Judicial proceedings: acts of the lords auditors of causes and complaints

The lords auditors of complaints deliver that Walter Stewart of Morphie, George Stewart, Malise Kerr of Monzie and Patrick Cranby shall restore and return two mares and a foal to Ninian Bonar and Robert Bonar, tutor to Ninian and Malise Mortgrunn, son of John Maleson, and to the tenants of the lands of Monzie. And if the said Walter, George, Malise and Patrick have anything to say about the said goods, that they pursue them lawfully as is fitting and that letters be written to distrenzie them of their lands and goods for the restoring of the same.

The lords auditors decree and deliver that John Dickson, Thomas Dickson, Robert Dickson and Thomas of Stanehope shall return to Christian Lockhart and William Tailifer, her son, the ox which they took from her from the lands of Dolphinston as a hereyeld and they declare that she did not owe them hereyeld nor did they have any reason thereto, and the said persons were to be fined 40s and half a merk for the expenses of the party.

The lords decree and deliver that Thomas Turnbull of Fowlishope shall satisfy and pay Thomas Folkart two sacks of good wool without matted wool or tar, for which he is bound to the said Thomas by his obligation as shown and produced before the lords, and ordain that letters be written to distrenzie him of his lands and goods for this.

In the action and cause pursued by the deacon and craftsmen of the skinner craft of the burgh of Perth, on the one part, against James Scott, burgess of Perth, on the other part, touching the warrandices of an annual rent of 15s and 4d owed from the lands of the late [...] lying in the said burgh of Perth and which annual rent was sold by the said James to the said deacon and craftsmen by charter and sasine with clauses of warrandice as was alleged, the said James, being lawfully and peremptorily summoned and often called but not compearing either by himself or through his procurators, the evidence, rights, reasons and allegations shown by the procurators of the said deacon and craftsmen and especially the said James' charter under his seal [being] seen, heard and understood at length, the lords auditors of complaints decree and deliver that the said James Scott shall warrant to the said deacon and craftsmen of skinners of Perth the said 15s and 4d of annual rent according to the form and tenor of his charter made thereupon, and ordain that letters be written to the elderman and bailies of Perth to compel him to [distrenzie] his lands and goods thereto.
