Judicial proceedings: acts of the lords auditors of causes and complaints

8 May 1471, third day of parliament

The lords decree, deliver and ordain that Robert Charteris of Amisfield shall give and deliver a letter of reversion to Walter Porter of Duchray in due form under his seal of the lands of Blakate, Achinreoch and Barholm according to the form and tenor of the reversion given to him by our sovereign lord and the laird of Cardoness, and of the same sums contained in the reversions like as were decreed, delivered and ordained by the lords of council of before, and that he shall [either] give the said reversion or leave this town under the pain of warding of his person, and the said Robert to have regress again to our sovereign lord if he had given him any larger sum than was owed to his highness.

The cause between the countess of Erroll and Slains pursuivant, James Adamson and David Seton is continued until 25 May, with continuation of days, without prejudice of party in the same form as it now is.

The lords auditors of complaints chosen by the three estates in the parliament decree and deliver that the action and cause pursued by [John Ramsay], abbot, and the convent of Lindores on the one part, against Philip Mowbray of Barnbougle, David Mowbray, his nephew, and Isobel Stewart, the mother of the said David, on the other part, concerning the wrongful occupation, detention and withholding of half the lands of Easter Craigie, ought not to resort nor be determined before them because it is fee and heritage.

In the action and cause pursued by John of Blackburn, on the one part, against Thomas Sibbald, on the other part, concerning the spoliation of four oxen from the lands of Spencerfield, and concerning the tack of the same claimed by the said John to pertain to him by the tack made to him through the tack of the late Alexander Thane, and for foremail, both the said parties being personally present and their evidence, rights, reasons and allegations, proofs and witnesses seen, heard and understood at length, the lords auditors, fully advised, decree and deliver that the said John of Blackburn shall use and enjoy the tack of the said lands of Spencerfield for the terms contained in the said letter of tack made to him by the said Alexander Thane, and mail free for the foremail paid by him to the said Alexander Thane, according to the form and tenor of the same letter, and if the said four oxen are not yet restored, as the lords of council ordained previously, the lords auditors ordain them now to be restored.
