to his awin use quhen evir it likis his grace but ony proces of law, and the takerris sall refound and pay all proffittis that thai haif tane up of tha landis agane to the king for all the tyme that thai haif had thame, with sic uther restrectionis as is contenit in the actis of parliament maid be his maist nobill predecessouris, kingis of Scotland, in the annexatioune to the crowne; and, tharefor, his hienes, with avise and counsale of his thre estatis, hes annext to his crone to remane tharwith in maner forsaid thir landis eftir following:

In presens of the kingis grace and hale thre estatis of parliament Maister James Foulis of Colintoune, clerk of register, prelocutour for oure sovirane lord, and at his gracis command, schew and declarit how thare is diverse domes of forfaltour gevin aganis diversis personis for crimes of lese majestie baith in parliament and justice courtis, and in speciale aganis Archibald, sumtime erle of Anguise, George Dowglas, his broder, and umquhile Archibald Dowglas of Kilspindy, thare eme, Jhone, sumtym lord Glamis, umquhile Schir James Hammiltoune of Fynnart, knycht, and umquhile Jhone Lyoune of Knokcany; and becaus the memour of tratouris suld remane to the schame and sclander of thame that ar cumin of thame and to be terrour to all utheris to commit siclik in tymes cuming, and becaus bukis may be tint and, throw oft handilling, be worne away, and utheris wayis the saidis domes of forfaltoure be distroyit, that therfor that all the saidis thre estatis wald think, geif it war expedient, that the saidis domes of forfaltoure war furth drawin of the bukis and auctentikly copeit and that the kingis grace suld append his grett sele tharto, and siclik all the thre estatis suld append thare selis to the samin for the fortificatioune, approbatioune and confirmatioune therof, the quhilk desire all the thre estatis thoycht verray resonable and be sensement of parliament thoycht the samin to be done and grantit to append thare selis to the auctentik extracte of all the saidis forfaltouris baith gevin in parliament and perticuler justice courtis. That the army of Scotland be unhorsit except greit baronis

Item, anentis the maner of cuming of all oure sovirane lordis lieges to weir, horsit and unhorsit, the kingis grace understandis the gret hurt, scaith and dampnage done in cuming of multitude of horsemen throw distructioune of cornis, medowis and hanyng of pure folkis, and als the grett impediment maid be thame in the host quhare that all men man fecht upoune fute, therfor has statute and ordanit that na maner of men haif horse with him bot be reddy to gang on fute fra the place that sall pleise the kingis grace to assigne to be the first meting and asembling of his army, excepte cariage horse alanerlie; and gif ony man cumis on horse back or bringis horse with him excepte for his cariage as said is, that he incontinent send his horse hame agane with ane rynand boy and with na sensable man or able of persoune to beir wapnis under the pane of deid. Providing awayis that albeit this acte is maid generale, the effecte therof sall nocht be extendit till erlis, lordis, baronis and grett landit men, bot that thai and sic utheris as salbe thocht expedient be the kingis grace or his lieutenentis sall pass on horse bak quhare evir the kingis grace movis with his army.

Item, as to the maner of harnes and wapnys and how every man suld be armit and wapnit, it is statute and ordanit that all oure sovirane lordis liegis haif wapnis and harnes as eftir followis: in the first, that every nobill man, sic as erle, lord, knycht and baroune, and every grett landit man haifand ane hundreth pund of yerlie rent, be anarmit in quhite harnes, lyt or hevy as thai pleise, and wapnit afferand to his honoure, and that all utheris of lawer rent and degre in the lawland haif jak of plait, halkrek or brigitanis, gorgett or pisane, with splintis, pansis of malye, with gluvis of plait or malye, and that all utheris oure sovirane lordis liegis, gentill men unlandit and yemen, haif jakkis of plait, halkrekis, splintis, sellate or stele bonet with pysane or gorgett, and every man with swerd, and that na maner of wapnis be admittit in wapinschawingis bot speris, pikis stark and lang of vj ellis of lenthe, leicht axis, halbortis, handbowis and arrowis, corsbowis, culveringis, tua handit swordis, and every man to be anarmit as said is under the pane of v lib. to be tane of every landit man, l s. of every gentill man and xx s. of every yeman man als oft as thai be fundin faltouse in the premissis. And becaus it is understand that thir wapnis and harnes may nocht be completlie gottin at the first wapinschawing, that is to say on the morne efter Leif Sounday nixt tocum, therfor, it is dispensit be the kingis grace at thai mak thare schawingis and monstouris with sic harness and wapnis as thai haif, or may convenientlie gett, agane the said day.

Item, that exercitioune may be had throwith all the realme amangis all oure sovirane lordis liegis for exercing of thare personis in ordoure, swa that be lering of ordoure and bering of thare wapnis in tyme of paice thai may be the mair expert to put thame selfis in ordoure hastaly and keip the samin in tyme of neid. It is thocht that this artikule is warray necessar to be providit and, therfor, statutis and ordanis that every schirrreff, stewart, ballies, provest, aldermen and ballies of burrowis, lordis and balyeis of regaliteis at every wapinschawing concur and sitt doune with the kingis gracis commissaris that sall happin to be depute to thame, and thai togidder to consult with the maist abill personis of the scire, and eftir that thai haif rollit the namis of every man with thare harnes and wapnis, cheise ane abill man for every parrochin or ma as it is of gretness, or for smaller parrochinnis ane, quha sall be capitan or capitanis to the cumpaneis of the saidis parrochynis and sall leir thame to gang in ordoure and beir thare wappinis, and sall convine thare saidis cumpaneis tuise at the lest in every moneth of the monethis of Maii, Junii and Julii, at quhat dayis thai sall think maist expedient, upoune halidayis befor nune, and als in all utheris monethis geif thai may gudelie, and thare exerce thame in maner forsaid; and that na man dissobey the saidis personis, capitanis to be depute and chosin as said is, under the pane to be punist at the kingis grace will; and that the saidis capitanis be chosin as oft as beis sene expedient be the schireff of the schire, commissaris and counsale admittit to him to that effecte.

Generale remissioune grentit be the kingis grace to all his liegis

Item, oure sovirane lord, understanding the grett occasioune and evill exemple for the tyme gevin to his lordis, baronis and all his liegis to committ and do the tyme of his lese aige sic offencis and crimes of tresoune and utherwayis quhilk deservis grett and hie punisment, quhilkis, as his grace understandis, be the gude and trew service done be thame to him sen his cuming to perfite age, tha wald nocht haif done nor committit; and becaus his grace thinkis that he will nocht be unremembrand and ungrate for the gude and thankfull service done to him be his saidis erlis, lordis, baronis and liegis of all degreis, hes remittit and forgifin and, be the tenour of this acte, remittis and forgevis to all his saidis liegis all maner of crimes of tresoune done be thame in oure sovirane lordis tyme that last decest and his predecessouris, kingis of Scotland, and in his hienes awin tyme unto the day and dait of this present acte, the intellegence with Archibald, sumtyme erle of Anguis, George Dowglas, his broder, and umquhile Archibald Dowglas of Kilspindie, thare eme, sen the tyme of the geving of dome of forfaltoure aganis thame alanerlie exceptit, and therfor exhortis and prayis presentlie all his baronis and liegis to be trew and thankfull subjectis unto his hienes as he sall nocht faill to be gude, thankfull and loving king to thame; and that the copy of this acte sufficientlie extractit sall be sufficient remissioune without ony uther particular writing.
