The said Jhone askit documentis and protestit that, sene thair was compromittis maid for concord to be had betuix the Erlis of Anguse and Arane, thar kyne and freyndis, and that the said Erle of Arane, Hew, lord Somervale and Sir James Hammiltoune gaif in protestatiounes to mak delay that the said Jhone suld nocht haif justice anent the reducing of the said process of forfaltour, gangand in contrare the tenour of the said compromitt and, in thair part, had brokin the samin, as he allegit. In presens of the kingis grace and thre estatis of parliament comperit Maister Jhone Davidsone, procuratour for James, erle of Arane, and in his name producit ane protestatioune subscrivit with the said erlis hand protestand efter the forme of the samin, and therupone askit instrumentis, of the quhilk the tenour followis:
I, James, erle of Arane, lord Hammiltoune, protestis solemptlie in the face of this present parliament that quhat beis done in the samyn in favouris of Jhone Somervale anent the summondis rase be him apone the retreting of his forfaltour and restoring of him agane to the samin, turne me to na prejudice nor scaith anent the gift of his eschete, baith of his gudis and landis, maid to me by my lord governour and anent all uther clame and rycht that I have to the samin for diverse causis quhilkis I sall schaw and assigne resounes at tyme and explane ganand tharto. And this my protestatioune I desire to be put in public forme and askis instrumentis and documentis therupone of yow and your notaris. I, James Hammiltoune of Fynnart, knycht, protestis solemptlie in the face of this parliament that quhat beis done in the samin in favouris of Jhone Somervale anent the summondis rasit be him for the retreting of his forfaltour and restoring him agane the samin turne me to na prejudice nor scaith anent the gift of his eschete, baith of his gudis and landis, and anent the apprising of his landis maid to me before the said forfaltour, and anent all uther clame and rycht that I haif to the samin, becaus I may nocht compere in the said parliament in my defence at this tyme for diverse causis, quhilkis I sall schaw at tyme and explane ganand, and for diverse utheris causis and resounes quhilkis I sall assigne and allege at tyme and place ganand tharto. In presens of the kingis hienes and thre estatis of parliament comperit Archibald, erle of Anguse and offerit to find cautioune to the quenis grace for indempnite of hire persoune and hir honest houshald under sic panis as the kingis hienes and lordis wald divise and think expedient, sua that hir grace may saiflie and surlie cum and gang to this toune of Edinburgh and fra the samin with hir said houshald during the tyme of this present parliament and thre dais therefter, and efter the forme and tenour of this writing gevin in be the said erle tharupoune, off the quhilk the tenour followis:
My lordis of consale, this is the ansuere that I, Archibald, erle of Anguse, make to the quenis grace. In the first, quhare scho desiris surtie of me of bodelie harme, my lordis, I traist it is nocht unknawin to all your lordis that I never as yit did hir grace ony harme in hir persoune, nor never tendis to do. And as I traist it has not bene use that men has gevin cautioune to thar wife, nochttheless, for the plessour of hire grace and to geif hire occasioune to adheire to me as to hir husband, for the wele of baith oure conscience, I am content to do all thingis that is nocht hurt to my saule or that I may do of gud zele. And according tharto, I sall bind me under gret sowmez that hir grace sall be harmeles of me and all that I may lett, as the law will that a manis spous be harmles of hire husband, and sall treit hir grace at my power sa lang as we are undivorcit, as law, conscience and honestie of hire grace requiris. And geif your lordis will requeist or consell me to find uther maner of assouerance quharthrow hir grace may tak occasioune not to adheire to me, hir husband, lik as scho is bundin and oblist be the law of God and Halikirk, my lordis, at your lordis and in speciale spirituale will pleise to avise geif ye may geif me that consale, and geif I may use the samin saiflie, for I am advertist be men of religioune and utheris of conscience that sic thingis may nocht be lefully grantit without displesour of God and incurring of deidlie syne, quhilk na man suld do, considering all hir desiris intendis to abstract hir grace fra me, hire husband, quhilk as I understand I may na way do lauchfullie for; and hir grace be wele consalit, scho suld nocht refuse this my resonable desiris.
