Judicial proceedings: acts of the lords auditors of causes and complaints

James Stewart and Master John Stewart have protested in the presence of the lords auditors that, because William Stewart of Castlemilk summoned them to his suit, concerning the wrongful occupation of the lands of Gallowhill and Windlaw but would not pursue or continue against them in the said action, therefore the said William shall not be heard in judgement with regard to the said cause until they are contented for their expenses and costs and until they are newly summoned.

The summons made and executed for Robert [Fleming], lord Fleming, and Malcolm Fleming, his son, regarding certain actions and crimes contained in the same, is continued by our sovereign lord, [and] the said Robert, lord Fleming is to be present on 8 May next, with the same force, strength and effect in all points and articles according to the form of the said summons.

In the action and cause between Master Nicol of Touris on the one part and Gabriel of Touris on the other part with both their consent and with the consent of William of Touris, son of the said Gabriel, the said persons being present in person, the lords auditors deliver and ordain that the said William of Touris shall give a new reversion to the said Master Nicol in this form, that is to say that the time the said Master Nicol, his heirs or assignees pay on a day in St Giles church within the burgh of Edinburgh.
