In the action and cause pursued by our sovereign lord against James [Stewart], earl of Buchan, Andrew [Gray], lord Gray and Thomas [Erskine], lord Erskine for the wrongful withholding from his highness of the sum of 10,000 merks usual money of the realm, for fault of entry of Andrew [Stewart], bishop of Moray to John [Drummond], lord Drummond, within 8 days after they were charged and warned for that †to have come with the said John, lord Drummond to our sovereign lord and after the form of their obligation, all the said parties being present in person, their rights, reasons and allegations seen, heard and understood at length, the lords decree and deliver that the said James, earl of Buchan, Andrew, lord Gray and Thomas, lord Erskine shall content and pay the said sum of 10,000 merks usual money of the realm to our sovereign lord for the fault of non-entry of the said Andrew, bishop of Moray to the said Lord Drummond to have come to our said sovereign lord, just as they were bound by their obligation under their seals and signature shown and produced before the lords, and the said James, earl of Buchan [is] to warrant the said Thomas, lord Erskine regarding the said sum just as he agreed in the presence of the lords to warrant him,† and reserving to the said Thomas his action regarding †the warrandice that he alleges David Bruce of Clackmannan should release him concerning the said sum, and ordain that letters be written to distrenzie them of their lands and goods for this.
