Our soveraign lord, with the speciall advice and consent of his estates of parliament, ratifies, approves and confirmes to and in favours of his majesties' lovit Sir Patrick Houstoun of that ilk, knight, and his airs male, whilks failyieing to his nearest and laufull airs and assigneyes whatsomever, ane chartor made and granted by his majestie, under the great seale of this his ancient kingdome, of the date at Whitehall, the tuentie-thrid day of Februar jM vjC and seventie-one years, whereby his majestie, for himselfe and as prince and stewart of Scotland, with advice and consent of the lords and others commissioners of his majesties' exchequer, gave, granted and disponed and, for him and his royall successors, perpetually confirmed to the said Sir Patrick Houstoun, and his airs male and assigneyes abovespecified, heretablie and irredeemablie, without any maner of reversion, regress or redemption whatsomever, all and sundrie the lands, baronies and others underwritten, viz, all and haill the blensch ferme lands of Houstoun, commonly called Nether Maines, with the castle, tower, fortalice, mannor place, housses, biggings, orchyairds, woods and parks of Houstoun, the lands of Houstoun crofts, Henriestouns, Bodrieckfield, Graviswrayes, Houstoun heads, Barshegrie, Willingistoun, Williamstoun, Hall Craigs, Bullockstoun and Barlogan, with the milne, milne lands of Houstoun and multurs of the samen, extending in haill to ane tuenty-one pound, sex shilling and eight pennie land of old extent, with all and sundrie annexis, connexis, dependancies, pairts, pendicles and pertinents of the same; and siclike, all and haill the ward lands of Houstoun, alswell propertie as tennandrie, with tennents, tennendries and service of free tennents of the same, and all pertinents thereof, extending to a eighteen pund, thretteen shilling, four pennie land of old extent; and all and haill the four pound land of old extent of Easter and Wester Gairvocks, with pairts, pendicles and pertinents of the samen, all lyand within the baronie and shirefdome of Renfrew, of old united and incorporated in ane haill and free baronie called, and to be called in all time comeing, the baronie of Houstoun, and the tower, fortalice and mannor place of Houstoun ordained to be the principall messuage thereof, togither with the fishing be cruves or any other manner of way upon the water of Gryff, within the bounds of the foresaids lands, or any pairt thereof, conforme to use and wont, with the advocation, donation and right of patronage of the paroch kirk and parochin of Houstoun, teind sheaves and others, great and small, parsonage and viccarage teinds of the samen, fruits, rents, profites, emoluments and dewties of the same paroch and paroch kirk; and siclike, the tuelve pound land of old extent of Inchboigfyff and Houstounglen, now called Ballglass, with the mannor place, housses, biggings, orchyairds, milnes, milnelands, multures and sequells of the samen, annexis, connexis, pairts, pendicles and pertinents thereof, lyand within the shirefdome of Stirling; all and haill the halfe of the town and lands of Wester Whitburne, with the milnes, milnelands, multurs, tennants, tennandries and service of free tennents of the samen, pairts, pendicles and pertinents thereof, extending to ane fiftie shilling land, lyand within the shirefdome of Linlithgow; all and haill the halfe of the lands and baronie of Easter Whitburne, with the pertinents, the halfe of the lands of Litle Blackburne, with the pertinents and ane anwelrent of tuelve shilling[s] Scots money yearlie, to be uplifted and taken furth of the lands of Carribber, with all pairts, pendicles and pertinents thereof, lyand within the shirefdome of Linlithgow foresaid; as also, all and haill the ten pound land of old extent of Auchincloich, with the tower, fortalice, mannor place, housses, biggings, yairds, orchyairds, milnes, milnelands, multures, tennents, tennandries, service of free tennents, pairts, pendicles and pertinents of the samen, lyand within the shirefdome of Dumbartan, also of old united, erected and incorporated in ane haill and free baronie called, and to be called in all time comeing, the baronie of Balglass, and the mannor place of Balglass ordained to be the principall messuage of the said baronie, which chartor proceeds upon the said Sir Patrick Houstoun and William, earle of Dundonald and William, lord Cochran, his sone, their resignation in maner therein specified; whereby also, our said soveraign lord, for himselfe and his majesties' successors, princes and stewarts of Scotland (for the causes therein specified) of new gave, granted and disponed to the said Sir Patrick Houstoun, and his foresaids, all and haill the lands, baronies, milnes, woods, fishings, teinds, teind sheaves, right of patronage and uthers particularlie and generallie above exprest, with the pertinents lyand and resigned as said is, with all right, title, interest and clame of right whilk his majestie or his royall successors had or could pretend thereto, by reason of ward, releiff, nonentrie, mariage, escheit, forfaulture or any other maner of way, as is at more length specified in the said clause de novo damus therein contained; and als, the town and lands of Houstoun, with the tenements, cottages, housses, biggings and yairds thereof, is erected in ane burgh of baronie, called the burgh of baronie of Houstoun, with the priviledge of haveing a weeklie mercat within the said burgh, on [...] weeklie, and als of two free faires to be holden yearlie within the said burgh, one thereof upon the [...] day of [...], called [...], and the other thereof upon the [...] day of [...], called [...], each of them to continue for the space of eight dayes toggither yearlie, and to collect the tolls, customes and other casualities thereof, and to apply the samen to their owne proper use, and with all other priviledges, freedomes, liberties and jurisdictions of the samen granted to any other baronie or burgh of baronie within this his majesties' ancient kingdome, as in the said chartor at more length is mentioned; and siclike, by the said chartor, the foresaids haill lands of Nether Maines, with the castle and mannor place of Houstoun, and burgh of baronie thereof, the lands of Houstoun Crofts, Henriestounes, Bodrieckfield, Graviswrayes, Houstounheads, Barshegrie, Willingstoun, Williamstoun, Hall Craigs, Bullockstoun and Barloggan, with the milne and milnelands of Houstoun, all and haill the ward lands of Houstoun, the lands of Easter and Wester Garvoicks, with the right of patronage of the paroch kirk and paroch of Houstoun, and fishing upon the water of Gryff, the lands of Inchboigfyff and Houstounglen, called Balglass, the halfe of the towne and lands of Wester Whitburne, with the milne and milnelands thereof, the lands and barone of Easter Whitburne, with the pertinents and anualrent foresaid, to be uplifted furth of the saids lands of Carribber, and lands of Auchin Cloich, with the milne and haill other pertinents of the samen, are of new united, erected, annexed and incorporat in ane haill and free baronie called, and to be called in all time comeing, the baronie of Houstoun, and the mannor place and tower of Houstoun ordained to be the principall messuage of the same, and ane seasing to be taken thereat to be sufficient for the haill; to be holden all and haill the foresaids lands and old baronie of Houstoun, comprehending the particular lands, milnes, woods, fishings and others above exprest, be the said Sir Patrick Houstoun, and his foresaids, of his majestie and his royall successors, princes and stewarts of Scotland, and all and haill the saids lands and baronie of Balglass, comprehending the particular lands, milnes, woods and others abovespecified, now united to the said baronie of Houstoun, as said is, off his majestie and his royall successors kings of Scotland, as superiors thereof, giveand yearlie the said Sir Patrick Houstoun, and his foresaids, to his majestie and his royall successors, princes and stewarts of Scotland, for the saids blensch ferme lands of Houstoun, milne and pertinents of the samen, extending to ane tuentie-one pound, sex shilling, eight pennie land of old extent, two pennies at the castle of Houstoun, at the feast of Mertimas in winter, in name of blensch ferme if the samen be asked allenerlie, and for the foresaids ward lands of Houstoun, tennents, tennandries and service of free tennents, with all pertinents of the samen, extending to eighteen pound, thretteen shilling, four pennie land of old extent, and the foresaid four pound land of Easter and Wester Garvoicks, with the pertinents, with the said burgh of baronie of Houstoun, liberties, priviledges, casualities and jurisdictions of the samen abovewritten, all lyand in maner foresaid, the rights and services used and wont, in maner aftermentioned, and likewayes, giveand yearlie the said Sir Patrick Houstoun of that ilk, and his airs male and assigneyes foresaids, to his majestie and his royall successors, kings of Scotland, for the haill remanent lands and others respective above mentioned, with the pertinents of old, unit in ane baronie, called the baronie of Balglass, now dissolved and separate therefrae and unit and annexed in maner abovementioned to the said baronie of Houstoun, all extending and lying as said is, the rights and services used and wont in maner aftermentioned allenarlie. Moreover, by the said chartor, it is expresslie provided and declared that when and how oft soever it should happen the foresaids ward lands of Houstoun and lands of Easter and Wester Garvoicks, with the pertinents, with the said burgh of baronie of Houstoun, liberties and priviledges of the same, and the foresaids lands and baronie of Balglass, comprehending as said is, now unit and annexed to the said baronie of Houstoun, to fall and become in his majesties' hands or in the hands of his royall successors, princes and stewarts of Scotland, be reason of ward and nonentrie or either of them, through the minoritie or defect of the airs male, assigneyes and successors of the said Sir Patrick Houstoun and his foresaids, in all time comeing, then and als oft notwithstanding of the said ward and nonentrie or either of them, it shall be leissum and laufull to the airs male and successors of the said Sir Patrick Houstoun, and his foresaids, peaceablie to bruik, joyse and possess all and sundrie the foresaids lands, baronie, milnes, woods, fishings, burgh of baronie and others respective abovementioned, with tennents, tennandries and service of free tennents, pairts, pendicles and haill pertinents thereof, and to intromett with and uplift the rents, fermes, caines, customes, casualities, profites and dewties of the samen, during the haill time of the said ward and nonentrie or either of them, als and swa oft as the samen shall happen in all time comeing, payand yearlie, the airs male, assigneyes and successors of the said Sir Patrick Houstoun and his foresaids, to his majestie and his royall successors, princes and stewarts of Scotland, for the foresaids ward lands of Houstoun, with tennents, tennendries, service of free tennents and all other pertinents thereof, extending to ane eighteen pound, thretteen shilling, four penny land of old extent, and for the foresaids four pound land of Easter and Wester Garvoicks, with the pertinents, with the said burgh of baronie of Houstoun, liberties and priviledges thereof abovewritten, during the space of the said ward and nonentrie or either of them, the soume of ane hundred and fiftie pounds Scots money yearlie, at two termes in the year Whitsonday and Mertimas in winter be equall portions, with the soume of ane hundred and fiftie pound[s] money foresaid for the releiff thereof, when the samen shall happen, and likewayes payand yearlie the saids airs male, assigneyes and successors of the said Sir Patrick Houstoun, and his foresaids, to his majestie and his royall successors, kings of Scotland, for the foresaids lands and baronie of Balglass, comprehending the halfe of the saids lands of Easter and Wester Whitburnes, and the other particular lands, milnes, yearlie anualrent and others respective abovespecified, with the mannor places, housses, biggings and all other pertinents thereof, now united and annexed to the said baronie of Houstoun, and lyand in maner respective abovementioned, during the space of the said ward and nonentrie or either of them, the soume of one hundred and fiftie pounds money foresaid yearlie, at the termes abovespecified, with the like soume of one hundreth and fiftie pounds money foresaid for the releiff thereof, when it shall happen, with the soume of ane thousand pounds money foresaid for the mariage of the aire or airs of the said Sir Patrick Houstoun, or his foresaids, succeeding to him in the saids lands, baronie, burgh of baronie and others respective abovewritten, als oft as the samen shall fall and become in the hands of his majestie or his royall successors, from time to time in all time comeing, to which soumes foresaids the ward, nonentrie, releiff and mariage respective are taxed and restricted be the said chartor; for payment whereof his majestie, for himself and his royall successors, kings, princes and stewarts of Scotland, gives, grants and dispones to the saids airs male, successors and assigneyes of the said Sir Patrick Houstoun, and his foresaids, all and haill the foresaid ward and nonentrie, with haill maills, fermes, profites and dewties of the saids lands, baronies and others foresaids, holden taxt ward as said is, during the haill time of the said ward and nonentrie or either of them, when the samen shall happen, with the releiff and mariage respective foresaids when the samen shall happen to vaik, and decernes, ordaines and declares that it shall be leissum and laufull to the appeirand airs and successors of the said Sir Patrick Houstoun, and his foresaids, to obtain themselves served and retoured as airs in speciall to their predicessors, and infeft and seased in the saids lands, baronies, fishings, right of patronage and others particularlie abovespecified, holden taxt ward as said is, notwithstanding they be minors for the time; whereanent and with all haveing interest his majestie, with consent foresaid of the saids lords of his majesties' exchequer, be the said chartor dispenses for ever, giveand yearlie the said Sir Patrick Houstoun, and his airs male and assigneyes foresaids, to his majestie and his royall successors, for all and haill the foresaid advocation, donation and right of patronage of the said parochin and paroch kirk of Houstoun, and all and sundrie teind sheaves and other teinds, great and small, parsonage and viccarage, fruits, rents, profites and emoluments thereof, the soume of tuelve pounds money foresaid yearlie at the terme of Whitsonday in name of blensch ferme, and that for the releiff of the said William, earle of Dundonald and William, lord Cochran, his sone, and their airs as ane proportionall pairt of the blensch ferme dewtie of two hundreth merks contained in their infeftments of the erection of the abbacie of Paisley, whereof the saids teinds are a pairt, as also reservand† the said earle and his said sone, of the minister's stipend serveing the cure at the said kirk, togither with the precept and instrument of seasing following thereupon in the haill heads, clauses, articles, provisions and conditions of the samen. And our said soveraign lord, with consent foresaid of his estates of parliament, decernes and ordaines the foresaid generall ratification to be als valid and sufficient and of als great strength, force and effect, to all intents and purposes, as if the said chartor and seasing were de verbo in verbum insert hereintill, albeit not swa done; whereanent his majestie, with consent foresaid of the estates of parliament, be thir presents dispenses for ever. And further, our said soveraign lord, with consent of the saids estates of parliament, off new gives, grants and dispons and, for his majestie and his royall successors, perpetually confirmes to the said Sir Patrick Houstoun, his airs male and assigneyes foresaids, heretablie and irredeemablie, all and haill the foresaid baronie of Houstoun, comprehending the lands, baronies, milnes, woods, fishings, teinds, right of patronage, burgh of baronie and others particularlie and generallie abovementioned, with the pertinents, lyand as said is, and now of new erected, united and incorporated in maner foresaid, and appoints the messuage to be and seasing to be taken as is abovespecified; to be holden of our said soveraign lord, and his majesties' successors, kings, princes and stewarts of Scotland, in fie heretage, baronie and burgh of baronie for ever, with all priviledges of ane baronie, burgh of baronie and others contained in the said chartor, for payment of the taxt ward dewties and other dewties contained in the chartor above confirmed and ratified, and dispenses with all nullities, faults and imperfections in and other grounds of the law competent against the said Sir Patrick Houstoun, and his foresaids, for reduceing, quarrelling or impugning their owne or their saids authors or predicessors rights of the foresaids lands, baronies and others foresaids, now unit in ane haill and free baronie, as said is, for whatsomever deed, cause or occasion bygone, and renunces and overgives the samen in their owne favours for ever.
