The lords auditors decree and deliver that John of Crichton, Robert of Crichton and William of Howden shall restore and return to Master Thomas of Borthwick 100 wethers and ewes, priced 6s 8d each, and 40 hogs, priced 3s 4d each, which goods the said persons spulzied and took from the mains of Ketk, as was clearly proven before the lords, and ordain that letters be written to distrenzie them of their lands and goods for that, and the said persons were summoned to this action but did not compear.

The lords auditors decree and deliver that William [Crichton], lord Crichton shall restore and return to William of Newton, William Thomson, John Dickson, Janet Lukeup, John Purcell, James Purcell John Thomson and James Miller, tenants of the town of Little Preston, 40 cows and oxen, priced 30s each, 100 ewes, priced 6s 8d each, 40 hogs, priced 4s each, 8 horses and mares, priced 5 crowns each, 4 bolls of meal, priced 12s per boll, and 4 bolls of barley, priced 14s 4d per boll, which goods were and taken by the said Lord Crichton from the said tenants from the said town of Preston, as was clearly proven before the lords, and ordain that letters be written to distrenzie him of his lands and goods for the said goods and sums noted above.

The lords decree and deliver that William [Crichton], lord Crichton shall restore and return to William [Borthwick], lord Borthwick 460 wethers and ewes, priced 6s 8d each, 6 oxen, priced 30s each, a chalder of oats, priced 6s 8d per boll, 320 hogs, each priced 40d, and 60 capons, each priced 12d, which aforesaid goods were taken by the said William, lord Crichton from the said Lord Borthwick from the places of Torcraik and Catcune, as was clearly proven before the lords, and ordain that letters be written to distrenzie him of his lands and goods for this.

The lords auditors decree and deliver [that] John Page shall restore and return to Thomas Simpson, sheriff of Fife, 10 oxen, each priced 30s, which he spulzied and took from the place of Pitgorno pertaining to the said Thomas Simpson as was clearly proven before the lords, and ordain that letters be written to distrenzie him of his lands and goods for this, and if it pleases the said John to call any persons to relieve him of the said goods, he is to call them and he shall have justice.

The lords auditors decree and deliver that Robert of Crichton, John of Crichton, William Haldane, Patrick Robinson, John Wilson and Gilbert of Crichton shall restore and return to William Hogg of Vigarushalh 200 ewes, priced 6s 8d each, 40 wethers, priced 6s 8d each, and 100 hogs, priced 3s 4d each, which goods were spulzied and taken by the aforesaid persons from the said William Hogg from the mains of Nether Keith, as was clearly proven before the said lords, and ordain that letters be written to distrenzie them of their lands and goods for the aforesaid sums and goods.

The lords auditors decree and deliver that Adam Muir of Caldwell shall satisfy and pay Robert [Lyle], lord Lyle the sum of 37 merks of the rest of the payment of the last 100 merks, as is contained in certain indentures made between them thereupon, and ordain that letters be written to distrenzie him of his lands and goods for this.

The lords auditors decree and deliver that Sir Laurence Mercer shall satisfy and pay a reverend father in God Andrew [Cavers], abbot of Lindores the sum of £20 of the usual money of the realm, which sum the said Sir Laurence owed to the said reverend father for lent silver, as was clearly proven before the lords, and ordain that letters be written to distrenzie him of his lands and goods for this.

Master Richard Lawson, procurator for William [Abernethy], lord Abernethy, compeared before the lords auditors and protested that because John Oliphant of the Dron caused him to be summoned but would not compear to pursue him, that therefore he shall not be heard against him in judgement until he has paid his costs and expenses and until new summons [are issued for him].

In the action and cause contested between [Robert Kerr], abbot, and the convent of Kelso, on the one part, and Steven Lockhart, on the other part, regarding the right of the ferry boat of the Cross-Ford of Clyde, it was previously continued and a charge ordained for the sheriff to investigate the possession of the use of the said boat and retoured again closed, that the said abbot and convent and the house of Lesmahagow had use of the said ferry boat for the period of the past 14 years, and the said Steven for 6 years since the said 14 years, and his predecessors for 90 years before the same 14 years, and the said Steven showed his predecessors' retour, which he was ordained to bring by the said continuance, that showed that they had right and privilege to a ferry boat at the said Cross-Ford of Clyde, the lords auditors decree and deliver that the said Steven Lockhart shall use and enjoy the ferry boat at the said Cross-Ford of Clyde according to the form of the said retour, and just as was contained in the investigation of the said retour, the said abbot and convent being often called but not compearing, and that our sovereign lord's letters be directed for this etc.

After noon

The lords auditors appoint 9 February next, with continuation of days, for William of Crichton to prove that the inhabitants and parishioners of the parish of Buttergill wrongfully withheld from the said William the offerings, teinds and fruits of the said church, and ordain him to have letters to summon their witnesses, and the parties are summoned themselves and their procurators according to the act.

In the action and cause pursued by Sir James Ogilvy of Airlie, knight, against Margaret [Ogilvy], countess of Buchan, regarding the said Margaret's entry to the superiority of the lands of Conveth and Auchengray according to the form of the act of parliament, the said Margaret being charged to have entered to the said superiority by our sovereign lord's letters many times, and to have shown the reason why she did not enter, under the pains contained in the said act, she being lawfully summoned and often called but not compearing, the lords auditors counsel our sovereign lord to cause the said Sir James to be entered into the said lands according to the form of the said act of parliament, because she neither entered nor compeared to show any reason why she would not enter, and ordain that the said Sir James have letters for this in due form.

The lords decree and deliver that David Simpson, Alexander Howison shall satisfy and pay Sir William of Knollis, preceptor of Torphichen, the sum of £10 groat, and the said David, Alexander Howison and Alexander Reid the sum of £10 groat, and Robert Pret £12 groat of Flanders money as was shown by their obligations previously produced, and alleged by the procurators of the said persons that the said sums were previously paid to Master James Lindsay as factor to the late Thomas [Spens], bishop of Aberdeen, of good memory, and [he] failed in his proof on the day appointed for him, and that letters be given to distrenzie them of their lands and goods for the said sums.
