The action and cause pursued by Margaret, lady Torrie, on the one part, against Lyon of Logie of Logiealmond, Andrew MacKay, Patrick Murdoson, Finlay Farquharson, Duncan Mancow and the rest of the persons contained in the summons, on the other part, for the wrongful occupation and manuring of the mains of Logie, and for the wrongful setting of the rest of the lands of Logie to the said persons, and for the collection of the mails, grassums and other profits from the said lands, as is contained in the said summons, which lands pertain to the said Margaret through a tack made to her by the said Lyon of Logie, as is alleged, is continued by the lords until 4 May next, with continuation of days. And because it is alleged by the said Lyon of Logy that [he] was compelled and constrained to make the said letter of tack for the said Margaret, and that he was not at liberty and free but in custody and captivity at the time it was made which is dated 4 May 1478, and immediately when he was free [he] revoked the said tack, the lords auditors appoint the said 4 May next, with continuation of days, for the said Lyon of Logie to prove that he was compelled and constrained by dread and fear, which might fail in a steadfast man, and by which compulsion he was compelled to make the said tack, and ordain that the persons who were now summoned but did not compear be summoned to compear on the said day under pain of personal imprisonment, and both parties are summoned according to the act, and ordain the said Lyon of Logie to have letters to summon his witnesses and the witnesses that were now summoned under pain of personal imprisonment be summoned to compear on the said day, under pain of rebellion because they did not compear now.
