Judicial proceedings: acts of the lords auditors of causes and complaints

In the afternoon [John Balfour], bishop of Brechin, [William Keith], lord Marischal, [Robert Lyle], lord Lyle, [John Drummond], lord Stobhall and James Shaw sat

The lords auditors of causes and complaints decree and deliver that Hugh Kennedy shall satisfy and pay Simon of Carruthers £20 for his costs and expenses incurred at various times and ordain that letters be written to distrenzie him of his lands and goods for this.

By consent of the parties

In the action and cause pursued by David Hay of Locherworth, knight, on the one part, against Dougal MacDowall of Makerstoun, on the other part, for the wrongful occupation and detention of Morham castle for the last two years, both the said parties being present and their reason, evidence, rights and allegations and in particular an indenture seen, heard and understood at length, the lords auditors decree and deliver that the said Dougal shall deliver the said Morham castle and land to Sir William Hay of Morham, and that the said Sir William shall release and hand over to the said Dougal the lands of Linplum, Baro and Duncanlaw as free as they were at the time they were set to him according to the tenor of their indentures, to which both parties consented in the presence of the lords auditors.

In the presence of the lords auditors Dougal MacDowall of Makerstoun charged and asked Sir William Hay to come and receive Morham castle on the Friday before Whitsunday [29 May], for which the said Dougal requested an instrument.
