Our sovereign lord, with advice and consent of the estates of parliament now presently convened, ratifies and approves and, for his highness and his successors, perpetually confirms the gift, tack and assedation made and granted by his said majesty to Alexander, earl of Kellie etc., his heirs and assignees, of all and whole the mails, ferms, feu duties, found duties, kanes, customs, casualties, services and other duties due and payable to his majesty furth of the lands of Kingsbarns and pertinents thereof, lying within the parish of Kingsbarns and sheriffdom of Fife, by the heritors, tenants and possessors thereof, or to the deceased Sir James Scott of Rossie, or his assignees, then tacksmen of the said rents and duties, and that for all the days, years and space of three nineteen years next, and immediately after his entry thereto, of the which gift, tack and assedation the tenor follows:
Charles, by the grace of God, king of Great Britain, France and Ireland, defender of the faith, to the lords of our council and session, and to all and sundry our lieges and subjects whom it pertains, to whose knowledge this letter shall come, greetings. Forasmuch as we, considering the good, true and faithful service done to our royal father, of blessed memory, and to ourself in the late troublesome times, by our trusty and well beloved cousin Alexander, earl of Kellie, and also the great prejudice, cost and damage sustained by the said earl thereby, therefore, we, with advice and consent of our treasurers principal and depute and remaining lords of our exchequer within our ancient kingdom of Scotland, to have given, granted and in tack and assedation let, likewise we, with consent foresaid, by these our letters, give, grant and in tack and assedation let, to and in favour of the said Alexander, earl of Kellie, his heirs and assignees, all and whole the mail ferms, feu duties, found duties, kanes, customs, casualties, services and others due and payable to us furth of our lands of Kingsbarns, lying within the parish of Kingsbarns and our sheriffdom of Fife, by the heritors, tenants and possessors thereof, or to Sir James Scott of Rossie, or his assignees, present tacksmen of the said rents and duties, and that for all the days, years and space of three nineteen years next, and immediately after the said Alexander, earl of Kellie's entry thereto, which is to begin at the next term of payment of the said duties immediately that shall follow the death of the said Sir James Scott, when the same shall happen, and thenceforth to continue until the said three nineteen years are completely outrun, with power to the said Alexander, earl of Kellie and his foresaids, to ask, crave, receive and uplift the said duties from the persons due in payment thereof, to give acquittances and discharges thereupon, which shall be as valid to the receivers as if the same were given by us with consent of our said treasurers principal and depute and remaining lords of our said exchequer, call and pursue thereof likewise and as freely, in all respects, as any other tacksmen within our said kingdom of Scotland, commanding hereby you, the said lords of our council and session, to grant letters of horning upon a charge of six days, commanding the persons due in payment to answer and obey the said Alexander, earl of Kellie and his foresaids, and make ready payment to them of the said duties, the said earl paying yearly in to our said exchequer or receivers of our rents, the same tack duty which the said Sir James Scott paid, at two terms in the year Whitsunday [May/June] and Martinmas [11 November], by equal portions, as for the present tack duty and all other duties payable by the said Alexander, earl of Kellie, for the tack and assedation foresaid, given under our privy seal, at our court of Whitehall, 28 August the year of God 1660, and of our reign the twelfth year, in all and sundry the heads, points, clauses, articles, circumstances and conditions contained in the said gift, tack and assedation, and after the form and tenor thereof in all points.
