Our soverane lord, with advice and consent of his estates of parliament, ratifies and approves and, for his hienes and his successors, perpetually confirmes, the lease or tack made and granted be his majestie, under his hienes['s] privy seale, of the date the tuentie-thrid day of Aprile last bypast, to his majesties' right trustie and wellbeloved cousing and counsellour James, earle of Newburgh, makeing mention that by a late signature dated the [...] day of [...], his majestie (for the good service and loyaltie of the said earle of Newburgh) had set and in tack and assedation lettin to the said earle all the custome of the borders betuixt England and Scotland, within which bounds the custumes of all goods imported or exported at Portpatrick in Galloway, from the river of Stencher inclusive, to the river of Nith inclusive, are not expressed, notwithstanding it wes his majesties' intention to include the same in the said gift. Thairfor, his majestie, with advice and consent of his right trustie cousing and councellour Johne, earle of Crafford and Lindesay, lord Struthers and Parbroth, his majesties' great thesaurer, controller and collector general and thesaurer of his majesties' new augmentations within the kingdome of Scotland, and also of his hienes['s] wellbeloved councellour William, lord Bellenden, his hienes['s] deput in all the forsaids offices, and of the remanent lords and others of his majesties' exchequer of the said kingdome, set in tack and assedation for the yeerly duetie therinspecified to the said James, earle of Newburgh, for the haill space, yeers and termes of fyve full and compleit yeers, and from fyve yeers to fyve yeers untill the issue and expyreing of tuentie yeers, and for the space of one yeer therafter, all and haill the customes of all goods and merchandice, which have been in use to pay custome, imported or exported by whatsoever persone or persones within these bounds forsaids, at whatsoever porte, haven or harbour, creik or rock, with the libertie of cocket and searchrie, with power to seaze upon all goods prohibited to be transported, and upon all goods and commodities exported or imported within the bounds, or at any of the places aforsaid, which are customeable and have not payed their due customes, the saids goods so seazed upon being alwayes escheit, the one halff to belong to his majesties' exchequer and the other halff to the said James, earle of Newburgh and his assignayes; the said James, earle of Newburgh, his entrie to the said tack is therby declared to have been and begin imediatlie from the last day of December 1660 yeers, and that he hes right to the haill bygone customes since that tyme and in tymecomeing dureing the space abovewritten, in the haill heids, articles and clauses therof, declareing heirby this present generall ratification to be als valeid, effectuall and sufficient as if the forsaid tack wer word be word insert heirintill; wheranent and with all other defects and imperfections whatsomever that may be anywayes objected against the forsaid tack, or this present ratification thairof, our said soverane lord, with advice and consent forsaid, hes dispenced and heirby dispenses for ever. Lykeas his majestie, with consent abovewritten, doth heirby declare and ordeane that the said James, earle of Newburgh and his forsaids shall peceably brooke, joyse and possesse the forsaid customes within the bounds abovespecified, conforme to the tenor of the forsaid tack, dureing the haill yeers and space abovementioned, without any let or interruption whatsumever.
