Ratification in favour of Robert Hamilton of Pressmennan

Our sovereign lord, with advice and consent of his majesty's estates of parliament, of this his kingdom of Scotland, taking to their consideration the good, true and faithful service done to his majesty and his predecessors in time past by his beloved Robert Hamilton of Pressmennan, advocate, and for his sad sufferings at Preston and Worcester, has ratified, approved and confirmed and, by this act, ratifies, approves and confirms the charter, under his majesty's great seal of this kingdom, of the date at Whitehall, 25 April 1681, proceeding upon a signature subscribed by his majesty, of the date thereof, whereby our said sovereign lord, with advice and consent of the lords commissioners of his majesty's treasury and exchequer, gave, granted and conveyed to the said Robert Hamilton of Pressmennan, and failing of him by decease to James Hamilton, his second lawful son, and to the male heirs lawfully to be procreated of his body, which failing to any person or persons the said Robert shall design at any time during his lifetime, in sickness or health, although in death bed, and failing of such designation, to the said Robert Hamilton his own nearest lawful heirs or assignees whatsoever, heritably and irredeemably, in manner mentioned in the said charter, all and whole the town and lands of Goslington, extending to a five merk land of old extent and four merk land of Tweedie and Tweedieside, with the mill, mill-lands and sequels of the same, with these parts and portions of the muir of Stenhouse, adjacent and pertaining thereto, with all and sundry houses, biggings, yards, outsets, insets, mosses, muirs, meadows, parts, pendicles and whole pertinents of the same whatsoever, all lying within the parish of Stenhouse and sheriffdom of Lanark. As also, his majesty, for the causes therein specified, did of new again give and convey to the said Robert Hamilton, and his said son and their foresaids, the whole lands and others above-written, and did unite and incorporate the same, that a sasine now to be taken upon the lands of Goslington, or others foresaid or on any part thereof, which should be as valid as if particular sasines were taken in the said whole particular lands and others foresaid, to be held of our sovereign lord in taxed ward, in manner mentioned in the said charter, whereby also our said sovereign lord, of his certain knowledge and proper motive, considering that the said lands were formerly held by the said Robert Hamilton and Sir Robert Hamilton of Silvertonhill, his author thereof, in simple ward, did for the onerous causes therein specified, tax and restrict the ward, non-entry, relief and marriage of the said lands and others foresaid, with the whole benefit and advantage accruing thereby, for payment of the tax duties following, namely: the sum of £60 Scots for the ward and non-entry of the said lands, or any of them, yearly to be paid to his majesty and his successors, during the space of the said ward or non-entry, at two terms in the year Whitsunday [May/June] and Martinmas [11 November] by equal portions, as also, for payment of the sum of £120 Scots for the marriage of the heir or heirs of the said Robert and James Hamilton, and their assignees succeeding in the said lands, as often as the same shall fall and no further, with £60 for relief of the said lands when the same shall fall, together with the precept of sasine contained in the said charter, and whole other clauses and conditions therein specified, and instrument of sasine following or that may follow thereupon, with all other writs, evidents, rights, titles and securities made and granted to the said Robert or to any of his predecessors or authors of or concerning the said lands, in all and sundry heads, points, articles and clauses therein contained, and after the form and tenor thereof. And our sovereign lord, with advice and consent of his estates of parliament, statutes and ordains that this present ratification of the foresaid charter, precept of sasine therein specified, and others above-written, is and shall be as valid, effectual and sufficient as if the same charter, precept of sasine and others foresaid were at length herein inserted, dispensing by these words with the not inserting thereof in this act of ratification. Likewise his majesty, with advice and consent foresaid, wills, grants and ordains the lands, mill, mill-lands and others above-specified, in all time coming, to be held of his majesty and his successors by the said Robert Hamilton, his said son and their foresaids, in taxed ward for yearly payment of the tax duties above-written and tax value of the marriage above-specified, notwithstanding that the lands and others above-rehearsed were formerly otherwise held, and finds, declares, statutes and ordains that the foresaid charter and precept of sasine, with the whole other rights and securities made to the said Sir Robert and Robert Hamilton their predecessors and authors of the said lands, and others foresaid, shall be sufficient and valid rights and securities for bruiking and enjoying the same lands and others foresaid in all time coming, to be held of his majesty and his successors in taxed ward, in manner above-rehearsed.
