Our soveraigne lord, with advice and consent of the estates of this present parliament, ratifies and approves the chartor of donatione and concessione maid and granted be his majestie, undir his highnes['s] great seall, with advice and consent of his majesties' commissioners of his highnes['s] thesaurarie and remanent lords of his majesties' exchequer, to and in favors of his majesties' lovite David Kinneir of that ilke, and of the aires maill lawfullie procreat or to be procreat of his body, whilkis failyieing of the eldest aire female, without divisione, also laufullie procreat of his said body, whilkis failyieing of his other aires of taillie and provisione and assigneys whatsumever, particularlie mentioned in the samyn chartor forsaid, heretablie and irredemablie (with and undir the provisione and conditione therin speciallie contained) off all and haill the lands and barronie of Kinneir, comprehending therin the lands and others undirwrittin, to witt, all and haill the lands and maynes of Kinneir; all and haill the lands of Over Caitloch; and all and haill the lands of Easter and Westir Torres, with their castles, toures, fortalices, maner places, houses, biggings, yairds, orchyairds, parkes, woods, dowcats, milnes, milnelands, fishings, outsettis, annexis, connexis, tennents, tennendries, service of frie tennents, pairts, pendicles and all their pertinents whatsumever, lyand within the forsaid barronie of Kinneir and shirrefdome of Fyffe. Attour his majestie (with advice and consent forsaid) hes therby of new given, granted and disponed and, for his majestie and his highnes['s] successors, perpetuallie confirmed to the said David Kinneir, and his aires male and of taillie and provisione and assigneys forsaids, heretablie and irredeimablie, as said is (with and undir the provisione and conditione abovementioned) all and haill the samyn lands and barronie of Kinneir forsaid, comprehending therin the lands and others particularlie abovenamed, lyand in maner forsaid, togidder with all right, title, interest, clame of right, propertie, possessione, als wiel petitor as possessor, action and instance whatsumever, which his majestie, or his highnes['s] predicessors or successors forsaids had, hes or any wayes may have, clame or pretend therunto, be whatsumever reasoun, cause or occasione or other maner of way particularlie and generallie mentioned in the said chartor. Moreover, his majestie (with advice and consent forsaid) hes therby united, annexed, created and incorporat all and haill the lands, barronie and others particularlie above exprest, lyand as said is, in ane haill and frie barronie to be called, now (as of befor) and in all tyme comeing, the barronie of Kinneir, decerning and ordaining the toure, fortalice and maner place of Kinneir to be the principal messuage of the samyn barronie forsaid, and that ane sasine now to be taken be the said David Kinneir, and in all tyme comeing be his aires male and of taillie and provisione and assigneys whatsumever forsaids, at the same principal messuage abovewrittin, or upon the ground of anie other pairt of the saids lands and barronie abovewrittine, shall stand and be ane sufficient sasine to him and them, for all and haill the same lands, barronie and others particularlie abovenamed, without anie other particular sasine to be taken at anie other pairt therof, notwithstanding the samyn lyes not contigue togidder bot in diverse places, wheranent his majestie (be the said chartor) hes dispensed for evir, and which all and haill the saids lands and barronie of Kinneir, comprehending therin the lands and others particularlie abovespecified, lyand in maner forsaid, are (be the forsaid chartor) holdin be the said David Kinneir, and his forsaids, of his majestie and his highnes['s] successors forsaids, in frie barronie, fie and heritage for evir, for the said David Kinneir, and his forsaids, their yeirlie giving suite and presence to his majestie and his highnes['s] forsaids their thrie head courts of the sherifdome of Fyffe abovewrittine, and als for the yearlie payment to be maid be the forsaids aires and successors of the said David Kinneir to his majestie, and his highnes['s] successors abovementioned, of the taxt waird dewties particularlie undirwritten, viz, dureing the haill tyme of the waird and nonentrie of the lands, barronie, and others particularlie abovenamed, or aither therof when the samyn shall happin, in maner speciallie specified in the said chartor, the soume of twa hundreth merks good and usuall money of this realme of Scotland, at twa termes in the year Whitsunday and Martimes in winter be equall portions, togidder with the lyke soume of twa hundreth merkis money forsaid for the releiff therof, and for the mariage of the aires forsaids of the said David Kinneir and their successors abovewritten, swa oft as the same shall happin, the soume of fyve hundreth merkis money abovespecified, as is particularlie exprest in the forsaid chartor, whilke chartor abovewrittine is of the dait, at his majesties' court of Whitehall in his majesties' realme of Ingland, the first day of Jully last by past, togidder also with the precept and instrument of sasine respective following upon the samyn chartor forsaid, in all and sundrie the pointes, heads, articles, clauses and conditions whatsumever conteind in the said chartor, precept and instrument of sasine respective forsaids following therupon, as said is and in ilke ane therof, eftir the severall formes and tennors of the samyn respective. And farder, his majestie, with advice and consent abovewrittine of the forsaids estates of this present parliament, statuts, ordaines, wills and declaires that this present ratification abovementioned is and shall be als valide, effectuall and sufficient to the said David Kinneir, and his forsaids, as if the said chartor, precept and instrument of sasine respective abovewrittine following therupon, as said is, and ilke ane of them, wer all at lenth word be word ingrossed and insert heirin, albeit the samyn be not swa done; queranent his majestie, with advice and consent forsaid of the saids estates of parliament, be thir presenttis, dispenses for evir.
