Judicial proceedings: acts of the lords auditors of causes and complaints

In the presence of [Colin Campbell, earl of Argyll], chancellor, and [the] lords of council Thomas Fotheringham of Powrie compeared and renounced and handed over all rights and claims of right to Andrew Wood which he had or might have to the office of chamberlainship of Fettercairn in the same way as he previously handed over the office of bailiary for the said lands, and as concerning the tacks that he had of a part of the said lands he put them at the said Andrew's disposal.

The same day after noon

The lords auditors decree and deliver that James of Dunbar of Cumnock shall content and pay Elizabeth [Livingston], countess of Ross the sum of 736 merks usual money of the realm owed to her by the said James for the mails of the lands of Ross which he has in lease from her for past terms, as was proven by his obligation under his seal and signature shown and produced before the lords. And also [they] determine and declare the letters of tack made to the said James for the said lands [to be] of no value, force or effect in the future because he failed to pay the said mails at the terms contained in the said obligation according to the form of the same, and ordain our sovereign lord's letters be directed to distrenzie him of his lands and goods for this, and the said James was lawfully summoned to this action, often called but did not compear.

The lords auditors decree and deliver that John [Hay], lord Hay of Yester shall content and pay Henry [Abercrombie], abbot of Cambuskenneth 20 horses each priced 4 merks, 4 horses each priced 4 merks, and 40s for damage and injuries sustained by the said venerable father by the breaking of his stable-doors and windows, which goods were spulzied and taken by the said John, lord Hay and his accomplices from the place, ward and west grange of Cambuskenneth, as was sufficiently proven before the lords and admitted by the said John, lord Hay that he was at the said place of Cambuskenneth [at] the said time, and ordain our sovereign lord's letters be directed to distrenzie him of his lands and goods for this, and if there are any persons who he is pleased to call as party with him that he is to have them called.
