The second session of the first parliament of our most heigh and dread soverane, Charles, be the grace of God, king of Scotland, England, France and Ireland, defender of the faith, holden and begun at Edinburgh the eight day of May, one thousand, sex hundreth [and] threescore tuo yeers, be Johne, earle of Midletoun, lord Clermont and Fettercairne, be vertew of the speciall commission under his majesties' great seale, with the advice and consent of the estates of parliament underwritten, ther being also present the ordinarie officers, earle of Erroll, constable, earle of Marishall, Sir Robert Murray, provest of Edinburgh, Mr William Wallace, shirreff and Andrew Lothian, dempster.

The which day the lord commissioner produced to his majesties' commission granted to him under his majesties' great seale for holding of this parliament, whairof the tenor followes.
Carolus, Dei gratia, Scotiae, Angliae, Franciae et Hiberniae rex, fideique defensor, probis hominibus suis ad quos praesentes literae nostrae pervenerint salutem. Sciatis quandoquidem nos bonis rationibus praeviis mense Decembris anno Domini millesimo sexcentesimo sexagesimo, praedilectum et fidelem nostrum consanguineum et conciliarium Joannem Comitem de Midletoun, Dominum Clermont et Fettercairne etcetera, et commissionarium nostrum pro parliamento in regno nostro Scotiae tenendo authoritate nostra munivimus cumque dictus comes hactenus in obeunda antedicta commissione non vulgare specimen eius fidelitatis prudentiae et obsequij exhibuerit, ac regiam nostram prerogativam† et regni nostri jamdudum interruptam pacem stabiliverit, idcirco ratificavimus et approbavimus tenoreque praesentium ratificamus et approbamus eius fidelem executionem dictae nostrae commissionis ac declaramus dictu comitem nobismetipsis ecclesiae et dicto regno nostro Scotiae egregium seruitium prestitisse et quia dictum parliamentum a nobis declaraturn fuit currens et continuatum ideo declaramus commissionem dicto comiti de Midletoun prius concessam in pleno vigore ad omnia negotia inibi specificata adhuc persistere et non solum ratificamus et redintigramus eandem verum etiam perpendentes stabilitam securitatem regiae nostrae authoritatis ac pacis et regiminis huius ecclesiae et regni nostri post tot annorum incompositos motus et tumultus, majorem curam et ampliorem fiduciam et commissionem quam tempore stabilitae pacis in presentiarum postulare; ac satis compertum habentes prudentiam diligentiam et obsequium dicti praedilecti nostri consanguinei et conciliarii Joannis Comitis de Midletoun etc., eundemque ad nostra imperata exequenda sufficienter instructum esse; igitur de novo absque prejudicio prioris commissionis dedimus et concessimus, tenoreque presentium damus et concedimus nostram plenam potestatem et commissionem dicto comiti de Midletoun nostram sacratissimam personam et authoritatem in reliquis dicti nostri parliamenti conventibus representandi cc omnia et singula quae in bonum et emolumentum ecclesiae eiusque de jure stabilitum regimen per archiepiscopos et episcopos in omnibus eorum juribus et privilegiis ac in publicam pacem et gubernationem dicti regni nostrique servitii in eodem propagationem in omnibus administrationibus ejusdem cedant obeundi et exercendi; ac cuncta alia de jure et consuetudine hujus regni ad officium et mandatum nostri commissionarii spectans vel qui alii simile munus prius obeuntes fecerunt vel facere potuerunt gerendi et prestandi. Mandamus porro omnibus nostris officiariijs status, conciliaris, judicibus, legumue nostrarum ministris et cunctis aliis nostris subditis, ut debita reverentia afficiant agnoscant et morem gerent dicto comiti tanquam nostro commissionario nostram sacrosanctam personam et authoritatem representanti ad effectum et modo in dicta commissione specificato quamquidem commissionem durante proxima sessione nostri parliamenti et semper donec eadem per nos specialiter inhibeatur in pleno vigore persistere ordinamus. In cujus rei testimonium praesentibus magnum sigillum nostrum appendi precepimus apud aulam nostram de Whitehall vigesimo nono Januarii anno Domini millesimo sexcentesimo sexagesimo secundo et anno regni nostri decimo tertio. Forasmuch as the king's majestie hath been graciouslie pleased to restore the church to its antient and right government be archbishops and bishops, dean and chapter, yet seing by the troubles and confusions these tuentie-four yeers past that government hes been suppressed, so as thair election and establishment at this tyme could not be in the forme prescryved be the act of parliament be dean and chapter; his majestie hes, with advice and consent of his estates in parliament, thought fit to dispense with the present manner of election, and declares the same to be sufficient and good and als valeid as if the same had been done be dean and chapter; and therfor, his majestie, with advice forsaid, ratifies and approves the same. And considering that the clargie did alwayes, in the right constitution of parliaments, represent the first state, and that now archbishops and bishops being restored, it is fit the parliament be returned to its antient constitution, and that the clargie have thair place and vote in parliament as formerlie; thairfor, his majestie, with advice forsaid, gives commission to the earles of Kellie and Weymes, the Lord Torphichen, the lairds of Crommerty, Blakbarronie and Prestoun, the commissioners for Edinburgh, Air and St Andrewes, to goe and, in his majesties' name, invite the archbishops and bishops to come and take thair place, and vote in parliament as in former tymes befor these troubles, which wes accordinglie done.†

The which day the archbishops of St Andrewes and Glasgow, the bischops of Galloway, Dunkeld, Murray, Ross, Breichen, Caithnes and Iles, being brought in to the house, tooke the oath of alledgance and oath of parliament.
The lord commissioner adds the nyne bishops abovenamed to the lords of the articles, and also adds Sir Johne Wrwhart of Crommertie in place of Sir Alexander Gibson of Durie, and it is declared that the nomination and constituon of the articles at this time shall be without prejudice of what course his majestie shall take heirafter for the constitution of the articles.
The lord commissioner continews the parliament till Tuisday at tuo hours in the afternoone etc.
