The parliament being mett according to his majesties appoyntment, after prayers said be the b[ishop] of Dumblane, deane of his majesties chappel.
The earle of Lauderdail, his majesties comissioner, produced his majesties comission granted to him to represent his majesties person and authoritie in this parliament; which, being red, wes appoynted to be recordit, wherof the tenor followes etc.
Thairafter the rolls being called, the earle of Weemes, in name of the earle of Sutherland, protested that the calling of the earle of Sutherland in this parliament should not prejudge him of his right and precedencie before all the earles of the kingdoms.
The earle of Eglinton protested that the enrolling and calling of his lord after the earle of Glencairne should not prejudge him of his right and precedencie before the earle of Glencairne; and the Lord Bargany, in name of the earle of Glencairne, protested in the contrare.
The earle of Kingorne protested that the enrolling and calling of him after the earle of Wigton should not prejudge him of his right and precedencie before the earle of Wigtoun.
The earles of Dumfreis, Southesk and Weemes protested that the calling of the earle of Loudon before thame should not prejudge thame of ther precedencie before him, being all of thame earles before him severall yeeres, whyles he wes onelie a lord baron.
The earle of Eglinton, in name of the earle of Finlater, protested that the calling and enrolling of the e[arl] of Airlie before Finlater should not prejudge Finlater of his right and precedencie before Airlie.
The Lord†Rosse protested that the calling of the lord[s] Elphinston, Oliphant, Lovat and Borthuick before him should not prejudge him of his right and precedencie before thame; and the earle of Callander, in name of the Lord Elphinston, protested in the contrare.
The comissioners of the shyres of Fyffe, Aberden, Air, Perth and Forfar protested against the present order of calling of the shyres, and for ther right and precedencie before the other shyres who are now enrolled before thame.
The earle of Home, in name of the Lord Mordington, protested for his right and precedencie before the Lord Cathart and Lord Sinclar.
The comissioner for the toun of Glasgow [protested] that the rankeing and calling of the toun of Glasgow in this parliament doe not prejudge thame of ther precedencie before other burghs now called before thame.
After the calling of the rolls, the court of parliament wes fenced be the clerk of register in the usuall forms.
The lord comissioner produced a letter from his majestie of the 15 of September, which being tuyse red wes appoynted to be recordit and to be considered be the lords of articles etc.
Oath of alledgeance and oath of parliament taken be all the members and the declaration subscribit.
The lord comissioner haveing moved that according to the forme formerlie used the lords of the articles should be chosen, the parliament wes adjornd for a litle, and the bishops reteired to the counsel chamber and made choise of the duke of Hamilton, the marques of Douglas, the earles of Argyl, Erroll, Atholl, Dunfermline, Tueedal and Kincardin of the nobilitie to be on the articles. And the nobilitie went to the inner hous of session and made choise of the archbishop of St Andrews, bishop [of] Edinburgh, Galloway, Aberden, Rosse, Brechen, Dunblane and Orkney to be of the articles for the clergie. Then the persons aforsaids nominat for the clergie and nobilitie haveing mett togidder nominat Sir Johne Gilmor, Sir James Lockhart, Halton, Limplum, Cromlix, Blackbarrony, Ochiltrie and Sir Alexander Fraser to be on the articles for the gentrie; and Sir Andrew Ramsay, the comissioners of Perth, St Andrews, Aberden, Linlithgow, Air, Selkirk and Northberwick to be on the articles for the borrowis. Which nomination being presented to the lord comissioner, his grace did approve therof; and the parliament being againe mett togidder, and this nomination red unto thame, the samen wes approven and the officers of estate adjoynd therto. Which lords of the articles are appoynted to meit to morrow be ten hours in the fore noone in the session hous, and therafter as they shall be appoynted be the lord commissioner.
Forasmuch as in several shyres as Berwick, Stirlin [and] Kincardin and in the burgh of Cromertie there be some difference as to the legalitie of the election of ther comissioners to this parliament, ther being double comissioners chosen in these places, the lord comissioner nominat the archbishop [of] St Andrews, the bishops of Galloway and Rosse, the d[uke of] Hamilton, e[arls of] Tueeddal and Dundonald, Craigmellor, Halton and Haddo, the comissioners for Edinburgh, Perth and Stirlin, and the officers of estate to be supernumerarie, or to any fyve of thame, there being one of everie estate present, to be a committee to consider of these elections; to heare the parties concerned and to report ther opinion. This comittee to meit to morrow at eight of the clock and therafter to appoynt ther owne meitings.
The lord comissioner adjorns the parliament till Thursday the 21 at three of the clock in the afternoone.
