Anent a petition presented to the king's majesty and estates of parliament by John Hope of Hoptoune, bearing that the petitioner is of intention to impark and inclose a considerable quantitie of ground about his hous of Nidriecastle, which will require the changing of the publick highway a litle more then what is allowed by act of parliament, albeit without any prejudice imaginable to travellers, and sieing his majestie and estates of parliament have always hitherto given all encouragement to inclosures; humbly therfore, craveing that warrand might be granted to the petitioner to the effect under written. The king's majestie and estates of parliament, having heard and considered the foirsaid petition and report of the articles theranent, doe allow the petitioner to change the highway lyeing east and west upon the southsyd of the toun of Winshburgh from the place where it now is, to goe streight throw the toun of Winshburgh and east along by Muriehall, and lykways to change another byroad going from the southsyd of the hieway by east Nidrie Castle towards the new bridge from the place wher it now is, to the westsyd of Nidry Castle towards Bellsmilne, provyding always that before the petitioner change the way the ground be surveyed by such persons as his majesties' privy councill shall appoint, that it may appear if by the alteration ther will be any considerable prejudice to the leiges travelling that way.
