These are the acts and statutes made in the aforesaid parliament and confirmed by the supreme lord our king on 15 February 1489 [1490] in the presence also of the three estates of his realm:

Firstly, for the honour of God, the liberty and freedom of the holy church and churchmen, it is decreed and ordained that all privileges, freedoms and immunities for them be observed and retained in the future, just as it has been during the times of our sovereign lord's father and forebears of most noble memory, with this addition: that those who take and intromit with the lands, teinds, oblations, profits or duties of the holy church without tack and lease from the parson, vicar or of their farmers, that is to to be a point of dittay in the future.

Secondly, it is thought expedient and ordained that for the ayres that are now set, that their diets be observed and kept according to the form of the said diets and laws of this realm, and that the ayres that are not set be immediately set, proclaimed and held with all care and diligence for the punishment of trespassers in order to pacify [the king's] realm and lieges.

Item, touching the love, amity and friendship to be made amongst all our sovereign lord's lieges, it is thought expedient by the three estates that our sovereign lord and his council shall use his authority by the advice of his said council to make all persons and parties be friendly and in agreement, and whichever person or persons who refuse in his failure to hear a reasonable and honourable agreement of his party, that the king's highness is to use swift justice on the parties which are obstinate, through which his highness can bring them into heartfelt amity, friendship and peace with punishment according to the laws of his realm.

Item, regarding the expediting of the hasty gathering and obtaining of the taxes granted in parliament, for the expenses of an honourable embassy that will go abroad for our sovereign lord's marriage, regarding the part in the hands of the clergy, it is thought expedient that the prelates currently in this town should agree a method with the treasurer and show him how the said taxes should be paid on behalf of the said clergy before any of them depart this town. And for the taxes of the barons and temporal persons that should be raised by and taken from the sheriffs, bailies and other king's officers, it is advised by the said lords that the said sheriffs, bailies and other officers being so often charged by the king's letters and are now called to be here, that therefore they should now be newly charged by a king's officer to come before the chancellor and the lords of council next Friday in George Robinson's lodgings, to make a full account and payment of the said taxes. And similarly that all sheriffs, provosts, bailies of burghs and all other officers who do not come here or are not present, that letters be written immediately to them to raise, bring in and pay the said tax in the near future, or else that they be charged to go and be imprisoned within Blackness castle within 15 days, if they fail to bring in and pay the said taxes, under the pains of rebellion and being outlawed, [and] the confiscation and escheating of all their own goods for the king's use. And because the said lords understand that there are certain letters of discharge from part of the said taxes granted by the king to the spiritual lords and prelates and also to the temporal lords and to burghs, which the said lords consider and understand the king might not discharge as it was granted by the estates for the said embassy, and for the aforesaid reason, and therefore that the said letters of discharge are not to be of acquittance for them, and that no such letters have any strength, force or effect, and that letters of discharge be made under the privy seal and sent to the ordinaries and sheriffs for this.

Item, touching the renewal and confirmation to be made of the confederation and alliances with France and similarly with Denmark and Spain, it is thought expedient by the said lords of the articles that they request to purchase and obtain such friendships, liberties and freedoms for the common benefit of this realm and profit of the course of trade and such things as shall be seen [as] profitable by the lords of the king's secret council, that therefore the body of the parliament has committed power to the chancellor and secret council to make the instructions and advice for such requests as they think expedient for the good of the king, his realm and lieges, which shall be done by the king and in the name of the whole body of his parliament.

Item, because the lords of articles understand that it is justly expedient and necessary that an embassy be sent to [John], king of Denmark for the renewal of the alliances and confirmation of the confederation between our sovereign lord, his realm and lieges and the said king of Denmark, his realm and subjects of the same, and to remove and get rid of all aloofness and displeasure conceived by any of the princes for any past cause, for the persons to be sent it is advised and thought expedient that a lord, a knight and a clerk, to the number of 20 persons, be sent, and to have the sum of £300 for their expenses, to be raised from the three estates, that is to say £100 from each estate. And that now before they depart the lords find a way how this sum will be brought in in all possible haste, as the said embassy must make its journey in this next month of March because of the time of year.

Item, as touching the article of the king's property for the honourable maintenance and keeping of his house in accordance with his estate and honour, which cannot be failed without great loss to his noble estate, it is considered by the said lords of articles that as all the lords spiritual and temporal and his other loyal lieges should above all singular and particular profit desire to offer the noble estates of his excellence, just as was done during the time of his most noble predecessors of good memory, for this reason it is thought necessary, reasonable and expedient, and also decreed and ordained in this present parliament, that full abrogation, voiding and annulment be made of all gifts, donations, infeftments, feu fermes, fees, life rents given by his highness to whichever person or persons since the day of his coronation, so that all lands, rents, customs, burgh mails, fermes, marts, mutton, poultry, arriage, carriage and other duties that were in the hands and possession of [James III], his progenitor and father, whom God absolve, the day of his death, despite whichever assignation or gift was made thereupon under the great seal, privy seal or other, is to be totally void and null, so that the whole rents and profits from them can come to our sovereign lord for the honourable maintenance of his house and noble estates as is said. And where there are any fees or duties to be given to officers, wardens and others like that who received fees during his father's and grandfather's times, that the same fees be paid to them in money by the hands of his receivers and comptrollers, and that they take no duties from the king's own lands for any assignation made to them, and that all their aforenoted lands, rents and fermes remain with the king in this way until he reaches 21 years of age, despite any gifts made previously in contradiction to this.

Item, regarding the provision and ordinance to be made for the honourable maintenance and ruling of my lords [James Stewart], duke of Ross and [John Stewart], earl of Mar, our sovereign lord's brothers, who are of young age and in the king's governance and keeping, it is seen [as] expedient that they be honourably maintained and governed in dignity and honour according to their noble estates, and be maintained and kept from their own rents, which the lords understand is sufficient and of [adequate] value to maintain them. And where their rents, mails, fermes and other duties are withheld and not brought in for their profit, the lords and estates advise the same direction and way to be taken for them as is ordained for the king's property and bringing in of the same, that is to say, that these undernoted lords who are of authority and power in the parts where their lands lie are to raise and bring in their rents and properties, just as is planned for the king's, which lords are specified and named below for bringing in our sovereign lord's duties and theirs. And where any thing or part of their lands, rents, mails or fermes are given away by the king after the time of their infeftment, that they are to be void, revoked and null in this present parliament, and to remain with them until they are [of] mature age, just as is provided for the king's highness as is said, and these are the said lords' names.

And as touching the observation and keeping of the truce made with [Henry VII], king of England, it is thought profitable by the said lords of articles that our sovereign lord make his wardens and lieutenants observe and keep days of truce as often as necessary for the observation of the said truce during the time of the same, so that his highness and lieges can have the same observed for them from the party from England, and that the wardens hold their courts and punish trespassers for the good of the country and stopping of such trespassers.

The lords of the articles think it expedient, and it is decreed and ordained in this present parliament, that an account and reckoning be made of all the king's officers, his treasurers and comptrollers both old and new from [James III], our sovereign lord's father's time, and now of our current sovereign lord's time, and that auditors be chosen and appointed by the advice and authority of this parliament to hear and understand the said accounts, and that the said auditors be commissioned for this with the consent of the three estates; and these are the names thought expedient by the said estates to be auditors of the said accounts, that is to say:

And for the more certain support [and] speeding up of justice, it is advised and seen expedient that the said council now chosen in this present parliament be sworn in the presence of the king and his three estates to give his highness loyal counsel in all matters concerning his majesty and realm, and to remain on his council until the time of the next parliament, and be responsible and accountable to the king and his estates for their counsel, and our sovereign lord has humbled his highness to promise and grant in parliament to abide and remain by their counsel until the next parliament as is said. And to eschew all circumventions and deceits that have been done to the king's highness by bringing various warrants, infeftments, donations, gifts, conducts, remissions and other such letters [which] hurt or injure the king in his casualty or property, in order to exclude the same his highness has granted and consented by that authority of this present parliament that no such gifts, warrants, remissions, conducts and letters shall pass in the future without the advice and consent of the lords of the secret council. And all such letters [are] to be signed by the king and as many of the said council as will be present at the time to the number of 6 persons at least sitting together in council, the chancellor being one. And if any such letters are given without their consent in other ways, that the said letters will be of no value, force or effect and will have no strength. And that the chancellor, privy seal and secretary will not answer any other letters except those which are signed as is said by the said lords of council. And similarly the king is to be ruled and governed by their counsels in the disbursing and giving of silver vessels, chains, jewels and other accessories pertaining to his most noble person from his treasury. And this manner of doing [things is to] be kept and observed until the time of the next parliament.

Item, as touching the article of goldsmiths, who debase and make false mixtures of bad metal, corrupting the fine metal of gold and silver, deceiving our sovereign lord and his lieges who have them create pieces in gold and silver, for the remedy and eschewing of the same, it is now advised and concluded that goldsmiths shall not make mixtures or put false alloys in the said metals. And in order to know the fineness of the said pieces, each goldsmith is to have a special mark or sign to be put on the said pieces which he makes, and the same work [is to] be of [equal] fineness as the new silver work from Bruges, and there is to be a deacon of craft of goldsmiths who will examine the said work and its fineness and ascertain that it is as good as the said work from Bruges, and after that the said deacon is to put his mark and sign on the said work, and [he is] to answer for it with his life and goods. And as touching gold work, it is to be made as fine as it is first molten in the presence of the owner, just as the feel and test given to him when it is first smelted and no less, and [it is] to be delivered in the presence of the said deacon so that the king's lieges will not be deceived and so that it retains the fineness as is said.

Item, regarding the act of sailing of merchants which was made previously, that the same act be now observed and kept by the merchants in the future. And similarly regarding the importing of bullion, that the act made for it be kept and given swift execution, and that the auditors of this exchequer and all others in the future make an account of the importing of the said bullion since the time of our sovereign lord, just as is contained at greater length in other acts made for it, and that the said account be made according to the quantity of goods that is returned. And as regards the sailing of the merchants, that the provosts, aldermen and bailies of burghs make diligent investigation and inspection of sailors in winter from All Hallows Eve [31 October] until Candlemas [2 February], and have fines for the king raised on those who break this [act], under the pain of £10 to be taken from the said officers who are negligent in this for each person who sails that goes unpunished in their fault.

Item, regarding the cruives and fish yairs which destroy the fry of fish and hurt the common profit of the realm, it is decreed and ordained that the acts and statutes made previously shall be observed and kept, with this addition: that letters be written to all sheriffs, bailies and stewards to destroy, tear down and remove all the said cruives within their bounds, immediately [and] without any delay, and that dittay be taken of those who have cruives in contradiction to the said act, and to pay £5 for each cruive as a fine in the justice ayre, to be raised on the maker and upholder of the same. And similarly that the sheriff who does not destroy the said cruives within 40 days after this parliament, the sheriff who fails is to be fined £20 to the king in the justice ayre, and to be a point of dittay as is said. And regarding the cruives set in fresh waters, that they must not stand during the forbidden time, and they must always allow the midstream to be free for the distance of 5 feet. And that the Saturday slop [is to] be observed and kept, as required by the act and statute made by King David. And that each bar of the said cruives be 5 inches wide according to the same statute. And for millers who set creels and nets in dams and water ways, destroying red fish and fish fry as is said, it shall be a point of dittay and the pain [for] both the cruives and the creels and nets of millers, each one to be as [for] a fine of red fish to be raised and taken from those who act against [the act]. And that letters be written as is said to the sheriffs, stewards and bailies to put this act into execution and see that the same is observed and kept, under the pain of £20 to be raised from the officer who fails as is said. And as touching the slaughter of red fish, that it be punished according to the form of the statutes, declaring the fine for it to be £10.

Item, regarding the article of the matter of money, it is thought expedient by the lords of articles, and also decreed in this present parliament, that a loyal [and] reputable man be made master of the money and mint, who shall forge and print money and coins to serve all the king's lieges, and that the coins shall be like this: a groat [is] to have course and go for 14d and ten of them will make up an ounce and will be of the same fineness as the Edward goat of England; and that the said minter shall give and pay 11s 6d for an ounce of burnt silver, and the same for Paris silver and silver of the new work from Bruges; and as for the silver work from this realm that is brought to the mint which is not as fine, the said minter shall give and deliver for that the exact value to the owner of the said silver and as far as it is inferior to Paris silver or silver of the new work from Bruges is to be deducted and reduced in the price of the said silver. And if the said minter and the seller of the said silver work cannot agree on a price, two loyal goldsmiths sworn on their great oaths shall see and examine the said silver work [for] its value and declare what it is worth per ounce, from which assessment and price the minter, owner and seller of the said silver work shall be contented. And to know that the said coin retains the [same] weight and fineness as the Edward groat, this said coin shall have a sign and token made in printing, which is different from the first coin, and if any of the new groats are found lacking in weight and fineness from the said Edward groat, the minter [is] to be punished for that and forfeit his life and goods and to be examined and seen at the next parliament, and sooner if it pleases the king. And because it is bemoaned to our sovereign that his gold and silver minted in his realm is refused by ignorant person, when the said gold and silver contains any cracks, flaws or is soldered, it is ordained that the said gold and silver be received by all the king's lieges so that it retains the weight and is good and genuine metal, even if it has cracks, flaws or soldering as is said in all times to come.

Also because it was bemoaned and complained by our sovereign lord's lieges dwelling in the bounds of Galloway that certain gentlemen chiefs of kin in Galloway who habitually took cawps, for which taking and exaction our sovereign lord and his three estates saw no profit or reasonable cause, therefore his highness, with the advice of his last parliament, appointed, warned and charged all persons who claimed, or alleged, to take, raise or intromit with any such exactions of cawps to come to the next parliament and there exhibit and show what right they had to take the same. And now in this present parliament, the said persons making the said claims have been often called to exhibit and show their rights as is said but no-one has compeared or shown any right or title to raise and take the said cawps, for this reason our sovereign lord, willing and intending to exclude and get rid of all such abuses, bad practises and extortions [which are] placed on his people and lieges without reasonable cause, has by the authority of this parliament ordained that the taking of the said cawps is to be stopped and abandoned in the future, and no man of the king's lieges is to tax them under the pain of being punished as for robbery, and in the future [it will] always be a point of dittay in the justice ayres.

Item, it is thought expedient that because there was a statute made in our current sovereign lord's parliament held at Edinburgh on Wednesday 8 October 1488 declaring all alienations of lands, inheritances, long tacks, feu fermes, offices, tailzies, blench fermes, lands made of ward, to be of no value after 2 February, which was the day our current sovereign lord came out of Stirling for the coronation of our sovereign lord's highness made by [James III], his father, of most noble memory, was made of no value, force or effect for certain causes contained in the said act and statute, that therefore all those who received the supposed gifts of alienation, inheritance, long tacks, feu fermes, offices, tailzies, giving of blench ferme, of ward lands, should bring their letters and evidence granted for this to our sovereign lord within 40 days to be destroyed, warning those who do not bring [them in] that the king will make pains to be specially called and punished for their disobedience.
