Judicial proceedings: acts of the lords auditors of causes and complaints

On 15 October, for deciding the causes and quarrels, [Andrew Gray], lord Gray and Master John Lyon were elected by the parliament in the absence of [Henry Abercrombie], abbot of Cambuskenneth and Alexander Fowlis.

The action and cause pursued by William Ayson against Duncan Toischeach for the wrongful occupation and withholding from him of the lands of Pettenny, and for the collection of the mails of the same lands for the past 8 years, as was alleged, both the said parties being present, the said William Ayson produced a charter of heritage of the said lands from our sovereign lord, and the said Duncan Toischeach [produced] a letter of feu-ferme under the seal of the said William's father and thereby alleged the said lands were heritage to him, excepting therefore that it should not remain before the lords, is continued by the lords auditors until 9 February next, with continuation of days, and [the lords] appoint the said day for the said Duncan to prove his lawful possession of the said lands, and both parties are summoned according to the act.
