Our soveran lord, considering that by the threttie-nynt act of the first session of his majesties' first parliament entituled, act for the fishing and erecting of companies for the same, the teind herring and teind fish of all the herring and fishes which shall be taken by the boats and fishers of the companies mentioned in the act are released and discharged; and seing his majestie hath be the first act of this second session of his first parliament restored the office and estate of bishops, not only to their dignities, priveledges and jurisdictions, bot also to their benefices, haill proffeits, rents, casualities and emoluments of the same, in maner as is more largelie set doun in the said act, and that a great parte of the rents and revenews of the bishoprick of the Yles doth consist in the teind of herring and fish mentioned in the forsaid threttie-nynt act; thairfor, his majestie, with advice and consent of his estates of parliament, casses, annulls and rescinds the forsaid clause anent the discharge of the teind of herring and fish contained in the said act, in sua far as the samen may be interpret to extend to the teind of herring and fishes taken within the bishoprick of the Yles; and notwithstanding of the forsaid clause, ordaines the present bishop and his successors bishops of the Yles to enjoy, possesse, uplift, receave and otherwise to dispose upon the teind herring and teind fish of all fish and herring taken within the bounds of the bishoprick, als fullie and freely as his predicessors bishops of the Yles hath heirtofore done and enjoyed, but prejudice alwayes of the forsaid release and discharge indulged to the companies, mentioned in the said act of the teind of all herring and fish taken in all places outwith the bounds of the said bishoprick, wheranent his majestie and estates forsaids wills and ordaines the same to stand in vigor and effect as formerly.
