To the right honourable his grace, [John Middleton], earl of Middleton, his majesty's high commissioner, and estates of parliament, the petition of Elizabeth Nicolson, widow of the deceased Doctor James Sibbald, sometime minister of the gospel at Aberdeen.
Humbly shows,
That whereas your grace and estates of parliament by an act and ordinance of the date at Edinburgh 21 June 1661, upon consideration of the great sufferings of the said deceased Doctor James Sibbald, your petitioner's husband, by deprivation from his place in the ministry and banishment from his country so that he died in exile for his constant loyalty to his majesty and adherence to the true government and discipline of the church of Scotland, did modify and ordain the sum of £200 sterling to be paid to your petitioner for herself and in name and on behalf of her children out of the first and readiest of the vacant stipends, and ordained Mr John Wilkie, collector thereof, to make payment to her of the same accordingly, as the said act in itself at more length purports. Notwithstanding whereof the said Mr John Wilkie and his subcollectors being often required to make payment thereof, neither have given nor intend to give satisfaction of the same, although he has paid and satisfied several persons whom he was pleased to favour. It is therefore the humble supplication of your petitioner that your grace and estates of parliament may be pleased to allocate and ordain to be paid to me, your petitioner, in satisfaction and payment of the aforesaid precept, the vacant stipends of the kirks and benefices mentioned below, namely: Croy, Dores, Daviot and Glenmoriston, with their annexations in the presbytery of Inverness, and the kirk of Assin in the diocese of Caithness, for the crop and year of God 1662 and all preceding and following years if it shall happen any to be, until the aforesaid precept is satisfied; with full power to your petitioner, or any in her name having her order, to pursue thereof the discharges thereupon and to give, compose, transact and agree relating thereto, and raise letters of horning and poinding and to do all other diligence against the persons liable in payment, discharging all other collectors to meddle with any of the said vacancy until your petitioner is paid the said £200 sterling, together with all necessary charges for pursuing thereof, since the former collectors are wanting in their duty. And your petitioner shall ever pray.

The king's majesty and parliament appoint the petitioners to be paid out of the readiest of the vacant stipends of the kirks above-expressed in this petition.

Anent the petition given in to the lord commissioner's grace and lords of the articles by Elizabeth Nicolson, widow of the deceased Doctor James Sibbald, sometime minister of the gospel at Aberdeen. Making mention that where by an act and ordinance of this present parliament of the date 21 June 1661 the sum of £200 sterling was appointed to be paid to the said Elizabeth Nicolson for herself and in name and on behalf of Marjorie Sibbald, her daughter, upon consideration of the great sufferings of the said Doctor Sibbald for his affection and loyalty to his majesty, out of the first and readiest of the vacant stipends, and Mr John Wilkie, collector of the said vacant stipends, accordingly appointed to make payment of the same; notwithstanding whereof the said Mr John, though he has been often various times required, has made no payment or of any part of the same; and therefore craving that a locality might be assigned out of the first and readiest of the vacant stipends of the kirks of Croy, Dores, Daviot and Urquhart, with their annexations lying within the presbytery of Inverness, and the kirk of Assin lying within the presbytery of [...], for the more speedy and effectual payment of the aforesaid sum as the said petition in itself more fully bears. Which petition being by the king's majesty and estates of parliament heard and considered, our sovereign lord, with advice and consent of his estates of parliament, assigns and dispenses the first and readiest of the vacant stipends and benefices of the aforesaid kirks of Croy, Dores, Daviot and Urquhart, with their annexations and kirk of Assin, for payment to the said Elizabeth Nicolson and her said daughter of the said £200 sterling, and appoints Mr John Wilkie to grant precepts for that effect. And ordains letters of horning to be delivered at the instance of the said Elizabeth Nicolson upon the sight of this act and the said Mr John Wilkie's precept against the persons liable in payment of the said stipends; the said Elizabeth always finding caution to the said Mr John Wilkie that she shall intromit with no more of the said stipends than shall pay the aforesaid sum of £200 sterling, and to retain her diligence between now and 1 June 1663.
