Edinburgh, 10 May 1661
George, erle of Linlithgow, of the age of threttie eight yeares and above, solutus, being sworne, purged of partiall counsell and malice and being examyned if he knoweth quhither Sir Archibald Jonstone of Warriestone sat in the pretendit parliament of Ingland as ane peere in the house called the uther house, depones that he being at London in the yeare 1658 he heard it comonly reported that at that tyme the said Sir Archibald sat as ane peere in the said house and parliament, but never did see him sitt himself.

Archibald Murray, yonger of Blakbarronie, of the age of twentie sener yeares or therby, solutus, being sworne, purged of partiall counsell and malice, being interrogat if he knaweth quhither Sir Archibald Jonstone of Warriestone sat in the pretendit parliament of Ingland as ane peere in the house called the uther house, depones that he being at London in the yeare 1658 he heard it reported that at that tyme the said Archibald did sitt in the said howse and parliament, that he did see him goe towards the said howse, and heard the said Sir Archibald himself say that he sat in the saids howse and parliament.

Sir Alexander Gibson of Durie, knight, of the age of 32 yeirs or therby, maried and purged of partiall consill and enimitie against Sir Archibald Jonston of Wariestone, being interogat if he knew or saw the said Sir Archibald sit as on[e] of the peers in the parliament of Ingland in anno 1658, deponis he both knew he sat and saw him siting as a peir in Richard's parliament in anno forsaid or therby.

Mr Robert Burnet, youngar, advocat, being suorne, deponis he hard it constantlie reported and beliewes that Sir Archibald Jonstoun of Wariestone got ane call fra Richard, pretendit protector, to sit as a peir in his parliament 1658. And conforme therto he believes he went to Londone and sate as a peir.

Mr James Hamilton, minister, of the age of 60 yeirs or therby, maried, purged of partiall consill and enimitie against Sir Archibald Johnstone of Wariestone, deponis that he wes at that meeting in Mr William Arthor's hous neir the West Kirk wher the act called 'The act of the West Kirk' wes maid; and that the said Sir Archibald Jonston wes ther and consented therto, being upon the 13 day of August 1650; and the printed act being showin to him, he perfyctlie remembers the first part therof unto the wordis and therof, bot if the wordis following wer concludit upone, he does not perfyctlie remember. And deponis that Mr Andro Ker wes clerk therto.

Mr Andro Ker, of the age of 40 yeirs and above, solutus, purged of partiall consill and enimitie against Sir Archibald Johnston of Wariestoun, deponis (having red the printed copie of the act called 'The act of the West Kirk') that ther wes sum appoynted for drawing of ane act to that purpose, wherof the said Sir Archibald wes on[e]. And the draught wes brought in be them, past by pluralitie of votis, conforme to the tenor of the said printed act. And to his remembrance he thinkis the said Sir Archibald consented to the said act.
